WAIVER AND RELEASE OF LIABILITY
In consideration of Wild Water West Waterpark and The Adventurepark furnishing services and/or equipment to enable
me to participate in paintball games, I agree as follows.
I fully understand and acknowledge that: (a) risks and dangers exist in my use of paintball equipment and my participation
in paintball activities; (b) my participation in such activities and/or use of such equipment may result in my injury or
illness, including, but not limited to bodily injury, disease strains, fractures, partial and/or total paralysis, eye injury,
blindness, heat stroke, heart attack, death or other ailments that could cause serious disability; (c) these risks and dangers
may be caused by the negligence of the owners, employees, officers or agents of WWW, the negligence of the
participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes. These risks and
dangers may arise from foreseeable or unforeseeable causes; and (d) by my participation in these activities and/or use of
equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in
whole or in part by the negligence or other conduct of the owners, agents officers, employees of WWW, or by any other
person.
I, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, waive, discharge,
hold harmless, defend and indemnify WWW and it’s owners, agents, officers and employees from any and all claims,
actions, or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of
my use of paintball equipment, or my participation in paintball activities, I specifically understand that I am releasing,
discharging and waiving any claims or actions that I may have present or in the future for the negligent acts or other
conduct by the owners, agents, officers or employees of WWW.
I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE THAT IT IS MY
INTENTION TO EXEMPT AND RELIEVE WILD WATER WEST WATERPARK AND FAMILY
AMUSEMENT PARK FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, OR
WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE. REMEMBER, YOU ARE
PLAYING AT YOUR OWN RISK!

SAFETY RULES – PLEASE READ!
1.
SAFETY GOGGLES MUST BE WORN AT ALL TIMES. Do not remove your goggles for any reason while on the playing
field. If you see anyone with their goggles off, DO NOT shot them. Tell them to put their goggles on and notify the referee immediately.
Anyone lifting or removing their goggles on the field (FOR ANY REASON) will be asked to leave the playing field for the day.
THIS IS FOR YOUR SAFETY!

BARREL PLUGS MUST BE USED AT ALL TIMES WHEN NOT ON THE PLAYING FIELD. Barrel plugs are
required in all areas except the playing field. Do not shoot your paintmarker in the staging area, even if you think you are out of paint.
NO SHOOTING AT THE HEAD OR NECK. Players may never intentionally fire at another player’s head. Players must always
be looking at their targets.
4. NO SHOOTING OUT OF THE PLAYING FIELD OR OVER THE NET. Players may not shoot their paintmarkers when
outside the playing field or shoot over the net, once inside. Violation of this rule may result in lost playing privileges for the day. Fees will
NOT be refunded.
5. NO VERBAL ABUSE OR FIGHTING WILL BE TOLERATED. No profanity, name-calling or slurs against anyone’s race,
color, religion, national origin or family member will be tolerated. Fighting of any kind is not permitted on the premises. ALL PARTIES
INVOLVED WILL BE TOLD TO LEAVE – NO ARGUMENTS, NO EXCUSES, JUST LEAVE…FEES WILL NOT BE REFUNDED.
6. IF AN INJURY OCCURS, THE GAME IS STOPPED IMMEDIATELY. If you see someone who has been injured, please
alert the players and referee to stop the game immediately.
7. NO CLIMBING ON FIELD BARRICADES. Players are not to climb or try to move any of the barricades or bunkers.
8. NO ALCOHOL OR MOOD-ALTERING DRUGS ARE ALLOWED. Any players suspected of drug or alcohol use are not
allowed on the premises and will not be allowed to play.
9. NO SMOKING IS ALLOWED WHILE PLAYING PAINTBALL. Players are not allowed to smoke anywhere in the
Commando Outpost instruction booth, staging area or on the paintball field.
10. DO NOT ATTEMPT TO DISMANTLE ANY PARTS FROM THE PAINTMARKERS. Players are never allowed to take
apart any of the paintmarkers. If you are having a problem, please report it to the referee as soon as possible.

HIT PLAYER RULES
1. 20FT. SHOOTING RULE. If you sneak up within 20feet of an opposing player, that player is considered out. Do not shoot anyone
from point blank range, if you do, you are out, no questions asked.

WHEN YOU ARE HIT. DO NOT REMOVE YOUR GOGGLES. Yell “HIT” or “OUT” loudly and put your barrel plug in
your paint marker, hold your paintmarker up, continue to say, “HIT or “OUT” while exiting the field. REMEMBER! ANYONE
COUGHT LIFTING OR REMOVING THEIR GOGGLES WHILE ON THE FIELD (FOR ANY REASON) WILL BE ASKED TO
LEAVE THE PLAYING FIELD FOR THE DAY. THIS IS FOR YOUR SAFETY!
AFTER THE GAME. After the game is over, immediately put your barrel plug in the paintmarker, DO NOT REMOVE YOUR
GOGGLES and exit the field to the staging area.
REFEREE’S DECISIONS ARE FINAL
Players are not allowed to argue with any referee. Referees will be happy to discuss any call after the game.
I ACKNOWLEDGE I HAVE READ THE ABOVE SAFETY RULES AND AM AWARE THISE RULES WILL BE STRICTLY
ENFORCED BY COMMANDO PAINTBALL PERSONNEL. I FURTHER AGREE I WILL NOT REMOVE MY GOGGLES
UNTIL INSTRUCTED TO DO SO. IF I SEE ANYONE BREAKING THESE RULES, IT IS MY RESPONSIBILITY TO NOTIFY
COMMANDO PAINTBALL PERSONNEL. IF I HAVE ANY FURTHER QUESTIONS, I UNDERSTAND I MAY ASK THEM
DURING THE ORAL SAFETY ORIENTATION GIVEN TO ME, AND/OR MY GROUP.
SAFETY IS YOUR RESPONSIBILITY. REMEMBER, YOUR ARE PLAYING AT YOUR OWN RISK.
