International Society for Transgenic Technologies Inc. (“ISTT”) is a New York non-profit corporation,
formed on May 21, 2013, exempt from U.S. Federal income tax under section 501(c)(3) of the
Internal Revenue Code.
ISTT offers the Website to its users (collectively, the “Users” and each a “User”), conditioned on the
acceptance of the terms, conditions, and notices contained herein, without modification. User access
and use of the Website constitutes acceptance of these terms and conditions. User further agrees to
use the Website as permitted by applicable local, state and federal laws.
ISTT reserves the right to modify the terms and conditions of this legal notice at any time and without
prior notification.
Content
ISTT does not control all content available through the Website nor does it have any obligation to
review, refuse or remove any content available through the Website. The User understands and
agrees that he or she may be exposed to materials and content that he or she may find offensive,
indecent, or objectionable, and agrees to use the Website at his or her sole risk.
Modifications to the Site
The User understands and agrees that ISTT reserves the right to modify, suspend or discontinue,
without prior notification, any part or all of the Website or the services provided though the Website
at any time and that ISTT will not be liable to the User or any other person for doing so, even if such
modifications make it more difficult or impossible for the User or any other person to interact with the
Website or obtain a service though the Website.
Security Notice
The Website is part of the ISTT web server system (the “System”). ISTT monitors the Website for
security purposes to ensure it remains available to all users and to protect information in the System.
All Users of the Website expressly consent to all monitoring activities of ISTT at all times.
ISTT does not and cannot guarantee the safety of personal information transmitted over the Internet
from possible interception. Users are authorized to access only the documents listed in the Website’s
menus. Unauthorized access to the Website, its contents or the System is prohibited and potentially
subject to criminal and civil penalties under applicable law. Unauthorized attempts to defeat or
circumvent security features, to use the Website or the System for other than intended purposes, to
deny service to authorized users, to access, obtain, alter, damage, or destroy information, or
otherwise to interfere with the System, the Website or their operation is prohibited. Evidence of such
acts may be disclosed to law enforcement authorities and result in criminal prosecution and/or civil
liability under applicable laws.
Privacy Notice
ISTT collects no personal information about a User without the User’s knowledge, although a User
may choose to provide this information to ISTT in specific instances. However, ISTT collects and
stores certain information automatically:




The Internet Protocol (IP) address of the domain from which a User accesses the Internet,
whether the User’s individually or provided as a proxy by the User’s Internet Service Provider
(ISP);
The date and time a User accesses the Website;
The pages a User visits; and
The Internet address of the website from which a User linked directly to the Website.
ISTT uses the summary statistics of the information collected to make the Website more useful to
users (such as assessing what information is of most and least interest to users and for other
purposes such as determining the Website's technical design specifications and identifying system
performance or problem areas). This information is not shared with anyone beyond the support staff
for the Website, except when required by law enforcement investigation.
Copyright Status and Proprietary Rights
All contents of the ISTT internet domains, including all written texts, images, sound and film files,
computer programs and all other materials contained therein are protected by their corresponding
intellectual and industrial property rights, and belong to ISTT or entities with links to ISTT or third
parties authorized by ISTT to use this material. However, documents provided by the Website may be
freely distributed and used only for non-commercial, scientific and educational purposes, and ISTT
should be cited as the provider of these documents.
Links and Third Parties’ Websites
The Website provides links and pointers to third party Internet pages and websites. These third party
pages and websites are not under ISTT’s control and ISTT does not assume any responsibility or
liability for any information, communications or materials available at such websites, or at any link
contained in such websites. These third party sites and links are provided for convenience only and
are not to be treated as referrals or endorsements of such sites and/or links by ISTT. User assumes
sole responsibility for use of third party links and pointers. The User understands and agrees that
ISTT (i) is not responsible or liable for any injury, loss, or damage the User incurs as a result of his or
her interactions with third parties through links or pointers provided in the Website, and (ii) will not
become involved in the event of a dispute between the User and any other individual, organization or
third party.
No Endorsement
Reference to any specific commercial product, process, or service by trade name, trademark,
manufacturer, or otherwise does not necessarily constitute or imply endorsement, recommendation,
or favouring by ISTT. The views and opinions of document authors do not necessarily state or reflect
those of the ISTT.
Disclaimer of Warranties
Use of the Website is at the User’s sole risk. ISTT endeavours to keep the information provided in the
Website up to date and correct but such information, services, data and other content provided in the
Website may be inadvertently erroneous or inaccurate. The Website and all information, services,
data and other content provided therein is for general purposes only and is provided on an “as is” and
“as available” basis without warranties of any kind. The User assumes all risks associated with the
use of the Website, including but not limited to risks (i) of any harm to him or herself or to others,
and/or (ii) to the User’s computer, systems, software or data being damaged by any virus, software,
or any other file which might be transmitted or activated via use of the Website or the System.
ISTT, its members, directors, officers, employees, agents, subsidiaries and affiliates (collectively, the
“Related Parties”) expressly disclaim all warranties of any kind relating to the Website or any
information, data, products, services or other content available through the Website, whether express
or implied, including, but not limited to, the implied warranties of merchantability, fitness for a
particular purpose, title and non-infringement. Without limiting the foregoing, ISTT and the Related
Parties disclaim any and all warranties, express or implied, for any products or services offered via the
Website.
ISTT and the Related Parties make no warranty that (i) the Website will meet the User’s
requirements; (ii) the Website will be timely, secure, error-free, operate in an uninterrupted fashion or
be provided free of viruses or other harmful components; (iii) anything available through or obtained
from the Website (including, but not limited to, author-generated content) will be accurate, reliable,
complete, adequate, timely, suitable, available or useful; (iv) the use of any information, data,
documents or other content obtained through the Website will not infringe privately owned rights; and
(iv) any errors will be corrected.
Only the limitations which are allowed and lawful in the User’s jurisdiction will apply to the User.
ISTT’s liability and the liability of the Related Parties, if any, will be limited to the maximum extent
allowed by applicable law.
Disclaimer of Damages
ISTT and the Related Parties shall not be liable to the User or any third party for any direct or indirect,
incidental, consequential, special, punitive or exemplary damages, including, but not limited to,
damages for loss of profits or revenues, loss of goodwill, loss of use, loss of data or other intangible
losses (even if ISTT and/or the Related Parties have been advised of the possibility of such damages),
resulting from: (i) use, the inability to use or the misuse of the Website or any content provided
therein; (ii) the cost of obtaining substitute goods or services; (iii) unauthorized access to or alteration
of the User’s transmissions or data; (iv) statements or conduct of any users of the Website or any
third party on the Website; (v) any information, product, or service the User obtains through the
Website; or (vi) any other matter relating to the Website.
Indemnity
As a condition to use of the Website, the User agrees to indemnify ISTT and the Related Parties
against any and all liability, expenses and damages arising out of claims resulting from the User’s use
of the Website.
