About this insurance
This document is intended to assist in understanding the main features and benefits of our Contaminated Land - No or Passed*
Environmental Search Indemnity Policy and the limitations that apply so that you can consider if it is suitable for the required
purposes.
Please also read the policy to understand its full terms and conditions.
What the policy covers
This policy will not cover
This policy provides protection from financial loss that
might arise in the event of the local authority or the
Environment Agency advising the insured of their intention
to serve, or the service of, a notice in relation to
contamination of the property and requiring the clean-up
of such contamination.
• any property that is not in England or Wales
• any property that together with any land ancillary to the
residential use of the property exceeds 1 acres
• any property that is not used as a residential dwelling or
had not been used as such for at least 24 months at the
commencement of the policy
• any property built or converted within the 24 months up to
the commencement of the policy, or within 10 years of the
commencement of the policy in the case of a construction
or conversion supported by an NHBC or Architect’s
Certificate
• any property that was built or converted under a self-build
scheme less than 10 years prior to the commencement of
the policy
• any property which was designated under the
Environmental Protection Act, or was under investigation in
relation to contamination issues at or prior to the
commencement of the policy
• loss arising directly or indirectly from or contributed by:
o any act or omission by the insured or anyone
acting on their behalf
o any act of vandalism or dumping perpetrated by
any party after the commencement of the policy
o harm or pollution attributable to radioactive
substances
o toxic, mould mycota, fungus, mould, mildew,
asbestos and other contamination transmitted
from the building into the ground at the Property.
o any act of terrorism.
Who is insured
The persons purchasing the property at the
commencement of the policy and all of their lenders whilst
they own the property.
The benefit of this policy does not extend to
successive owners of the property.
How long the policy is valid
This policy is provided for either a term of 10 years of a
term of 15 years from its commencement date as is stated
as the Period of Insurance in the schedule of the policy.
Additional important factors to consider
In addition to the circumstances which the policy will not cover it is important to understand that:
(a) the maximum amount the Insurer will pay is the limit of indemnity shown on the policy
(b) the policy provides financial compensation only
(c) the policy may not pay if the insured discloses the existence of the policy to anyone other than their
respective mortgagees and respective legal advisers.
(d) The policy does not provide cover for the cost of disturbance to the property or the cost of finding alternative
lodgings during any remedial works

The insured must give written notice as soon as possible of any claim or circumstances likely to give rise to a claim to

Cancellation Rights
The insured is entitled to cancel the policy within 14 days of receiving it. Any refund will be made to the party who paid
the premium.
If you do cancel, you may be in breach of the terms of your mortgage or the terms of the contract for the sale of the property.
If you are in doubt, you may wish to seek legal advice prior to cancellation.

We are covered by the Financial Services Compensation Scheme (FSCS).
If We fail to carry out our responsibilities under this policy, you may be entitled to compensation from the Financial Services
