TERMSANDCONDITIONS
ThesearethegeneraltermsandconditionsfortheMTVBaseVJSearchNigeria
2016(the"Competition").Theserulesgoverntherelationshipbetweenyouand
MTVNetworksAfrica(Pty)Limited("MTV")whenyouentertheCompetition.By
participating in the Competition, you agree to be bound by these Terms and
ConditionsaswellasMTV’sGeneralCompetitionRules(whichmaybeamended
or varied at any time by us with or without notice) which may be found at
http://www.mtvbase.com/info/general-competition-rules.
1. Term
TheCompetitionwillcommenceon13July2016andwillbeopenuntil
23h59pmon24September2016
2. EligibilityCriteria
ToentertheCompetition,youmust:
• BeaNigeriancitizenorbeeligibletoworkfulltimeinNigeriawithout
therequirementofaworkpermit,
• Bebetweentheagesof18-25yearson13July2016(Winnerswillbe
requiredtoshowproofofage);
• SpeakfluentEnglish;
• Havenocriminalrecord;
• Not be an employee of MTV, its parent, subsidiaries, affiliates,
associated and group companies or be associated with any other
company or person involved in the Competition (including but not
limited to any sponsor, media partner, or any other company or
individualinvolvedintheCompetition),theirfamiliesoragents,
• Notcurrentlybe,orhavebeen,apresenteronanymajortelevisionor
radiochanneltransmittedinSubSaharanAfrica;
• NothavewonanypreviousMTVVJsearches;
• (If you win) be able to enter into an exclusive presenter agreement
with MTV for a period of either 6 months or 1 year (at MTV's sole
discretion)

3. EntryandApplicationForms
To enter the Competition you must meet the Eligibility Criteria and
accurately complete and sign the online Application Form (including any
Release).Allformsmustbefilledoutcompletelyandtruthfully.Ifyoufailto
completeanyform,giveanyfalseinformation,orfailtorevealanypertinent
informationyoumaybedisqualifiedfromtheCompetition.
4. Auditions
Auditiondates,timesandlocationswillbeadvertisedinadvance.Youmust
attendtheauditionswithvalididentificationAFTER FILLING THE ONLINE
APPLICATION FORM and any other paperwork or terms and conditions
requiredontheday.IfyoumeettheEligibilityCriteriayouwillbeassigned
anauditionnumber.MTVwillaimtoauditionthefirst300eligibleentrants
howeverMTVdoesnotguaranteetodoso.
5. FilmingRelease
You agree that MTV has the right to film, record, tape and photograph you
during and in connection with the filming of the Competition You hereby
assigntoMTVallpresentandfutureintellectualpropertyrightsandrelated
rights (including, without limitation, copyright and performer's property
rightsandalllikerights)inandtoyourappearanceinthefilms,recordings,
videotapes,photographsand/oranyothermaterialscreatedbyoronbehalf
of MN pursuant to this Competition (the "Footage"). You hereby grant all
necessaryconsents,includingthoseundertheCopyrightAct98of1978(as
modified, amended or re-enacted from time to time) or otherwise, to MTV
and its affiliates worldwide to use and exploit all rights assigned to MTV
underthisclause,foreverandthroughouttheworldinanyandallmedianow
knownorhereafterdiscovered,withoutrestriction.Youunconditionallyand
irrevocably waive, in favour of MTV its affiliates, licensees, assigns and
successors in title, such rights including those under Section 20 of the
CopyrightAct98of1978(asmodified,amendedorre-enactedfromtimeto
time) and, so far as is legally possible, any and all moral rights or similar
rights as you now have or hereafter acquire anywhere in the world in
relation to your appearance in the Footage and every part thereof. All right
andtitleinandtotheFootageshallvestinMTV,andMTVshallbeentitledto
use and exploit the Footage in whole or in part, in the Competition or any
production thereof or otherwise, as it may at its absolute discretion
determine. MTV shall have the right to assign and/or license the rights
(includingtheFootageitselforexcerptsthereof)grantedtoMTVunderthese
TermsandConditionstothirdpartieswithoutrestriction,
6. BehaviorDuringAuditions
You must not swear during the audition or do or say anything which is
obscene, defamatory, infringes any third party rights or may damage or
prejudice the interests of MTV or any of its sponsors or partners. You must
not bring any weapons, alcohol, drugs or controlled substances to the
audition.Youmustnotwearanyclothingwhichcontainsprominentdesigner
names,brandnames,logos,inflammatorystatements,orbearingthenameor
likenessofacelebrity(livingordead).Ifyoudowearsuchclothingyouwill
berequiredtochange.
7. Confidentiality
Ifyouarechosenasafinalistyouwillnotdisclosethatfacttoanyoneatall
withoutthepriorwrittenconsentofMTV.OnlyMTVhastherighttodisclose
this information. For the avoidance of doubt you will not issue any press
releases or make any public announcements (such as but not limited to
Twitter,Facebookoranyblogs)relatingtoanydetailsoftheCompetitionin
the finals stage (including any details of other finalists). BREACH OF THIS
CLAUSE WILL RESULT IN YOUR IMMEDIATE DISQUALIFICATION FROM
THECOMPETITION.
8. MediaGuidelines
Please note that when blogging, tweeting or making any social media
comments with respect to the Competition (with MTV’s prior consent) you
shouldfollowthefollowingguidelines:
• Don'tswearoruseoffensivelanguage(blasphemyetc.).
• Don'tmakeanydefamatorycomments-acommentisdefamatory
ifitisfalse,andislikelytodamageaperson'sreputatione.g."Xisa
drunk","Ywassodruggedup""Zisaliar'.Notethateven;
repeatingsomethingsomeoneelsesaidcanbedefamatorye.g."He
saidshewasacompleteslut";
• Don'tuseanygraphicanatomicaldescriptions(e.g.dick)orany
graphicinnuendos;
• Don'tmakeunnecessaryreferencestobrands/advertise/promote
productsetc.;
• Refrainfrommakingreligious/politicalcomments-avoid
referencestotheoccult;
• Donotincitehateorwriteanythingracist/sexistetc.;
• Donotencourageviolence;
• Donotpromoteorglorifysmoking/takingdrugs/drinkingalcohol;
• Whenexpressinganopinionmakeitclearthatit’syouropinion;
• Tryandbeobjectiveandalwayspresentbalancedarguments-
bothsidesofthestory;
• Don'trepeatanyunsubstantiatedrumors.
9. Disqualification
MTV reserves the right to disqualify any entrant from the audition or the
Competition for any failure to any aspect of these Terms and Conditions or
MTV’sgeneralcompetitionrules.
10. FinalistandWinners
MTV will appoint a panel of judges to select, in their absolute discretion,
finalistsandultimatelyandonewinnerfromthefinaloftheCompetition.If
you progress to the final you must be willing to consent to an alternative
Finalist/Winner of any of the heats or the final if MTV has reasonable
groundsforbelievingthatanentrantdoesnotmeettheEligibilityCriteriaor
hasnotcompliedwiththesetermsandconditions.MTV’sand/orthejudge’s
decisionisfinalandnocorrespondencewillbeenteredinto.
11. PromotionalAppearances
Shouldyoubechosenasafinalistyouagreetomakeyourselfavailable(for
no financial consideration) to MTV for such reasonable promotional
appearances,pressconferencesand/orphotoshootsasmayberequired.
12. Changes
MTV reserves the right to change any of the audition dates, times or
locations, any of the Eligibility Criteria or terms and conditions of the
Competitionatanytimewithoutnotice.MTVwillnotbeliableforanysuch
changesorforanyerrorsinanymaterialsorinformationassociatedwiththe
Competition.
13. PersonalInformation
Any personal information collected during the course of this Competition,
including the information in the Application Form, will be used solely in
connection with the Competition and will not be disclosed except to the
extentstrictlynecessaryfortheCompetition.Forfurtherinformationonhow
MTV will handle your personal information, please read the terms of our
PrivacyPolicywhichcanbefoundonwww.mtvbase.com.
14. NoLiability
MTV, its employees, agents and sponsors of the Competition disclaim all
liabilitytothegreatestextentpermissibleatlaw,foranylossentrantortheir
propertycausedorbesufferedinconnectionwiththeCompetition.
15.Miscellaneous
TheseTermsandConditionsshallbegovernedbythelawsofSouthAfrica.
Ifanyprovisionoftheserulesisfoundtobeinvalidorunenforceablebyany
court of competent jurisdiction, then that provision shall be severed from
theserulesandshallnotaffectthevalidityorenforceabilityofanyremaining
provisions.
Itisnotintendedthatanyprovisionoftheserulescontravenesanyprovision
of the Consumer Protection Act, 68 of 2008, and therefore all provisions of
theserulesmustbetreatedasbeingqualified,ifnecessary,toensurethatthe
provisionsoftheConsumerProtectionActarecompliedwith.
Ifawinnerdeclinestheprizeorisdisqualified,anewwinnerwillbeselected.
MTV’sdecisiononanymatterconcerningtheCompetitionand/orarisingout
of these Terms and Conditions is final and binding, and no correspondence
willbeenteredinto.
MTV and its affiliates will not be responsible for any harm, damage, loss or
claimrelatingtotheprovisionofanyelementofaprizeoranychangestoa
prizethatmaybemadeatanytime.Prizesarenottransferableandmaynot
bedeferred,changedorexchangedforcashoranyotheritem.
