The homeowner must have the work performed by a licensed contractor. The homeowner will process and submit the necessary incentive forms. Incentive is available to customers throughout the Idaho Power service territory. Homes receiving this incentive may not receive incentives for the same equipment under another Idaho Power incentive program. One incentive per residence is available. • The Idaho Power incentive is available for the installation of a smart thermostat • Qualified homes include homes with electric resistance forced air heat (with or without central air conditioning), or a heat pump. • Must be an existing single-family home built onsite. • Home can be a primary residence, vacation home, or rental. • No minimum length of residency. • New construction is not eligible. • Idaho Power does not require the homeowner to participate in offers made by the thermostat manufacture, seller, or other parties involving the sharing of the homeowner’s data. The decision to share data resides with the homeowner. • The smart thermostat must not void the manufacturer warranty for the system. The manufacturer should be consulted prior to the installation of the smart thermostat • The smart thermostat must be new. • The smart thermostat must be listed on the Qualified Products List. This list can be modified by Idaho Power at any time since some models can become obsolete while new models can become available from manufacturers. The smart thermostats listed in the Qualified Products List incorporate specific pre-determined energy impacting product features required by Idaho Power. • The smart thermostat must be wired, connected to the Internet and tested by the contractor after installation to verify that it is operating correctly. • The homeowner will have the licensed contractor performing the work maintain the appropriate license(s) and adhere to the requirements within the state where work is performed. The contractor shall install the equipment and/or perform services in accordance with all applicable federal, state, and local applicable safety, building, environmental, and other applicable statutes, regulations, ordinances, codes, and accepted industry standards. In the event the contractor contracts or delegates work to be performed by others, the contractor shall be responsible for the acts and omissions of any such work. • The homeowner is responsible for having the contractor install the smart thermostat consistent with manufacturer instructions. • Idaho Power is under no obligation to pay the contractor any amount of money. • Homeowner shall indemnify, hold harmless, reimburse, and defend Idaho Power from, for, and against any actual or alleged claims, demands, damages, losses, expenses, and liabilities from third parties (collectively “Claims”) relating to or arising from contractor’s work or work the contractor has performed by others, provided the claims are not the result of bodily injury to persons or damage to property caused exclusively by the sole negligence of Idaho Power. • Homeowner acknowledges and agrees that Idaho Power offers no warranties of any kind whatsoever related to this program. • Idaho Power does not endorse contractor’s services, products, reputation, or reliability • Neither the program nor the contractor’s work shall create any employment or agency relationship between the contractor and Idaho Power, and nothing shall be construed or interpreted to place any obligation on Idaho Power to pay the contractor any amount as a result of contractor participation in or expressly referenced in the program. • In no event shall the homeowner bring an action against Idaho Power, nor shall Idaho Power be liable to homeowner for, any direct, indirect, special, incidental or consequential damages of any nature or kind, whether in contract, warranty, tort, negligence, strict liability, or otherwise, arising out of or resulting from the program or any terms and conditions of the program.
