How to Appeal a Decision Made by Employment Nova Scotia
ORGANIZATIONAL RIGHT TO APPEAL
If you have applied for, or are receiving funding for a program offered by Employment Nova Scotia
(ENS), you may appeal specific decision related to your application.
You must request an appeal within 20 business days of the date of the written notice (letter or e-mail)
regarding the ENS decision about your organization’s eligibility for funding. If the appeal is requested
after 20 business days of notification of the decision, the original decision is final.
If you wish to appeal, you must:
• Write a letter or email stating what decision you are appealing and why. Please include any
information you have that was not disclosed at the time of application that may support a
change to the decision.
•
Ensure that your organizational name, contact person is identified, a phone number where that
person can be reached and the current address is clearly stated in the letter.
•
Take your appeal letter to any office of Employment Nova Scotia, send it by mail to the address
below or email to the following address: ensappeals@gov.ns.ca
The postmark, email date or date stamp if delivered in person will be used as the date the appeal is
requested.
Please note:
If an application is approved as the result of an appeal, funding support will be based on the date of the
original decision of the application. Costs paid out prior to the original decision date may not be eligible
for reimbursement.
YOU CANNOT appeal the following through this process:
Administrative issues or decisions made by the Board of Directors, employers, or owners
of the organization/ business.
Human resource or salary related decisions made by employers or Boards of Directors.
Decisions made by ENS to deny funding for an activity, budget item or cost listed in the
Guidelines for Application for the program under which funding is being requested.
Specific wording of the Articles or content of schedule I (General Terms and Conditions)
of the LaMPSS Agreement Contract form.
THE APPEAL PROCESS
STEP 1 - THE ADMINISTRATIVE REVIEW
The first step in the appeal process is an Administrative Review. This is done by a supervisor at the local
level. Within 5 business days, this supervisor must let you know if the original decision should stay the
same, or should be changed. The supervisor’s decision will be based on the information you have
provided Employment Nova Scotia in your appeal letter and original application. Every attempt will be
made to contact you via phone to notify you of the decision. You will also be notified of the decision in
writing. The date of the written notification will be considered the date of the decision.
STEP 2 – MANAGERIAL REVIEW
If you are not satisfied with the results of the Administrative Review and there is additional information
that was not presented as part of the Administrative Review, you can request a Managerial Review.
Within 5 business days of receiving the results of the Administrative Review, you must let Employment
Nova Scotia in writing know that you wish to continue the appeal and have a Managerial Review
conducted. If you do not respond within this time period, the decision of the Administrative Review will
be final. The Managerial Review is carried out by a designated Manager within Employment Nova
Scotia. The Manager’s role is to review the original application, along with the additional information
presented by your organization, the results of the Administrative Review, and the decisions made.
Within 5 business days of receiving your request this Manager must let you know the results of the
review. Every attempt will be made to contact you via phone to notify you of the decision. You will also
be notified of the decision in writing. The date of the written notification will be considered the date of
the decision. Please note: if there is not additional and/or new information presented as part of the
request for the Managerial Review, the appeal process will be considered closed.
STEP 3 – DIRECTORIAL REVIEW
If you are not satisfied with the results of the Managerial Review, and there is still additional information
that was not presented as part of the Managerial Review, you can request a Directorial Review. Within 5
business days of receiving the results of the Managerial Review, you must let Employment Nova Scotia
in writing know that you wish to continue the appeal and have a Directorial Review conducted. If you do
not respond within this time period, the decision of the Managerial Review will be final. The Directorial
Review is carried out by the Director of Employment Nova Scotia. The Director’s role is to review the
original application, the results of both the Administrative Review and the Managerial Review and the
decisions made. Within 5 business days of receiving your request, the Director must let you know in
writing the results of the review. Please note: if there is not additional and/or new information
presented as part of the request for the Directorial Review, the appeal process will be considered
closed.
The Directorial Review is the final step in the ENS appeal process.
