CUBE 5K WALK/RUN ACTIVITY WAIVER AND ACKNOWLEDGEMENT
I understand and acknowledge that my participation in the CUBE 5K Walk/Run on July 24, 2015 at the
CUBE Summer Issues Seminar in Savannah, Ga. (the “Activity”) is voluntary, and that the Activity carries
some physical risk to me. I acknowledge that I do not have any medical condition that would prevent me
from participating in this event. I agree to assume the risk of any illness, injury or damage resulting from
my participation in the Activity. I assume all risks associated with participating in weather, including
cold, high heat and/or humidity, traffic and the conditions of the road, all such risks being known and
appreciated by me. Having read this waiver and knowing these facts and in consideration of the
acceptance of my entry to participate in the Activity, I, intending to be legally bound, do hereby for
myself, my heirs, my executors and administrators agree as follows:
In exchange for being allowed to participate in the 5 k walk/run, which is sponsored by Humana and
being held during the CUBE summer issues seminar, I hereby release and discharge Humana Vitality, LLC
and its parent company Humana Inc. and the National School Boards Association and their affiliates,
subsidiaries, employees, officers, agents and vendors from all claims, damages, and liability including but
not limited to those for bodily injury, death, property damage or property loss, that I may have against
them arising from my participation in the 5 k walk/run.
I assume responsibility for all liability in connection with such claims, damages, and liability, and
agree to indemnify and hold harmless Humana and the National School Boards Association
against any claims, damages, liability and related costs.
In the case participant is an employee of Humana, participant acknowledges participation in the Activity
is not within the scope of employment with Humana or performed as an employee of Humana.
Participant understands he/she does not qualify for workers’ compensation benefits for any injuries that
may be incurred while participating in the Activity.
If participant is a person under the age of 18 years of age as of the date of the 5K walk/run, the
undersigned parent or legal guardian of the participant agrees to indemnify, defend, and hold
harmless the entities named above from and against all claims, liabilities, losses, damages,
costs, expenses (including attorney’s fees), judgments, and penalties arising out of the
participant’s participation in the 5 k walk/run.
