Rack Technologies was founded in Sydney, Australia
on March 15th 1990 and was acquired by Preformed
Line Products (Australia) Pty Limited on 1st April,
2000. The company is a specialist manufacturer
of rack system enclosures and accessories for the
communications, data centres, electronic, security and
electrical industries.

one of Australia and New Zealand’s
largest manufacturers of system
enclosures and accessories.

To meet the need for both short
lead
times
and
guaranteed
strength, PLP has invested in an
in-house aluminium casting facility,
complementing its diverse range
of products. Daily testing and a
rigorous assessment system, aim to
ensure the consistent quality of final
products. Most casting processes
use alloys, of CC401 and 601 grades.
In many situations, our market
requires plastic extruded, rather then
injection moulded products. Where
plastic extrusions are required,
PLP offers a full range of extrusion
capabilities, enabling the creation of
products suited to full outdoor use, in
both hollow and solid sections.
Utilising both MIG and TIG welding,
PLP
manufactures
everything
from simple steel “Eye-Nuts” to
complex aluminium busbars, which
are required for major substations.
All PLP welders are trained and
certified in the welding of busbar
and compression terminals. As
part of the PLP training program,
certification includes confirmation
by X-Ray and weld testing.

PLP has a range of CNC-turret
presses, brake presses and spot
welders, as well as a powder coating
line. These, combined with our highly
motivated engineering team, enable
us to offer our customers a complete
solution to their sheet metal needs,
regardless of whether they seek a
steel computer rack or individual
sheet metal components. Materials
predominantly utilised range from
stainless steel and aluminium to
various zinc seals and galvanised
metals.
To enable a highly diverse and
flexible manufacturing environment,
combined with quick turnaround
on tooling, PLP employs a tooling
design department. It utilises
equipment such as its recently
acquired CNC machining centre,
EDM and wire cut machines,
coupled with sophisticated CAD/
CAM systems. PLP manufactures all
forging, wire forming and aluminium
die-casting tools, as well as plastic
moulding dies.
The most recent addition to the broad
range of PLP’s in-house capabilities
is the new powder coating line,
which uses the most recent
technology available. This powder
coating capability permits products
to be manufactured, coated and
packed without leaving the facility.
This reduces the amount of
transport involved in the process
and
consequently
decreases
the associated risks of aesthetic
damage and extended lead times.

To respond quickly to both large
and small volume requirements,
PLP’s wire-forming section has
reduced set up times. PLP has also
re-engineered the production line
to allow for speedy change over
times between galvanised high
tensile steel, stainless steel, copper,
aluminium and aluminium-clad wires
in diameters ranging from 1.6mm to
9.27mm.
Utilising in-house drop hammers,
upsetters and screw presses, PLP
offers a full range of forging services.
Materials such as high carbon steel,
mild steel, stainless steel, copper
and aluminium, can be forged as
well as heat-treated when required.
The in-house, Lloyds certified,
tensile testing facility ensures that
production capability is maintained
and customer specifications are met.
The Engineering Department at
PLP is the place where technology
meets customer needs. Whilst
continually striving to embrace new
technologies and materials in order
to address both current and future
requirements, the engineering area
must also design within the strict
limitations of applicable standards.

outdoor, high strength injection
moulded products, which can
withstand total UV exposure in the
most hazardous of environmental
conditions. The range of our
moulding machine capacity extends

machining centre allows for the
automatic production of many of
the precision turned parts required
for our market, eliminating the need
for operator intervention. Speed

PRODUCT SPECIFICATION
Rack Technologies RT Series cabinets are constructed from corrosion
resistant, extruded aluminium frames and die cast corners, for added
strength and durability. The material used is architectural grade 6060-T5
alloy, produced to Australian Standard AS 1866. Sheet metal is formed
for top, side panels and mounting rails. Door frames are constructed from
1.6mm steel, with a commercial grade tinted acrylic panel secured using
industrial strength adhesives.
The powder coating is Interpon Plus and meets the Australian Standard
AS 3715 at 80 microns. Rack Technologies cabinets are approved to the
Seismic Loading Standard to meet the Bellcore Generic Requirement GR63-CORE (Issue 1, October 1995). Testing was conducted by the University
of Technology, Sydney (UTS). Rack Technologies enclosures comply with
the International Standard IEC297.
MODULAR DESIGN
Rack Technologies modular design provides optimum space efficiency,
allowing components to be stored individually, separately or as a complete
assembly. In today’s market, where larger racks are often required, modular
design enables flat pack delivery for tight and difficult working environments.

CABINET SPECIFICATION
FRAME MATERIAL AND CONSTRUCTION
Rack Technologies free standing cabinet frames are constructed from
extrusions made from corrosion resistant aluminium (6060-T5) produced to
Australian Standard AS1866. The extrusion is pressed, fitted to solid cast
aluminium corners (AE401) and finished in Ripple Black gloss powder coat,
to Australian Standard AS3715. In addition, every joint is positively locked
together with six counter sunk earthing screws. All screws are located on the
non-visual faces of the cabinet and are concealed by top and side panels
to ensure security. All Rack Technologies components are zinc phosphate
treated prior to the application of the powder coating. Cabinets are available
in 600mm wide and 800mm wide mounting (external width).

SIDE AND TOP PANELS
Side panels are lockable, sit flush with the cabinet and feature quick release
clips and lower ventilation slots. Top panels are made with fan Knock-outs for
2,4 and 6 fan configurations. Fans can also be retro fitted. Both components
are made from 1.2mm steel and are powder coated.
DOORS
Doors are made from 1.6mm steel and are powder coated. For internal viewing
equipment, 4.5mm tinted acrylic is fitted with industrial adhesive. Four styles
of doors are available: acrylic, steel, steel-perforated and bi-fold. All styles of
doors are available in various locking configurations: single point, three-point
lock and bi-lock key. All are easily removable without tools. Doors sit flush
and secure within the cabinet frame, with concealed quick release hinges
providing extra security, and can be hung left or right.
MOUNTING RAILS
Mounting rails (L-Rail) are fully adjustable, to suit most applications. Rails
are very user friendly and can be moved with a Phillips head screwdriver.
RU mounting holes, condtructed from 1.6mm zinc annealed steel, are 9.5mm
square and are designed for M6 cage nuts.

The iQ series 600mm and 800mm
wide cabinet range is one of the
most advanced server racks
featured on the Australian market.
A robust construction made from
durable welded steel with powder
coated finish gives the iQ series a
variety of applications.
The iQ Open Frame Series
has been designed specifically
for high density patching
applications associated with
data centres. There are several
cable management options
available utilising the Rack
Technologies T-finger design.
The extra width on the outside
of the vertical mounting rails can also be utilised for
cable management, like the iQ Series vertical cable
management system. this is perfect for high density
patching as it keeps all cable runs neat and manageable.
The 600mm and 800mm wide server range is available
in 38RU and 45RU configurations, including 800mm,
900mm, 1000mm and 1200mm depths. It will house most
servers on today’s market without overcrowding and
allows excellent airflow for maximum cooling of precious
server hardware.
The vertical cable managers
are available in widths of 150mm, 300mm and 400mm.
The iQ Open Frame rack can be bayed as many
times as required in conjunction with the vertical cable
management system. The 2-way hinged door cover
design allows for ease of cable management as well as
a neat and tidy finish. The iQ series 2-post open frame
has a 500kg UDL load rating (dependent on application),
while 4-post open frames have a 1000kg UDL load rating.

CABLE MANAGEMENT
The T Finger Vertical Cable Management System is
designed to handle high density cabling, whether for
termination or patching applications. It fits neatly alongside
the vertical 19" rails within a 600mm or 800mm wide
cabinet to ensure neat cabling as well as adherence to
bend radius requirements. The T-fingers are mounted on
steel channels in 2RU increments and can be removed to
allow the bending and entry of larger cable bundles via the top or bottom or
left or right. The fingers are available in 2 (two) lengths: 93mm and 146mm.

SELECTING A RACK
All cables eventually lead to electronic equipment,
and most equipment is located in a rack. An
equipment rack is the skeletal framework in which
key components are arranged and interconnected.
Rack design involves the process of selecting options to meet the needs of
a specific installation. Equipment is not just mounted in a rack haphazardly.
Special considerations is given regarding how much heat a piece of
equipment emits, the types of signals sent to and from the equipment,
whether or not the equipment features an interface component for a
typical user and more. Rack designs requires substantial pre-planning and
attention to all system elements.

With the proper hardware, wall mount racks attach to any type of wall.
They swing open, enabling the technicians to access equipment from the
rear. Installers should understand the structural issues associated with the
installation of this type of rack to determine the wall’s capacity to hold the
weight of the populated rack.

PANEL WIDTH
Panel widths varies according to rack type. The interior width of the rack
must be sufficient enough to accommodate different types of equipment.
Standard rack equipment features a rack space width of 19" inches.
RACK HEIGHT
Rack height ranges from over 2.2m to less than 30cm. Racks are also
classified by their vertical mounting space. The specification is given as
the number of Rack Units (RUs) available for equipment mounting. A single
rack unit is 1.75 inches (44.45mm). Equipment is also typically measured in
RUs. Some equipment, like larger servers, can be 10RU or more. On each
of the side mounting rails, there are typically two or three punched holes for
each rack unit. Caged nuts are inserted into the holes for the mounting of
equipment.
RACK ACCESSORIES
If you think of a rack as an organisation space, it is a lot like a cupboard.
Just as you can have space dividers, shelves and drawers in a cupboard,
similar accessories are available for racks. Blanky are metal panels
mounted in empty spaces between pieces of equipment. Rack Technologies

SEISMIC RATED
Rack Technologies has completed an extensive exercise to have our floor racks
seismic tested. Our aim was to partake in a universal test to prove the strength and
reliability of our racks beyond doubt.
Upon embarking on a search for an available international standard regarding loading and strength, we found that the
only standard close to and relevant to the test was the Seismic Load Standard to Bellcore’s Generic Requirement
(GR-63-CORE Issue 1 October 1995). This standard was founded in the United States where earthquakes are
common and all kinds of structures must have the capacity to withstand great destabilising forces.
We have worked in conjunction with the University of Technology Sydney to achieve our aim and we have drawn an
impressive conclusion. Rack Technologies cabinets are approved for earthquake risk Zone 4. Although earthquakes
are not a major concern in Australia, this achievement does clearly demonstrate the strength and reliability of our
cabinets.
Important note: All racks are Seismic tested: however, they are not fitted with the Seismic Kit as standard. The
Seismic Kit can be fitted to any rack and is available upon request.

Rack Technologies has developed a new enclosure complete with the most up-to-date cable management system. The
fully enclosed cabinet addresses the customer’s requirement to house high-density copper and fibre optic patching
facilities, together with large, chassis-based active equipment.
The High-Density cabinet is designed around the iQ cable management system, whereas in most other cabinet
designs, the iQ cable management system is a secondary thought. The system controls cable bend radius with
the vertical finger design, which also accommodates large volumes of patch cables that travel vertically within the
enclosure.
The High-Density cabinet has optimises the space available within the cabinet. It is also capable of housing large,
chassis-based switch equipment, and managing the high volume of cabling generally required.

IICCS STANDARD CONFIGURATION
Developed specifically for the IT industry, the IICCS
provides the ideal in-cabinet operating environment
for mission-critical servers and IT equipment.
The IICCS is designed to be mounted inside a sealed server cabinet fitted
with an in-cabinet airflow management system, which prevents the mixing of
hot and cold air streams. In operation, hot exhausted server air is drawn into
the IICCS through variable speed fans, transferring heat to an inbuilt water
coil that is constantly fed chilled water, piped from a remote water chiller.
The cold conditioned air is then directed into the cold air plenum at the front
of the cabinet, where it can be consumed by the servers. The process is then

The% Customer% acknowledges% that% no% employee% or% agent% of% the% Company% has%
any% right% to% make% any% representation,% warranty% or% promise% in% relation% of% the%
Goods%or%the%sale%of%the%Goods%other%than%as%contained%in%these%Terms.%%

received%by%the%Company.%%
The%Company%will%charge%a%handling%fee%of%$100%or%such%other%greater%amount%
for% orders% of% an% invoice% value% under% $1,000% or% such% higher% amount% as% the%
Company%determines.%%

PROPERTY(IN(GOODS((

REASALE(OF(GOODS((
Legal%and%beneficial%ownership%of%Goods%supplied%by%the%Company%will%not%pass%to%the%
Customer% until% such% time% as% the% Goods% so% supplied% have% been% paid% in% full% in% cash% or%
cleared%funds.%%

If% the% Customer% is% a% reMseller% then,% subject% to% subMclause% 4.2.4,% the% Customer%
has%the%right%to%sell%the%Goods%in%its%own%name%at%full%market%value%and%in%the%

Until% the% amount% payable% to% the% Company% in% respect% of% the% Goods% has% been%
paid%in%full%in%cash%or%cleared%fund:%%
4.2.1. the%Customer%will%hold%the%Goods%only%as%bailee%for%the%Company;%%
4.2.2. the% Goods% must% be% stored% in% such% manner% that% they% are% readily%
distinguishable% from% other% goods% owned% by% the% Customer% or% other%
persons% and% so% as% to% clearly% show% that% they% are% the% property% of% the%
Company;%%
4.2.3. the% Customer% must% indemnify% the% Company% from% and% against% any%
Claim% incurred% or% suffered% by% the% Company% arising% out% of% the%
possession,% use% or% disposal% of% the% Goods% by% the% Customer% or%
repossession%or%attempted%repossession%of%them%by%the%Company;%and%%
4.2.4. any% sale% of% the% Goods% under% clause% 4.1% will% only% be% effected% by% the%
Customer% as% trustee% for% the% Company% and% the% proceeds% of% such% sale%
and%the%rights%of%the%Company's%Customer%against%its%customer%arising%
from% such% sale% will% be% held% on% trust% for% the% Company.% The% said%
proceeds% must% be% held% in% a% separate% account% or% otherwise% clearly%
identified%in%the%books%and%records%of%the%Customer.%%
The%Customer%must%ensure%that%the%Goods%are%stored%in%accordance%with%any%
reasonable%direction%or%instructions%from%the%Company%and,%without%the%prior%

written% consent% of% the% Company,% must% not% treat,% alter,% or% incorporate% the%
Goods% into% or% with% another% product% of% the% Company% or% any% third% party,% or%
otherwise%vary%the%Goods%as%supplied%by%the%Company.%
If% the% Customer% resells% any% Goods% then,% unless% the% Goods% are% clearly%
identifiable% by% serial% numbers% or% other% distinguishing% marks,% the% Customer% is%
deemed%to%have%disposed%of%the%Goods%in%the%chronological%order%of%supply%by%
the%Company%to%the%Customer%(oldest%to%most%recent).%%
On%the%resale%of%the%Goods%by%the%Customer,%the%Customer%must%ensure%that%
any% contract% between% the% Customer% and% its% customer% limits% or% excludes% any%
liability%of%the%Company%to%such%customer%on%no%less%favourable%terms%than%the%
Company’s%liability%to%the%Customer%under%clause%19%or%on%more%limiting%terms.%
Despite% clause% 4.5,% the% Customer% must% indemnify% the% Company% from% and%
against%any%Claim%incurred%or%suffered%by%the%Company%arising%out%of%the%resale%
of%the%Goods%by%the%Customer.%

If%the%Customer%uses%the%Goods%in%some%manufacturing%or%construction%process%
of%its%own%or%on%behalf%of%some%third%party%and%receives%monies%from%time%to%
time% in% respect% of% such% use% then% the% Customer% must% hold% a% portion% of% such%
monies% received,% calculated% in% accordance% with% clause% 5.2,% in% trust% for% the%
Company.%
The%portion%referred%to%in%clause%5.1%will%be%so%much%of%the%monies%received%as%
equals%the%amount%owing%by%the%Customer%to%the%Company%at%the%time%of%the%
receipt%of%such%monies%by%the%Customer.(
%Money%received%by%the%Customer%excludes%any%debts%due%to%other%parties%by%
the%customer%but%not%yet%paid%by%the%Customer.(
In% the% circumstances% outlined% in% clause% 5.1,% the% Customer% must% not% assign% or%
deal% with% its% debts% in% any% way% prior% to% payment% of% the% moneys% receivable% by%
the% Customer% in% respect% of% the% Goods% as% their% use% as% described% in% clause% 5.1%
prior%to%their%payment%to%the%Company.(

INSTALLATION(OF(GOODS(
6.1.
All%Goods%must%be%handled,%mounted%and%installed:%
6.1.1. by%an%appropriately%licensed%technician/tradesman;%and%
6.1.2. in%accordance%with:%
6.1.2.1. the%manufacturer’s%directions,%if%any;%%
6.1.2.2. the%relevant%Application%Procedure%found%at%

Goods%or%for%any%loss%or%damage%to%the%Customer%caused%by%the%Goods.%

without% prejudice% to% any% other% rights% which% it% may% have% against% the% Customer,%
terminate% any% Contract% relating% to% the% Goods% and% the% bailment% referred% to% in% clause%

In%any%of%the%circumstances%referred%to%in%clause%7,%the%Customer:%%
8.1.
authorises% the% Company% by% itself,% its% agents% or% representatives% at% all%
reasonable% times,% without% notice,% to% enter% onto% (with% force% if% reasonably%
necessary)% and% at% all% necessary% time(s),% to% remain% in% and% on% any% premises%
where%the%Goods%are%located%in%order%to%collect%the%Goods,%without%being%guilty%
of%any%manner%of%trespass;%and%%
8.2.
assigns%to%the%Company%all%the%Customer's%rights%to%enter%onto%and%remain%in%
and%on%such%premises%until%all%the%Goods%have%been%collected.%%

In%any%of%the%circumstances%referred%to%in%clause%7.3:%
9.1.
neither% the% Customer% nor% its% Insolvency% Representative% or% any% other% person%
acting%for%the%Customer%and/or%its%creditors%is%entitled%to%sell,%charge,%remove,%
dispose%of,%use%or%otherwise%deal%with%the%Goods%in%any%way%inconsistent%with%
the%Company's%ownership%of%the%Goods,%without%the%Company's%prior%written%
approval;%
9.2.
the%Customer,%its%Insolvency%Representative%and%every%other%person%acting%for%
or% on% behalf% of% the% Customer% and/or% its% creditors% is% obliged% to% reMdeliver% the%
Goods%to%the%Company%immediately%or%immediately%on%his%appointment,%as%the%
case%may%be,%at%its%or%his%expense;%and%
9.3.
if% the% Goods% are% returned% to% or% collected% by% the% Company,% the% Company% will%
within% twentyMeight% (28)% days,% account% to% the% Customer% or% its% Insolvency%
Representative% for% all% monies% received% for% the% Goods% from% the% Customer% less%
the%Company's%reasonable%administration%charges,%expenses%incurred%and%loss%
of%profits%involved.%%

If% the% Customer% carries% on% business% as% trustee% of% a% trust% then% the% Customer% warrants%
that:%%
10.1. the% Customer% enters% into% a% Contract% or% Contracts% to% purchase% the% Goods% as%
trustee%of%a%trust;%%
10.2. the% Customer% has% all% requisite% powers% to% enter% into% a% Contract% under% these%
Terms;%%
10.3. the%beneficiary%of%the%trust%approves%the%purchase%of%the%Goods%on%the%terms%
of%the%Contract;%and%%
10.4. the%assets%of%the%trust%are%available%to%the%Company%in%satisfaction%of%any%debt%
incurred%by%the%Customer%for%the%purchase%of%the%Goods.%%

If%GST%is%imposed%on%the%Company%in%respect%of%the%Goods%then%the%Customer%

CUSTOMS(DUTIES,(TARIFFS(AND(LEVIES((

All%applicable%customs%duties,%tariffs%and%levies%are%payable%by%the%Customer%unless%the%
order,%order%confirmation,%invoice%or%other%writing%indicates%otherwise.%%

Availability% dates% are% estimates% only,% but% the% Company% will% use% its% best%
endeavours%to%maintain%these%estimates.%%
If%the%place%of%delivery%to%or%collection%of%the%Goods%by%the%Customer%is%within%
Australia% then% the% Company% will,% at% the% Customer’s% request,% arrange% for% the%
delivery%of%the%Goods%at%the%Company’s%expense.%%

The% Company% reserves% the% right% to% deliver% the% Goods% in% whole% or% by%

Where%the%Goods%are%delivered%by%instalments,%each%instalment%is%sold%under%a%
separate%Contract.%%
Any% failure% on% the% part% of% the% Company% to% deliver% instalments% within% any%
specified% time% does% not% entitle% the% Customer% to% repudiate% the% Contract% with%
regard%to%the%balance%of%the%Goods%remaining%undelivered.%%

The%Goods%are%entirely%at%the%risk%of%the%Customer%from%the%moment%the%Goods%
leave%the%Company's%premises%or%physical%custody.%%
The%Customer%must%at%its%own%expense,%maintain%the%Goods%and%insure%them%
for% the% benefit% of% the% Company% for% their% full% replacement% value% against% theft,%
destructions,%fire,%water%and%other%risks,%as%from%the%moment%of%delivery%to%or%
collection%by%the%Customer%until%property%of%and%title%to%the%Goods%have%passed%
to%the%Customer.%
The% Customer% must% take% all% reasonable% measures% to% ensure% that% the%
Company's%title%to%the%Goods%is%in%no%way%prejudiced.%If%any%of%the%Goods%are%
lost,% destroyed% or% damaged,% any% insurance% proceeds% relating% to% the% Goods% in%
respect%of%such%event%that%are%received%by%the%Customer%are%held%on%trust%for%
the% Company% and% must% be% paid% to% the% Company% immediately% on% receipt% but%
only% up% to% the% amount% that% the% Customer% owes% the% Company% in% respect% of%
those%Goods.%%

RETURN(OF(GOODS((
Unless% the% Customer% has% inspected% the% Goods% and% given% written% notice% to% the%
Company% within% seven% (7)% days% after% collection% or% delivery% that% the% Goods% do% not%
comply%with%the%relevant%specifications%or%descriptions,%the%Goods%are%deemed%to%have%
been%accepted%in%good%order%and%condition.%%

No% returns% will% be% accepted% unless% the% Company% has% previously% agreed% in%
writing.%If%the%Company%agrees%to%the%return%of%Goods,%they%must%be%unsoiled,%

such% consent% will,% at% the% Company’s% election,% be% subject% to% the% Company% being%

from%any%delay%in%delivery%or%defect%or%fault%in%the%Goods%or%any%negligence%by%
the% Company% in% relation% to% the% Goods% (including% but% not% limited% to% their%

If,% despite% clause% 19.2,% the% statutory% provisions% under% the% Competition. and.
Consumer.Act.2010%(Cth),%the%Sale.of.Goods.Act.1923%(NSW)%or%any%other%act%or%
the%general%law%impose%on%the%Company%a%liability%for%a%defect%or%fault%in%the%
Goods% then,% to% the% extent% to% which% the% Company% is% entitled% to% do% so,% the%
Company’s%liability%under%the%statutory%provisions%is%limited,%at%the%Company’s%
option,%to:%
19.3.1. replacement%or%repair%of%the%Goods;%
19.3.2. supply%of%equivalent%Goods;%or%
19.3.3. payment%of%the%cost%of%replacing%or%repairing%the%Goods%or%of%acquiring%

On% discovery% of% any% defect% in% the% Goods,% the% Customer% must% notify% the%

the% day% of% delivery.% This% warranty% extends% only% to% the% Customer% and% to% no%
other%person.%
The% Customer’s% failure% to% provide% written% notice% to% the% Company% within% the%
required% time% of% any% alleged% breach% of% the% above% warranty% will% release% and%
discharge% the% Company% from% any% obligation% or% liability% for% that% breach% of%
warranty.%%
The% Customer% must% not% carry% out% any% remedial% work% to% allegedly% defective%
Goods% without% first% obtaining% the% written% consent% of% the% Company% to% do% so%
otherwise% all% of% the% Company’s% warranties% will% be% voided% to% the% full% extent%
permitted%by%law.%%
The% warranties% stated% in% clauses% 20.1% and% 20.2% do% not% apply% in% circumstances%
where%the%Customer%treats,%alters,%incorporates%the%Goods%into%or%with%another%
product% of% the% Company% or% any% third%party,% or% otherwise% varies% the% Goods% as%
supplied%by%the%Company.%%

Particulars%in%leaflets,%catalogues,%drawings,%brochures%and%other%printed%material%are%
illustrations% only,% form% no% part% of% the% Contract% between% the% Company% and% the%

The%Company%may%sell%any%of%the%Customer’s%property%on%which%the%Company%

the% sale,% given% the% Customer% a% written% notice% setting% out,% and%
demanding% payment% of% such% part% of% the% sum% in% respect% of% which% the%

the%Customer%has%failed%to%pay%the%sum%referred%to%in%the%notice.%%
The%proceeds%of%the%sale%will%be%applied%by%the%Company:%%
22.4.1. firstly%to%cover%the%costs%of%the%sale;%%%
22.4.2. secondly% in% payment% of% such% part% of% the% sum% in% respect% of% which% the%

The%Company%reserves%the%right%to%recall%the%Tooling%from%the%Customer%at%any%

The%Customer%acknowledges%that%if%the%Company%has%a%security%interest%in%the%

then% the% Company% may% register% its% security% interest% on% the% PPSR% and% the%
Customer,%in%accordance%with%section%157(3)(b)%of%the%PPSA,%waives%the%right%to%
receive%notification%of%the%registration.%%
COPYRIGHT((

The%Customer%warrants%that:%%
25.1.1. the%drawing%of%any%extruded%shape%submitted%by%the%Customer;%and%%
25.1.2. any%Tooling%made%in%accordance%with%such%drawing;%and%%

does% not% infringe% the% rights% of% any% third% party% (whether% copyright,% registered%

The% Customer% irrevocably% and% unconditionally% submits% to% the% nonMexclusive%

jurisdiction% to% hear% appeals% from% those% courts% about% any% proceedings% in%
connection% with% these% Terms% and% waives% any% right% to% object% to% proceedings%

stoppages,%wars,%riots%or%civil%commotion,%intervention%of%public%authority,%explosion%or%

The%Company%and/or%the%Customer%must%not%commence%any%court%proceedings%

arising%out%of%or%in%connection%with%these%Terms,%then%that%party%must%submit%a%
written%notice%(“Notice(of(Dispute”)%to%the%other%party%specifying:(
30.2.1. the%nature%of%the%dispute%that%has%arisen;(
30.2.2. the%major%issues%for%determination;%and(
30.2.3. the%relief%or%outcome%being%sought.%(

the% parties% must,% within% an% additional% fourteen% (14)% days% agree% to% refer% the%
dispute%to%a%single%expert%for%determination.%
If% the% parties% are% unable% to% agree% on% a% expert% within% the% time% stipulated% in%
clause%30.5,%then%either%party%may%refer%the%dispute%to%an%expert%as%nominated%
by%Unisearch%Expert%Opinion%Services,%for%determination.%

30.7.1. must%be%in%writing,%accompanied%by%reasons;%and%(

The% parties% are% to% bear% their% own% costs% of% the% dispute% and% the% costs% of% the%
expert%are%to%be%borne%by%the%party%found%to%be%at%fault%by%the%expert%and,%in%
the%event%that%no%such%finding%is%made,%the%costs%are%to%be%borne%by%the%parties%
equally.%

34.5. “Customer”% means% the% party% to% whom% the% Company% has% agreed% to% sell% the%

34.6. “Goods”%means%the%goods%agreed%to%be%sold%by%the%Company%to%the%Customer.%%
34.7. “GST”%means%the%Goods%and%Services%Tax%imposed%by%a%New.Tax.System.(Goods.
