 Wrought Iron Fence Request for Proposal AAMA is seeking two proposals for the professional installation of a wrought iron fence (hereafter referred to as the “Work”) for the 6001 Gulf Freeway campus property (hereafter referred to as the “AAMA Property”). Your company is hereby invited to submit your proposals to perform this Work. Request For Proposal (“RFP”) Submission Information Your proposal shall be submitted by the date and time indicated on the website. Any questions or clarifications should be made to Joe Esquivel via email. Scope of work on AAMA Property 1st Proposal – Total fencing length: 339 feet 




Iron fence, 6 feet high, approximately 339 linear feet in length, including gates on property. Approximately, ninety‐nine (99) feet of the fence will be on concrete. Fencing material requirements: 4 x 4 inch posts with two (2), 1 ¼ inch solid rails, top and bottom Solid iron pickets ¾ inch thick and 6 feet in height 3 traffic gates Gate #1: 26 feet, sliding gate Gate #2: Double sliding gate, 12’‐6” on one side and 12’‐6” on the other Gate #3: 20 feet, double swing gate Two (2), 5 feet walk‐in gates for pedestrians All posts to be set in mixed concrete, 3 feet in the ground Prime and Paint Black in color with rust‐resistant, oil based exterior metal rated paint Clean up all construction debris 2nd Proposal – Total fencing length: 445 feet 





Fencing material requirements: 4 x 4 inch posts with two (2), 1 ¼ inch solid rails, top and bottom Solid iron pickets ¾ inch thick and 6 feet in height 3 traffic gates Gate #1: 26 feet sliding gate Gate #2: Double sliding gate, 2’‐6”one one side and 12’‐6” on the other Gate #3: 20 feet, double swing gate Two (2), 5 feet walk‐in gates for pedestrians All posts to be set in mixed concrete, 3 feet in the ground Primed and Painted, Black in color with rust resistant, oil based, exterior, metal‐rated paint Clean up construction debris AAMA Requirements 

All Contractors or Contractor’s employees who come onto the AAMA Property will be subjected to a background check, with other checks to be performed as may be required by AAMA in its sole discretion. Contractor’s employees will check in with Security prior to performing any of the Work, and will check out upon completion. 
Contractor will be responsible for all Contractor’s personnel while on the AAMA campus in performance of the Work. AAMA reserves the right to request that any Contractor personnel be removed from the campus if evidenced that an individual’s behavior is not in keeping with the safety of students or administrators and teachers or is in violation of acceptable behavior on a school campus. 
AAMA is a non‐smoking facility and the policy will be enforced by the Contractor. 
Alcohol is not permitted on the AAMA Property. 
Firearms are not permitted on the AAMA Property. 
Payments will be made to the Contractor by AAMA. Contractor will submit a Monthly invoice for all services rendered during the calendar month. Invoices shall be on Contractor’s letterhead or, conversely, shall indicate the Contractor’s name and address and contain the following information: (1) The time period covered by the invoice; (2) A 



description of the Work that was performed; (3) The amount of the invoice, and; (4) A name and telephone number of Contractor’s accounts payable contact. The invoice will be paid by AAMA on a Net 30‐day term based on the date that AAMA receives each conforming invoice. AAMA shall pay Contractor by check or Bank ACH payment, in AAMA’s sole discretion. Contractor shall provide AAMA with the information necessary for it to pay Contractor by ACH payment. At AAMA’s election, it may withhold ten percent (10%) of the contract amount in accordance with Section No. 53, as amended, of the Texas Property Code pertaining to Retainage. Contractor will prepare a mutually acceptable contract for execution which contains, upon other provisions, the INDEMNITY language and insurance requirements contained herein; Contractor will be responsible at its expense for obtaining all permits that may be required by local and/or state authorities, and; INDEMNITY. THE CONTRACTOR WAIVES ALL CLAIMS OR CAUSES OF ACTION AGAINST AAMA AND EACH OF THE FOREGOING, ITS AFFILIATED ENTITIES, DIRECTORS, OFFICERS, MEMBERS, MANAGERS, AGENTS, REPRESENTATIVES, CLIENTS, STUDENTS, GUESTS AND EMPLOYEES (THE “AAMA INDEMNITEES”) AND HEREBY INDEMNIFIES AND HOLDS HARMLESS THE AAMA INDEMNITEES FROM ALL CLAIMS OR CAUSES OF ACTION ARISING OUT OF DAMAGE TO ANY PROPERTY OR INJURY TO OR DEATH OF, ANY PERSON IN, UPON, OR ABOUT ANY PORTION OF THE AAMA PROPERTY, LAND OR BUILDINGS, CAUSED BY, RESULTING FROM, ARISING OR GROWING OUT OF OR IN ANY WAY WHATSOEVER CONNECTED WITH THIS CONTRACT OR ACTIVITIES OF THE AAMA INDEMNITEES, INCLUDING, WITHOUT LIMITATION, THE CONTRIBUTORY OR CONCURRENT NEGLIGENCE OF THE AAMA INDEMNITEES. IT IS THE EXPRESSED INTENTION OF AAMA AND CONTRACTOR THAT THE INDEMNITY PROVIDED IN THIS SECTION IS AN INDEMNITY BY CONTRACTOR TO INDEMNIFY AND PROTECT THE AAMA INDEMNITEES FROM THE CONSEQUENCES OF THEIR OWN CONDUCT WHETHER OCCURRING AS THE CONTRIBUTORY OR CONCURRENT CAUSE OF AN ACT OR EVENT GIVING RISE TO AN INDEMNITY OBLIGATION HEREUNDER. CONTRACTOR SHALL NOT BE REQUIRED TO INDEMNIFY THE AAMA INDEMNITEES IN THE EVENT THAT THE LOSSES, DAMAGES, DEATH(S) OR INJURIES ARE CAUSED BY THE SOLE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF ANY OF THE AAMA INDEMNITEES Certificate of Insurance. Contractor shall carry, pay premiums and maintain in force, insurance coverage types, limits, endorsements, and requirements as required below: Commercial General Liability: $2,000,000.00 combined single limit, bodily injury, personal injury and property damage, per occurrence Personal and Advertising Injury: $1,000,000 per occurrence Employers Liability: $1,000,000.00 each accident/policy/employee Automobile Liability: $2,000,000.00 combined covering all owned, non‐owned, leased and hired vehicles. Workers Compensation: Texas Statutory Benefits General Aggregate: $2,000,000.00 aggregate per location Products and Completed Operations Liability: $1,000,000.00 aggregate Fire Legal Liability: $100,000.00 per fire Umbrella Liability: $1,000,000.00 per occurrence and in the aggregate providing excess coverage over Employers Liability, Commercial General Liability and Automobile Liability AAMA and each of the foregoing, its affiliated entities, directors, officers, members, managers, agents, representatives, students, guests and employees shall be named as additional insureds in all of the policies listed above, except Workers’ Compensation. A Waiver of Subrogation endorsement in favor of AAMA shall be issued on all policies. Each policy required shall contain an endorsement that it will be primary over any collectible insurance insuring AAMA. The Certificate of Insurance shall state that the applicable polices have been endorsed as required herein. All required insurance will be placed with carriers licensed to do business in Texas and have a rating in the most current edition of A.M. Best’s Property Casualty Key Rating Guide that is reasonably acceptable to AAMA. AAMA shall be provided thirty (30) days written notice of cancellation or non‐renewal. The Certificate of Insurance shall be sent directly to AAMA by either the insurance broker or insurance companies. Receipt of the Certificate of Insurance from CONTRACTOR is not acceptable. No later than Contractor’s execution of any contract which may result from this RFP, Contractor shall cause to be furnished to AAMA a certificate of insurance evidencing the existence of all insurance coverage and limits required herein and including the Additional Insured, Waiver of Subrogation, an endorsement that the policies will be primary over any collectible insurance insuring AAMA, and other endorsements as have been noted herein. Contractor’s proposal will contain both the commencement and the completion date of the Work. Contractor will provide verifiable references, a description of the Contractor’s history including years in business, and the names and addresses of Contractor’s primary owners and officers. Contractor will provide a one‐year warranty on labor and materials. Commencement Date 
All work shall be completed within the time period quoted by Contractor. Exceptions to this requirement due to weather, etc. may be considered by AAMA as mutually agreed with Contractor.
