A signed copy of this attached Terms and Conditions form
A copy of your current malpractice insurance policy declaration sheet as
evidence that you maintain lawyer's professional liability insurance coverage in
the minimum required amount:

If you DO NOT practice in the areas of medical malpractice or
product liability claims, the minimum amount of coverage is
$100,000 per occurrence, and $300,000 in the aggregate;

If you DO practice in the area of either medical malpractice or
product liability claims, the minimum amount of coverage is
$1,000,000 per occurrence.
PAYMENT
Payment for your subscription will be automatically charged to the credit card number
provided in your JACKSONVILLEFINDALAWYER.ORG profile via our secure online
payment service. Payments will be charged once monthly or annually, according to the
subscription plan. If credit card information needs to be changed at any time, this can be
accomplished by accessing your profile through the Login link at:
www.JACKSONVILLEFINDALAWYER.ORG/login.

TERMS AND CONDITIONS FOR ATTORNEY LISTING
By signing below, and by participating in the JACKSONVILLE FIND A LAWYER
online advertising service ("JACKSONVILLE FIND A LAWYER") offered by The
Jacksonville Bar Association, Inc. ("JBA"), through its partnership with
Columbus Bar Services (“CBS”), I represent and agree to the following terms and
conditions (the "Agreement"):
1. I agree to pay all fees associated with my listing on JACKSONVILLE FIND A
LAWYER immediately when due. I understand that such fees will be automatically
charged to my major credit card through JACKSONVILLE FIND A LAWYER's secure
online payment and authorization site. The fee schedule and promotions for listing on
JACKSONVILLE FIND A LAWYER is subject to change at any time after the Initial Term
upon 30-day notice to current subscribers. A current fee schedule is included herein and
can be found at www.JACKSONVILLEFINDALAWYER.ORG/join.
2. I agree that the initial term of my listing on JACKSONVILLE FIND A LAWYER is
either “Monthly,” for a minimum of three (3) months ("Initial Term") or “Annual,” for one
(1) year, as indicated by me during the online sign up process. Payment of said term as
described in attached fee schedule will be charged as soon as my listing is live on the
JACKSONVILLE FIND A LAWYER site. Unless terminated earlier by the JBA in
accordance with paragraph 9 of this Agreement, after the initial term, monthly listings on
JACKSONVILLE FIND A LAWYER will continue on a month-to-month basis, and I will
continue to be charged monthly for such listing at the then-current service fee for such
listing, unless I notify the JBA that I desire to terminate my participation in
JACKSONVILLE FIND A LAWYER. Should I wish to renew an Annual subscription for
another year in full, notice of same should be provided in writing to the JACKSONVILLE
FIND A LAWYER Administrator thirty (30) days in advance of the end of the
Annual subscription period. An Annual subscription which is not renewed
will automatically convert to a Monthly subscription unless terminated.
Notice
of termination must be in writing, addressed to JACKSONVILLE BAR
ASSOCIATION, One Independent Drive, Suite 2201, Jacksonville, FL 32202-5050,
ATTN: Administrator of JACKSONVILLE FIND A LAWYER, with an email copy to
kcarver@jaxbar.org. Termination will be effective at the end of the billing cycle in which
notice is received by the JBA, and no prorating or refund of fees will be provided for any
reason.
3. I agree that the JBA and the administrators of its online advertising service may
make, without prior notice to me, any and all modifications to the general site as they
may deem to be in the best interests of all subscribers and the public. Such
modifications may include, but are not limited to, technical and functionality
modifications, format improvements, changes in the URL, changes in the logo(s),
limitations on the number of future advertisers under any specific category of law, and
changes in marketing strategies.
4. I acknowledge that listing on JACKSONVILLE FIND A LAWYER requires me to
satisfy certain professional criteria. To that end, I represent that:
a) I am an attorney in good standing with The Florida Bar;
b) I maintain a full-time private law practice;
c) I have not had any disciplinary action taken against me by The Florida Bar and its
Department of Lawyer Regulation or any other comparable body in any jurisdiction;
d) No disciplinary investigation or proceeding by The Florida Bar and its Department of
Lawyer Regulation or any other comparable body is currently pending against me in any
jurisdiction;
e) I have reviewed and agree to fulfill the following "Nine Commitments to Clients":
i) To treat clients with respect and courtesy;
ii) To handle their legal matters competently and diligently, in accordance with
the highest standards of the profession;
iii) To charge a reasonable fee and to explain in advance how that fee will be
computed and billed;
iv) To return phone calls promptly;
v) To keep clients informed and provide them with copies of important papers;
vi) To respect my clients’ decisions on the objectives to be pursued in their case,
as permitted by law and the rules of professional conduct, including whether or
not to settle their case;
vii) To work with other participants in the legal system to make our legal system
more accessible and responsive;
viii)To preserve the clients’ confidences learned during our lawyer-client
relationship; and
ix) To exhibit the highest degree of ethical conduct in accordance with the Rules
of Professional Conduct;
f) I will not transfer client matters that come to me as a result of my advertising on
JACKSONVILLE FIND A LAWYER, unless the transfer is in compliance with the Rules
regulating The Florida Bar: Chapter 4. Rules of Professional Conduct.
g) All information provided by me to JACKSONVILLE FIND A LAWYER is accurate and
complete;
5. I voluntarily wave privacy rights to the limited extent allowing the Administrator, or the
Administrator's designee, to be informed by The Florida Bar and its Department of
Lawyer Regulation on behalf of the Jacksonville Bar Association, Inc. ("JBA") as to
whether I have any formal disciplinary charges pending or any ethical grievances under
investigation by any Certified Grievance Committee, the Office Disciplinary Counsel, or
any other comparable body in any jurisdiction. I further agree that if, after listing on
JACKSONVILLE FIND A LAWYER, I am notified by any disciplinary authority that I am
the subject of an investigation or charges regarding professional ethics, I will
immediately notify the Administrator of the JACKSONVILLE FIND A LAWYER Program,
of the investigation. I understand that, pursuant to paragraph 9 below, I will not be listed
initially on JACKSONVILLE FIND A LAWYER or, if already listed; my listing will be
withdrawn from the site unless and until any such disciplinary proceeding or grievance
has been resolved in my favor.
6. I agree that as a condition to being listed by the JBA and CBS on JACKSONVILLE
FIND A LAWYER, I must be a current member of the JBA.
7. I currently carry lawyer's professional liability insurance with coverage limits of at
least $100,000 per occurrence and $300,000 in the aggregate. In addition, if I practice
in the areas of medical malpractice or product liability claims, I carry lawyer's
professional liability insurance with limits of at least $1,000,000 per occurrence. If my
coverage is terminated for any reason, I will notify the Administrator immediately at
which time my name will be removed from JACKSONVILLE FIND A LAWYER without
any refund of fees paid. I will submit a renewal verification form to the Administrator
within thirty (30) days from the expiration date of the terminating policy along with the
coverage of my new policy which shows my limits and deductible.
8. I agree to use a written fee agreement with every fee-generating client contact from
JACKSONVILLE FIND A LAWYER and to provide an executed copy of such agreement
to my client(s). I agree that any disputes with clients contacting me through
JACKSONVILLE FIND A LAWYER regarding fees will be resolved through The Florida
Bar Fee Arbitration Committee, in accordance with its rules. I agree to cooperate with
the arbitration and be fully bound by any decision made by the arbitrators.
9. I agree that my listing on JACKSONVILLE FIND A LAWYER will be removed
immediately, without any refund of fees paid, in the event that (i) I violate any of the
provisions of this Agreement; (ii) any information provided by me is inaccurate or
incomplete; (iii) I fail to pay any JACKSONVILLE FIND A LAWYER service fees when
due; (iv) a disciplinary proceeding, or other investigation, is instituted against me for
professional misconduct; or (v) I fail to abide by the standards of ethics and
professionalism set forth herein, and in the Florida Rules of Professional Conduct.
10. I agree to indemnify, defend and hold the JBA, CBS, and their agents and
employees, harmless from and against any and all claims, damages, liabilities, costs,
demands, suits or losses (including attorney's fees and other costs of defense) arising
from or relating to (i) information that I provide to the JBA or CBS in connection with
JACKSONVILLE FIND A LAWYER; (ii) any services that I perform for or provide to, my
clients; (iii) my negligence or other wrongdoing, or (iv) my breach of any term or
condition set forth in this Agreement.
11. THE JBA AND CBS PROVIDE THE JACKSONVILLE FIND A LAWYER SERVICE
"AS IS," "WITH ALL FAULTS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT
PERMITTED BY APPLICABLE LAW. THE JBA AND CBS MAKE NO
REPRESENTATIONS, WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED.
THE JBA AND CBS DISCLAIM ANY AND ALL WARRANTIES OR CONDITIONS,
EXPRESS, STATUTORY AND IMPLIED, INCLUDING WITHOUT LIMITATION (1)
WARRANTIES OR CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE; AND (2) WARRANTIES OR CONDITIONS THAT ACCESS
TO OR USE OF THE JACKSONVILLE FIND A LAWYER SERVICE WILL BE
UNINTERRUPTED OR ERROR FREE. IN NO EVENT WILL THE JBA OR CBS BE
LIABLE FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE
DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM THIS
AGREEMENT OR THE JACKSONVILLE FIND A LAWYER SERVICE. IN NO EVENT
SHALL THE JBA OR CBS BE LIABLE TO ME FOR ANY DAMAGES EXCEEDING THE
AMOUNT THAT I HAVE PAID FOR JACKSONVILLE FIND A LAWYER SERVICE
UNDER THIS AGREEMENT.
12. This Agreement will be governed by the laws of the State of Florida, and any dispute
arising from or relating to this Agreement or the JACKSONVILLE FIND A LAWYER
service shall be submitted to binding arbitration through the American Arbitration
Association or other mutually acceptable arbitrator(s) conducted in Jacksonville, Florida.
I agree to cooperate with the arbitration and be fully bound by any decision made by the
arbitrator.

Current Fee Schedule
The JACKSONVILLE FIND A LAWYER program offers two payment plans.
MONTHLY SUBSCRIBERS - $150/per month: Pending approval of your online listing,
your credit card will be charged approximately thirty (30) days from the day your
account goes live to the public, and again on the same day each month following for a
minimum of three (3) months. Unless you contact JACKSONVILLE FIND A LAWYER to
cancel, we will continue to charge you on a monthly basis.
ANNUAL SUBSCRIBERS - $1,620/Annual Fee: Pending approval of your online listing,
your credit card will be charged thirty (30) days from the day your account goes live to
the public. The annual subscription fee provides a 10% savings off the twelve (12)
month subscription rate. Annual subscribers will be notified in advance of profile
expiration date so that renewals can be processed previous to expiration. Annual
subscriptions not renewed by expiration date will be pulled from public view one
business day post-expiration.
