A tender is invited for the work given in Appendix ‘A’. The work is estimated to cost as given in the Appendix '’A’ 02. The work is to be completed within the period given in Appendix ‘A’ ( in accordance with the phasing , if any indicated in the tender) from the date of handing over the site, which will be on or about (given in Appendix ‘A’) 03. Normally contractors whose names are on the approved list of Ordnance Factory Chanda or MES, Chandrapur and within whose financial category the tendered amount would fall may tender. In case where the tendered amount is in excess of the financial category of the contractors, the Accepting Officer reserves the right to accept the tender. The tenderer would be required to lodge individual security deposit as may be notified by the Accepting Officer. Not more than one tender shall be submitted by one contractor or one firm of contractors. Under no circumstances will a father and his son (s) or other close relations who have business dealing with and another be allowed to tender for the same contract as separate competitors. A breach of this condition will render the tenders of both parties liable to rejection. 04. The General Manager, Ordnance Factory Chanda will be the Accepting Officer herein after referred to as such for the purpose of this contract. 05. Application for tender form must be submitted to the General Manager, Ordnance Factory Chanda so as to reach his office on or before the date given in Appendix ‘A’. 06. Tender form and conditions of contract and other necessary documents (together with addressed envelopes to be used for the return of tender form and other documents) will be issued on and after the date given in Appendix ‘A’ to approved contractor. In case of contractor who have not executed the standing security bond, their tender shall be accompanied by earnest money amounting to a sum given in Appendix ‘A’ in the form of a deposit at call receipt issued in favour of the General Manager, Ordnance Factory Chanda by a scheduled bank. A contractor who has executed the standing security bond but not for the appropriate category as mentioned above shall deposit within 30 days of the receipt by him of notification of acceptance of tender, the amount of security deposit as (difference) given in Appendix ‘A’. CONTRACT LABOUR (REGULATION & ABOLITION) ACT 1970 The subject contract is covered under Contract Labour (Regulation & Abolition) Act, 1970 and Contract Labour (Regulation & Abolition) Central Rules, 1971. The Contractor is liable to obtain a license from Labour Enforcement Officer, 1st Floor, Kamal Complex, Ramnagar, Chandrapur and maintain all the records under the Act and Rules. He is also liable to provide Canteen, Rest Room and First – Aid facilities etc. and other such benefits to his labourers as required under the said Act and Rules. In other words, the contractor is deemed to have read and have full knowledge of the said act and he has to comply with its full requirement during the execution of this contract. Any provision of the forementioned documents shall be deemed to take precedence over them. Acceptable Standard or Work and Workmansh ip 2 a)To determine standard of work and workmanship, the Engineer- In- Charge may order the contractor to execute certain portions of work under the direct supervision of Engineer- In- Charge or his authorised rep. and label these work as ‘Guiding samples’ ( acceptable samples) so that works may be executed to confirm to these samples. b)The contractor shall proceed with work in bulk only after satisfactory compliance of the requirements of para (a) above. The total completion period allowed for work shall be deemed to have made allowance for this requirement. Fair Wage payable to Labourers 3 Contractor shall have no claim whatsoever, if no account of any local regulation or other he is required to pay wages in excess of the Minimum Wages shown in the Schedule of Minimum Fair Wages. Security of Classified 4 Contractor’s special attention is drawn to condition 2 & 3 of General Conditions of Contract (IAFW 2249). The contractor shall not communicate any classified information regarding works either to sub-contractors or others without prior approval of the Engineer-In- Charge. The contractor shall also not make copies of the design, drawing and other documents furnished to him in respect of works on or earlier to determination of the contract. The contractor shall along with final bill attach a receipt from the Engineer-In-Charge in respect of his having returned the classified documents as per condition o3 of General conditions of contracts (IAFW 2249). 5 If the contractor is required to employ more than twenty workmen on the work under this contract, shall be bound by the Contract Labour Regulation & Abolition Act, 1970 and rules framed there under. No contractor can undertake or execute his work without a license issued by licensing Officer. Co- operation 6 with other Contractors The contractor is required to work in close co-operation with other contractors or execute working in the same area which may separate therein after. The person signing the tender on behalf of another on behalf of firm shall attach with tender a prior power of attorney duly executed in his favour by such person or by all the partners of the firm stating that he has authority to bind such other person of the firm as the case may be in all matters pertaining to the contract including arbitration clause. Condition 1 : of IAFW 2249 in respect of royalty shall be amended as below: “ The contractor will not be allowed to remove or extract any materials from MD land except approved earth required for works. Approved earth will be allowed to be extracted from placed (as approved by Engineer- In- Charge or his authorized representative) located at site shown on the site Plan or as directed by the Engineer-In- Charge.” b) Allotment of Land. The following shall be read in conjunction with condition 24 of IAFW 2249. “ The contractor shall be permitted to store his materials including erecting temporary sheds for his labour camp. Temporary workshop and the like at the area (s) only with prior permission of factory authorities and as directed by the Engineer- In- Charge and he shall pay a license fee ` 1/- (Rupee One only per year or part thereof in respect of each and every separate area allotted to him”. Electric supply 11. a) In case the contractor desires to buy electricity from O.F. Chanda, he shall be charged ` 250/- as a fixed charge for the electric energy consumed, at the following rates : i) ii) at ` 12.00 per unit for lighting + Electric Duty. at ` 12.00 per unit for power + Electric Duty. OR the current tariff applicable. b) Electric supply required for work shall be made available by O. F. Chanda at a point marked on site plan or as decided by Engineer-In- Charge. The exact location of the electric point shall be shown by the Engineer-In- Charge. The main switch and KWH meter to register the power supplied shall be provided and installed by the contractor. The contractor shall provided all necessary connections, cable fitting etc. from the main switch in order to ensure a suitable supply of electricity for execution of work. Contd… 3 -: 3 ::T.E. No. OFCH/EO/65 OF 2011-12 PAGE NO. 10 c) The factory does not guarantee for continuity of supply and no compensation whatsoever shall be allowed for supply becoming intermittent for break down in the system. d) The supply shall be AC 3 phase, 230 / 400 Volts 50 Cycles per second. Contractors Representatives Servants and Workmen The Contractor shall employ only Indian National as his representative, agents, servants and workmen and verify their antecedents and loyalty before employing them for the works. He shall ensure that no person of doubtful antecedents and nationality is in technical collaboration or other consideration. If employment of any foreign national is unavoidable, the contractor shall furnish full particulars of this effect to the Accepting Officer at the time of submission of his tender. The General Manager shall have power and without giving reasons to direct to the contractor immediately to remove in connection with this contract, any representatives, agents, servants, workman or employees whose continued employment in his opinion is undesirable. The contractor shall not be allowed any compensation on his account. In this connection reference is invited to condition 25 of IAFW 2249. Consumption of Cement 12. For the purpose of keeping a record of cement issue and consumed in works, the contractor shall maintain a bound register in the form approved by Engineer-In-Charge showing daily receipts from quantity used in works and balance in hand. This register shall be signed daily by contractors representatives and Engineer-In-Charge in token of their verification of its correctness. This check will not however absolve the contractor or his responsibility to justify the consumption of cement at the time of finalization of his account. Work in Unrestricted Area 13. Conditions of Work in Unrestricted Area. Time and Progress Chart 14. Attention is invited to condition 11 of IAFW 2249 according to which time and progress chart will be prepared by the contractor in consultation with Engineer- In- Charge, taking into the account contractor resources and site restriction so that the period of completion mentioned herein is adhered to. Normally there shall be no restrictions on the working hours but the contractor, his labour, agents and transport are liable to be searched at any time or any number of times by Security Staff. All materials of proprietary nature such as WPC bitumen, paint etc. shall be entered in the Measurement Book and vouchers shall be submitted for verification of Engineer-In- Charge by the contractor. Conditions of Working in Restricted Area 16. The work lies within the restricted areas as shown on the site plan, following are the conditions for working within “ Restricted Area”. a) Definition : Restricted Area’s for the purpose of this contract means the areas declared as such by the units shown in site plan / described in special conditions. b) Visit to site within the Restricted Area : Permission to enter the restricted areas at the time of submission of tender can be obtained from the General Manager. Tenderers are advised to send prior intimation to the General Manager about the particulars of their agents, representatives etc. if any, the date and time to their proposed visit so that necessary arrangement may be made by him to secure admission. Whether a tenderer visit the site or not be shall be deemed to have full knowledge of the restrictions on entering into / exist from and the working within the Restricted Areas. c) Entry and Exit : The contractor, his agents, representatives, workmen etc. and his materials, carts, trucks or other means of transport etc. will be allowed to enter through and leave from only such gate or gates and at such time as the General Manager or depot authorities in charge of restricted area may at their sole discretion, permit to be used. Contractor’s authorised representative is required to be present at the places of entry and exit for the purpose of identifying a carts, truck etc., to the personnel in -charge of the security of the restricted area. d) Identity Cards or Passes : i) The Contractor, his agents and representatives are required individually, to be in possession of an identity card or pass duly verified by Police Department. The identity card and pass will be examined by the Security Staff at the time of entry into or exit from the Restricted Area and also at any time or any number of times inside the Restricted Area. ii) Identity of Workman : Every workman shall be in possession of an Identity Card. The identity card will be issued by Ordnance Factory Chanda only after character verification of each and every individual by Police Authorities. Contd…5 -: 5 ::- T.E. No. OFCH/EO/65 Conditions of working OF 2011-12 PAGE NO. 12 The attestation form will be obtained by the Contractor from the factory and the same will be submitted to factory duly filled in alongwith a crossed DD for ` 100/- per head drawn in favour of the SP Chandrapur for verification purpose where verification is to be done by the Civil Authorities of Maharashtra. Contractor, however shall not absolve himself from his responsibility for the proper conduct and action of his workmen, agents, representatives. Any damage / loss caused by the Contractor’s agents, representatives and workmen to the existing properly of works shall be made good by the contractor free of cost and to the entire satisfaction of General Manager. e) Search : Thorough search of all persons and transport shall be carried out at each gate and for as many times as gate is used for entry or exit and may also be carried out at time or any number of times at the work site within the restricted area. f) Working Hours : The units controlling restricted areas, usually work during 6 days in the week and remain closed on the 7th day. The working hours normally observed area as following : Monday to Saturday : 8.00 Hrs. to 16.30 Hrs. Sunday / Holiday : Closed The working hours available to contractor’s labour and staff are appreciably reduced because of the time taken in security checks in force at the time of entry, exit and during working hours. The Tenderers attention in invited to the fact that the total number of working hours for a unit are prescribed in regulations and that they can not be normally increased by the Sr. General Manager or authorities controlling the restricted area. The definition of working day given under condition 1 (t) or IAFW 2249 does not apply in cases where the works are carried out in Restricted Area. Conditions of Working g. Working on Holidays : The Contractor shall not carry out any work on gazetted holidays, weekly holidays and other non- working days except when he is expressly auhorised in writing to do so by the General Manager. The General Manager may at his sole desecration declare any day as holiday or non- working day without assigning any reason for such declaration. Contd…6 -: 6 ::T.E. No. OFCH/EO/65 OF 2011-12 PAGE NO. 13 h) Access to Restricted Area after completion of work : After the works are completed and surplus stores etc. are removed the contractor, his agents, representatives or workmen etc. may not be allowed any access to the restricted area except for attending to and rectification of defects pointed out to him by the General Manager. i) Fire Precautions : a) The Contractor, his agent, representatives, workmen etc. shall strictly observe the order pertaining to fire precautions prevailing in the restricted area. Process involving fire hazards like welding etc. will be permitted with only prior permission. b) Motor transport vehicles if allowed to enter the restricted area must be fitted with serviceable fire extinguishers. j) If the Contractor desires to employ female labour on work to be carried outside the area of a factory and a female searcher is not borne on the authorized strength of the factory at the time of execution of work, the pay and allowances etc. for female searcher (Class – IV servant) shall be paid by the contractor. If more than one contractor employees female workers, extra female searcher’s to be employed in addition to the authorised strength of the factory the salary and allowances paid to the additional female searchers) shall be distributed on an equitable basis between the contractors employing female labour making consideration the values and periods of completion of their contracts. The GM’s decision in regard to the amount recoverable on this account from any contractor shall be final and binding. Conditions for entry : Following conditions will be laid down as mandatory before allowing the entry of the contractor’s casual labourers inside the Factory Restricted Area : a) PVR Documents : Filling up to Attestation Forms by the Contractors and forwarding it to the Security Officer of the Factory through concerned section / office alongwith a crossed D.D. of ` 100/- (Where verification is to be done from Civil Authorities of Maharashtra) per head (Ref Para (ii) above ) for initiation of the PVR documents to the concerned Police Authorities. A period of 90 days may be allowed for the receipt of the completed PVR documents from the Police Authorities by the Factory Security Staff, by which time the contractors should get the PVR or disengage the Casual labourers. No. OFCH/EO/65 OF 2011-12 PAGE NO. 14 b) Identity Documents : Production of identity and Character Certificates from two Gazetted Officers in respect of labourers of the contractors to be given to cover the 90 days period stated at Sub- Para (a) above. c) Labour Supervisors : For every 30 Contractor’s labourers or part thereof, there should be a supervisor with Temporary Pass (IAFW 3050) after being duly verified by the Police (PVR) as thereto to ensure and guarantee the identity and conduct of the labourers while inside the factory. d) Wearing of Identification Jackets by Contractor’s labourers : The Contractor’s labourers during working inside Factory & Magazine shall be required to wear the “Maroon Colour Jacket” and the cost of the jacket shall be borne by the contractor only. If it is not been followed, Security Officer will have the right to stop the entry of Contractor’s labour inside Factory & Magazine for working. e) Surprised Checks : The Security Staff of the factory will carry out surprise checks at the work sites to ensure that the Contractor’s Supervisors are present and adhere to the security restrictions imposed by the Security Staff. f) Arbitration Clause:- All disputes & differences arising out of or in any way touching or concerning this agreement (except these for which specific provision has been made therein) shall be referred to Sole Arbitrator to be appointed by Director General Ordnance Factories, Government of India. The Arbitrator so appointed shall be a Government servant who had not dealt with matters to which this agreement relates and in course of his duties had not expressed views on all or any of the matter in disputes or differences. The Award of the Sole Arbitrator shall be final and binding on the parties. The venue of the Arbitration shall be Ordnance Factory Chanda.
