STANDARD WARRANTY FOR FLYGT PRODUCTS
Xylem Water Solutions, a division of Xylem Canada Company (“the Company”) warrants the Flygt
manufactured products to the original end user against defects in workmanship or material under
normal use and service in compliance with the requirements of the Company Catalogue, Technical
Manual, Specifications, and Care and Maintenance Manual relative to the product.
The Company’s sole obligation under this warranty shall be to repair, replace or grant a credit
reimbursement, at the Company’s discretion, through its warranty processing procedures for defective
products when returned prepaid to the Company and upon the Company’s exclusive examination
found to be defective. Parts and repairs due to abnormal or abusive wear and tear are excluded.
Products repaired or replaced under this warranty will be returned freight collect.
The warranty period is as follows:
Flygt 2000 series pumps are warranted for eighteen (18) months from date of shipment.
Flygt DS, HS and NS pumps are warranted for six (6) months from date of installation
or twelve (12) months from date of shipment, whichever occurs first.
Flygt Diesel pumps are warranted for twelve (12) months or two thousand (2,000) hours of
operation, whichever occurs first.
All other Flygt products are warranted for twelve (12) months from date of installation or
eighteen (18) months from date of shipment, whichever occurs first.
Repairs carried out by the Company’s service personnel are warranted for:
• Twelve (12) months from date of repair, applicable only if genuine parts have been used or;
• Ninety (90) days from date of repair, applicable if refurbished or reconditioned parts have
been used.
Flygt spare parts shipped separately and not installed by the Company are warranted for thirty
(30) days from date of shipment.
Electrical system schematics (including Bills of Material) and/or general layout arrangement of the
installation may be required to support any warranty claim.
Warranty shall not apply to any other product or part of product which has been subjected to: accident,
negligence, operated and/or installed and/or used in a manner contrary to the Company’s printed
instructions or damaged due to defective power supply, improper electrical protection or faulty
installation or repair.
Equipment manufactured or supplied by others, sold by the Company, and not incorporated in
Equipment manufactured and sold by the Company, shall bear only the warranty given to the
Company by the manufacturer or supplier of the Equipment.
The Company neither assumes, nor authorizes any person to assume for it, any other obligation in
connection with the sale of its equipment. The Company’s liability as stated herein cannot be altered,
enlarged or extended except in writing by an officer of the Company.
THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, OBLIGATIONS,
CONDITIONS OR LIABILITIES, EXPRESSED OR IMPLIED BY THE COMPANY OR ITS
REPRESENTATIVES. ALL STATUTORY OR IMPLIED WARRANTIES AND CONDITIONS,
INCLUDING BUT NOT LIMITED TO WARRANTY OF MERCHANTABILITY AND

WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, BUT EXCLUDING WARRANTY
OF TITLE, ARE HEREBY EXPRESSLY NEGATED AND EXCLUDED.
UNDER NO CIRCUMSTANCES WHATSOEVER SHALL THE COMPANY BE LIABLE FOR
SPECIAL OR CONSEQUENTIAL DAMAGES, WHETHER OR NOT BASED UPON OR
RESULTING FROM THE COMPANY’S NEGLIGENCE ON ANY CLAIM FOR LOSS, DAMAGE
OR EXPENSE ARISING OUT OF OR CONNECTED WITH THIS CONTRACT OR ANY
OBLIGATION RESULTING THEREFROM. THE COMPANY’S ENTIRE LIABILITY ON ANY
CLAIM FOR LOSS, DAMAGE OR EXPENSE, FOR ANY CAUSE (WHETHER AS TO
EQUIPMENT DELIVERED OR NOT DELIVERED), THE MANUFACTURE, SALE, DELIVERY,
RESALE, REPAIR, USE OF, OR INABILITY TO USE ANY EQUIPMENT OR OTHER ITEM
WITHIN THE SCOPE OF THE CONTRACT - WHETHER SEPARATELY OR IN COMBINATION
WITH ANY OTHER EQUIPMENT OR MATERIAL OR FROM ANY OTHER CAUSE
INCLUDING BUT NOT LIMITED TO ACTIONS FOUNDED UPON NEGLIGENCE OR
BREACH OF CONTRACT SHALL, UNDER NO CIRCUMSTANCES WHATSOEVER, EXCEED
THE REPAIR OR REPLACEMENT VALUE, WHICHEVER IS LOWER, OF THE PARTICULAR
COMPONENT INVOLVED.
THE COMPANY’S OBLIGATION TO REPAIR OR REPLACE EQUIPMENT IN ACCORDANCE
WITH THIS WARRANTY, SHALL BE THE PURCHASER’S EXCLUSIVE REMEDY FOR
BREACH OF ANY WARRANTY OR FOR NEGLIGENCE.
