CONTRACT AND HOLD HARMLESS AGREEMENT FOR THE USE OF LSUS FACILITIES
This agreement made by the Dept. of Kinesiology Health Science on behalf of Louisiana State University in Shreveport (“LSUS" or
"University”), and
(LESSEE) and, in consideration of the agreements
herein expressed, LSUS does hereby lease to LESSEE the facilities described below on the University campus, together with available
services and equipment as requested and available, pursuant and subject to the provisions of the policies of the University Policies,
and the laws of the City of Shreveport and the State of Louisiana. This contract shall be constructed and interpreted in accordance with
the laws of the state of Louisiana.

Lessee agrees to pay a 20% down payment at time of signed contract. Lessee also agrees to pay remaining balance of rental fee no
later than 7 days prior to event ________________. If rental fee is not paid by this date, or the Lessee does not notify the University of
cancellation, this agreement will be null and void, all monies paid to the University will be forfeited.

The LESSEE hereby assumes responsibility for the condition of the premises. The University shall not be liable for any damages or
injury caused by any vice or defect therein to any tenant or occupant, nor to anyone in the building or on the premises by license of
LESSEE, unless the University knew of such vice or defect and failed to remedy same within a reasonable time after acquisition of
such knowledge. The LESSEE undertakes and agrees to indemnify, hold harmless and save the University, its agents and employees
against any and all claims, demands, damages and expenses, including any
claims or liability for compensation under the Louisiana Workman’s Compensation Act arising out of an injury sustained by an
employee of LESSEE or any contractor or subcontractor of the said LESSEE, or LESSEE’S invitees, together with reasonable
attorney fees for the defense thereof, arising from the use of the premises by LESSEE, or from any act of negligence of LESSEE, its
agents, employees or visitors in or about the premises or other portions of the building, or the lawns, terraces, sidewalks, and parking
area adjoining the building.
If the facilities to be used are under circumstances where, in the judgment of University officials, there is a significant risk factor, a
certificate of public liability insurance will be required from the using organization in an amount not less than one million dollars
($1,000,000.00). Insurance must be in effect at all times during the operation of this agreement. Proof of insurance must be provided
before event is signed off on. In addition, if deemed necessary medical staff/supervision may be required and proof of medical
staff/supervision must too be provided before event is signed off on.
In the event Lessee does not comply in all respects with the terms and conditions of the Agreement, LSUS may, without notice,
terminate this Agreement. LSUS reserves the right to cancel or alter reservations as deemed necessary by LSUS. University events
hold priority. All parties agree that any amendments or changes to the arrangements described in this contract must be made in
writing, signed by both the Lessee and LSUS.
Lessee and LSUS acknowledge that this Agreement is the entire agreement between the parties and that there is no other agreement
between Lessee and LSUS in reference to this matter. This Agreement supersedes, voids, and terminates all other agreements existing
in reference to this matter. This Agreement may not be modified, amended, changed or terminated unless both Lessee and LSUS
execute a written notification of such change, modification or termination.
Signatures indicate acceptance of the aforementioned terms and conditions and the parties signing on behalf of the Lessee and LSUS
are duly authorized to bind their respective entities to this Agreement.

FEE FOR THE USE OF LSUS FACILITIES
A. Fee Structure will be based on the following scale:
1.
Base rate by the hour, day or event
2.
Base rate for 4 hours for equipment
3.
Deposit equal to half the quoted fee will be required
two weeks prior to the event.
4.
Deposit will be returned after event if
a)
No additional charges occurred
b)
No damages were done to the facility
5.
If event is canceled, the deposit minus scheduling fee
will be refunded if,
a)
Written notification is received 7 working days prior
to the event or,
b)
If inclement weather causes cancellation, a full
refund will be given.
B. Fee is for use of the building and sport fields and does not
include extras. The following are additional fees:
1.
Any additional set-up or take-down charges will be quoted
on request.
2.
Special equipment needs or requirements must be addressed
in advance.
3.
Personnel
a)
Staffing for the Facility Supervision needs included
as an additional charge at $15/hour.
b)
Aquatic activities will require lifeguards @ $10/hour
c)
Security may be provided by request at
$25/hour/officer(min. 4 hours) (Large events mandatory)
d)
Housekeeping at $15/hour (min. 4 hours)
4.
Reported damage claims fee Concessions may occur during events with prior approval
a)
Sales of merchandise may only occur with approval. Minimum 20%
royalty to the university
b)
Incidents and Accidents need to be reported on university
report form (ask facility supervisor)
c)
Copies of this form must be held present during the event by
the organization representative
d)
The representative of the organization that signs the reservation form must
be present at the event while it is in progress
e)
All vehicles must be parked in the parking lots on campus. NO
parking is allowed on the shoulders of the university roads,
fire lanes, or sports fields.
f)
Certified athletic trainers or EMT personnel must be present at all competitive sports events.
g)
CHILDREN AGE 12 AND UNDER MUST BE SUPERVISED AT ALL TIMES.
h)
If the event runs over contracted time, additional fees will be
accessed.
