GLOSSARY OF TERMS 2012 DeclarationsTribal Declaration is used to activate the Tribal Emergency Operations Plan and opens the door to additional authority not available otherwise (TAB A2.2) State of Montana Declaration is used to supplement additional disaster relief from the State of Montana in accordance with Title 10, Chapter 3, Section 311, MCA. (TAB B1) Federal Declaration is used when State resources have been exhausted and Federal assistance is needed. Debris Management- eligible work is defined as the removal and disposal of debris that was generated by a disaster and which presents an immediate threat to the public interest. (A link is provided for all guidance for this under the Hyperlink page TAB H) Debris Removal - picking up debris and taking it to a debris management site, composting facility, recycling facility, permanent landfill, or other reuse or end-use facility. Disaster- the occurrence or imminent threat of widespread or severe damage, injury, or loss of life or property resulting from any natural or artificial cause, including tornadoes, windstorms, snowstorms, wind-driven water, high water, floods, wave action, earthquakes, landslides, mudslides, volcanic action, fires, explosions, air or water contamination requiring emergency action to avert danger or damage, blight, droughts, infestations, riots, sabotage, hostile military or paramilitary action, disruption of state services, accidents involving radiation byproducts or other hazardous materials, outbreak of disease, bioterrorism, or incidents involving weapons of mass destruction. Disaster and Emergency Services- the preparation for and the carrying out of disaster and emergency functions and responsibilities, other than those for which military forces or other state or federal agencies are primarily responsible, to mitigate, prepare for, respond to, and recover from injury and damage resulting from emergencies or disasters Disaster Medicine- the provision of patient care by a health care provider during a disaster or emergency when the number of patients exceeds the capacity of normal medical resources, facilities, and personnel. Disaster medicine may include implementing patient care guidelines that depart from recognized nondisaster GLOSSARY OF TERMS 2012 triage and standard treatment patient care guidelines determining the order of evacuation and treatment of persons needing care. Division- the division of disaster and emergency services of the department. Duration of Response- a period of time beginning when an emergency responder is requested by the appropriate authority to respond to an incident and ending when the responder is released from the incident by the incident commander and returned to the emergency responder's place of residence by the most direct route and includes the time required to replace and return all materials used for the incident to the same or similar condition and state of readiness as before the response. Emergency- the imminent threat of a disaster causing immediate peril to life or property that timely action can avert or minimize. Fire Protection Service- a governmental fire agency organized under Title 7, chapter 33, or another fire suppression entity organized under the laws of this state, any other state, or an agency of the government of the United States. (TAB A2.23) Tribal Government Situation Report (DES form 209)The Tribal Government Situation Report (DES Form 209) is a reporting tool for emergency management officials from any of the legally constituted political subdivisions of the state (i.e.; Tribe). It is intended as a means of notifying the Montana Disaster and Emergency Services Division (State DES) of an event or occurrence, whether caused by individuals or natural phenomena, which has the potential for developing into an emergency, disaster, or incident requiring action at the state level.(TAB A2.1) Incident- an event or occurrence, caused by either an individual or by natural phenomena, requiring action by disaster and emergency services personnel to prevent or minimize loss of life or damage to property or natural resources. The term includes the imminent threat of an emergency. The term does not include a state of emergency or disaster declared by the governor pursuant to10-3-302 or 103-303. GLOSSARY OF TERMS 2012 Individual Assistance- Disaster assistance is money or direct assistance to individuals, families and businesses in an area whose property has been damaged or destroyed and whose losses are not covered by insurance. It is meant to help you with critical expenses that cannot be covered in other ways. This assistance is not intended to restore your damaged property to its condition before the disaster. While some housing assistance funds are available through our Individuals and Households Program, most disaster assistance from the Federal government is in the form of loans administered by the Small Business Administration. Incident Commander- the person who is designated in the Tribal emergency operations plan. Intra State Mutual Aid- Additional resources provided from other jurisdictions throughout the State of Montana. Tribal Nations must opt into the Intrastate Mutual Aid System, a letter (on tribal letter head) requesting the Tribal Nation’s desire to be a part of the Intrastate Mutual Aid system is all that is needed. The letter can be faxed or mailed to the Operations Section Chief at (406) 324-4790; attn. DES OPS section chief or, PO Box 4789 Fort Harrison MT 59636-4789; attn. DES OPS Section Chief. Member Jurisdiction- the state of Montana or a political subdivision or a federally recognized Tribal Nation that participates in the system. Montana Disaster and Emergency Services Division (DES)- Montana DES is the lead in agency coordinating comprehensive emergency management in Montana. Located at 1956 Mt. Majo St Fort Harrison MT. There are 24 full time employees including 6 district reps that are located within each of the districts. Mutual Aid Agreement or Agreement- an agreement, consistent with the purposes of this part, by one or more fire protection services, emergency medical care providers, or government subdivisions of this state with one or more fire protection services, emergency medical care providers, or government subdivisions of any other state or the United States. Party Emergency Service- a fire protection service, emergency medical care provider, government subdivision, or agency of the United States that is a party to a mutual aid agreement as provided in this part. Political Subdivision- any county, city, town, Tribal Nation or other legally constituted unit of government in this state. GLOSSARY OF TERMS 2012 Posse Comitatus Act- 18 U.S.C., Sec. 1385 The use of the Army, Navy, Air Force, and Marines from participating in arrests, searches, seizure of evidence and other police-type activities on U.S. soil. (The coast guard and National Guard are excluded from this act). Principal Executive Officer- the mayor, presiding officer of the county commissioners, or other chief executive officer of a political subdivision. Public Assistance-. This program provides assistance for debris removal, emergency protective measures, and permanent restoration of public infrastructure i.e.…Debris Clearance, Emergency Protective Measures, Roads and Bridges, Water Control Facilities, Buildings and Equipment, Utilities, Parks, Recreational Facilities and Other Items. State of Montana Duty Officer (DO)- The duty officer is the Division’s 24- Hour point of contact for reporting emergencies, disaster related events and requesting state assistance. (When calling after hours the reporting agency needs to ask to be transferred to the DO) 324-4777 System- the Montana intrastate mutual aid system. Tribal Government- the governing body of a federally recognized Tribal Nation within the state of Montana. Volunteer Professional- an individual with an active, unrestricted license to practice a profession under the provisions of Title 37, Title 50, or the laws of another state.
