I/we acknowledge and agree that where the Property is mortgaged it is my/our responsibility to secure the mortgagee’s (lender’s) agreement to the works required under the Scheme being carried out. 4. I/we acknowledge that the operations shown on the schedule of works attached hereto (‘the Works’) are those identified as being required to meet the objectives of the Scheme and that it may become necessary during operations on site to make variations to the Works and I/we consent to such variations and further works and agree that these will be at the sole discretion of The Vale of Glamorgan Council (“the Council”). 5. I/we agree to the Council’s contractor entering the Property to carry out the Works. 6. I/we acknowledge that where additional works are required that are of a substantial nature, eg. renewal of rotting rafter ends, that the Council will seek my/our further permission before those works are undertaken. 7. I/we understand that the Works will be managed by the Council’s Grant Agency and the Grant (“the Grant”) is being offered in connection with the Council’s Housing Renewal Policy 2014. 8. I/we agree to pay a contribution of £………………… towards the Works and I/we accept that my/our contribution must be paid to the Council before the Works can commence and my contribution together with the Grant will be held and managed by the Council’s Grant Agency who will pay the contractor direct for Works completed to the Council’s satisfaction. 9. I/we acknowledge that my/our contribution will be a “one-off” payment and that any increase in the cost of the Works will be met by an increase in the Grant unless I/we do something or fail to do something which increases the cost of the Works in which case I/we agree to pay any increase in my/our contribution. 10. I/we acknowledge and agree that where I/we am/are the Landlord of the Property it is my/our responsibility to notify and obtain the consent of my/our Tenant and Superior Landlord (if any) in the case of associated residential or commercial premises to notify the tenant of the Works to be undertaken. 11. I/we understand that internal decorations affected by the Works are my/our responsibility and that the Council accepts no liability for any damage of whatever nature arising from the execution of the Works. 12. I/we understand that I/we will not be entitled to make a claim for compensation due to temporary closure or the erection of scaffolding in relation to the Property and/or loss of income in relation to any associated residential or commercial premises due to disruption caused by the Works. 13. I/we understand that the Council will not be liable for disturbance/damage to frontages and boundary walls/fences arising from the execution of the Works. 14. I/we understand that the contractor will dispose of all existing material replaced as part of the Scheme and hereby agree to sole disposal of such material by the contractor. 15. I/we understand that where windows are replaced on the Scheme the new window design will be determined by the contractor in the contractor’s absolute discretion in order to comply with the requirements of the Scheme and the relevant Building Regulations. 16. I/we confirm that all curtains blinds and items within the vicinity of the windows to be replaced shall be removed prior to commencement of the Works. 17. I/we understand and agree that prior to commencement of the Works all loft spaces to receive insulation shall be clear of all personal items furniture and other such items. 18. I/we accept that consenting to take part in the Scheme does not place the Council under any obligation to carry out the Works and acknowledge that it may decide without consultation and in its absolute discretion not to execute the Works and that the Council shall have no liability for any costs or claims arising from non-execution of the Works. 19. I/we understand that immediately after a satisfactory final inspection by the Council’s officers the Works will become entirely my/our responsibility and the Council shall have no further responsibility or liability for the Works. 20. I/we understand that after a period of 14 days from the date of signing this consent form should I/we wish to withdraw from the Scheme I/we will incur a £200.00 charge to cover the Council’s agency fees in addition to which the Council will require full repayment for all Works carried out which will include costs incurred for any materials or components that may have been ordered together with architects plans, planning permission, building regulation application and administrative fees which may have been incurred and I/we hereby agree to pay the aggregate of such sums to the Council in that eventuality. 21. I/we understand that I/we must repay the Grant in full to the Council if the Property is not occupied within 6 months of the Works being completed which in relation to a Commercial Improvement or a Town Centre Living Grant requires the Property to be actively trading within the 6 month period. 22. I/we understand that I/we must occupy the Property in accordance with the Occupation Certificate I/we have signed in relation to the Property throughout the Grant Condition Period. I/we understand that failure to comply with the signed Occupation Certificate will result in a breach of the terms and conditions of the Grant and that I/we must repay the Grant on a reducing amount as determined by the Council.
