Cal. Gov. Code §8549 et seq., Emergency Response Team for State Operations, 2002 8549. The definitions contained in this article shall govern the construction of this chapter, unless the context requires otherwise. 8549.1. "Asbestos release" means any dislodged building construction material that contains any amount of asbestos fibers. 8549.2. "Act of terrorism" means any unlawful harm, attempted harm, or threat to do harm to, any state employee, state property, or the person or property of any person on the premises of any state-occupied building or other property leased or owned by the state. 8549.3. "Business interruption" means any unplanned occurrence which causes the stoppage of the operation of any state agency in such a manner that it cannot accomplish its mission and goals. 8549.4. "Director" means the Director of the Office of Emergency Services. 8549.5. "Public transportation interruption" means the complete loss of public transportation services, including, but not limited to, the loss of transportation services due to the closure of a bridge or major highway, but does not include the loss of a personal vehicle. 8549.6. "Responsible administrator" means the agency emloyee who has onsite authority to direct state agency employees. 8549.7. "State-occupied building" means any building owned or leased by the state. 8549.8. "Team" means the Emergency Response Team for State Operations. 8549.10. There is in state government the Emergency Response Team for State Operations. 8549.11. (a) The team shall be comprised of all of the following: (1) The Chief of the Occupational Safety and Health Division of the Department of Industrial Relations. (2) The Commissioner of the Department of the California Highway Patrol. (3) The Director of the Office of Emergency Services. (4) The Director of Finance. (5) The Director of General Services. (6) The Director of Health Services. (7) The State Fire Marshal. (8) The Director of Forestry and Fire Protection. (b) The team shall be chaired by the Commissioner of the Department of the California Highway Patrol. 8549.12. The team shall meet not later than January 31, 1991, for the purpose of organization. 8549.13. The team shall work to improve the ability of state agencies to resume operations in a safe manner and with a minimum of delay if their operations are significantly interrupted by a business interruption. 8549.14. Each team member shall designate not less than one member of his or her staff to serve as a team representative. 8549.15. Each team member shall designate not less than one staff member from the state agency under the supervision of the team member to provide clerical support for the team. 8549.16. The Director of the Office of Emergency Services shall define the equipment necessary to ensure the full functioning of each team member. 8549.20. (a) The Department of General Services, in cooperation and consultation with the team, shall develop model business resumption plans which detail how a responsible administrator should direct state employees and state agency operations when, including, but not limited to, any of the following business interruptions affect a state agency: (1) Act of terrorism. (2) Asbestos release. (3) Earthquake. (4) Fire. (5) Loss of electronic information. (6) Loss of all or a portion of state-occupied space for a period of one hour or more. (7) Major theft of equipment or documents. (8) Public transportation interruption of five days or more which impedes the ability of agency employees to commute to work. (9) Toxic spill. (b) The team may include, in the development of model business interruption plans, other business interruptions in addition to those listed in subdivision (a). 8549.21. In developing model business resumption plans, the team shall identify emergency response plans and actions which are required by federal or state law. 8549.22. The team shall, not later than July 1, 1991, furnish each state agency with the model business resumption plan developed pursuant to this article.
