Recruit for, coach, manage and supervise the ______ varsity sports team and program; 2. Supervise and evaluate Assistant Coach(s) and other staff; 3. Operate athletic program within assigned budget; assist in development of the program budget; assist with compliance with Title IX. 4. Ensure team compliance with institution’s academic standards. Notify Director when student athletes experience academic difficulties, including but not limited to any grade below “C,” poor attendance, academic probation, etc. 5. Comply with all NCAA and Conference rules and regulations; Regents’ Policy and University Regulations; UAF policies, rules, and procedures (including policies and procedures of the Department of Athletics and Recreation); 6. Immediately inform the Director of Athletics of NCAA/Conference rule violations or potential rule violations; 7. Promote positive image for athletic program and institution; 8. Furnished Vehicle Use of a sponsor-provided vehicle may be provided as available and determined by _____________. The coach is required to meet IRS reporting regulations and the university may withhold an amount for federal income tax purposes based upon one of the university procedures whether it be commuting valuation rule method, cents per mile rule method or annual lease valuation rule method. Coach must meet all campus health and safety/risk management department criteria for operating a University of Alaska vehicle. By accepting this position Coach agrees to indemnify the University of Alaska for all claims arising out of the personal use of such vehicle, and to do all things required to effectuate the indemnification, including but not limited to completion of forms and proof of insurance to Alaska Statutory limits through endorsement on a personal auto insurance policy. Non-university drivers and drivers who have not been approved through the campus health and safety/risk management department are prohibited. The vehicle will be returned immediately in the event UAF and/or the coach sever this contract. Benefits Coach will be eligible for and receive university provided employee benefits in the same manner and to the extent as other exempt, nonrepresented employees of the university. Outside Income In accordance with NCAA Bylaw 11.2.2, Athletically Related Income and the Alaska Executive Branch Ethics Act, outside income is allowed, however, coach must obtain written approval of the designated ethics supervisor and UAF’s Chancellor prior to rendering any outside services for compensation. In addition, the coach must provide a written detailed account annually to the Chancellor for all athletically related income and benefits from sources outside the institution. Term Appointment 2 08/17/2015 Withholding UAF may withhold amount for federal income tax and other purposes from and/or on account of salary and other payments or benefits to the coach in amounts it deems necessary to comply with law or appropriate to avoid incurring direct liability for failure to withhold. Termination Of Contract In addition to termination pursuant to general provisions of Regents’ Policy and University Regulation (see General Conditions), UAF may terminate this contract without further obligation in the event of any major infractions or violations of NCAA, CCHA, or GNAC or UAF rules and regulations, or for any misconduct by the Coach determined by UAF to have the potential to negatively impact UAF, the team or department. Failure to self-report violations, repeated secondary violations, failure to attend rules education sessions, or failure to document evidence of compliance may result in termination of this contract under this provision. Violations are defined in accordance with current NCAA Bylaw, Article 19 Enforcement: 19.02.02 Types of Violations Secondary Violation: A secondary violation is a violation that is isolated or inadvertent in nature, provides or is intended to provide only a minimal recruiting, competitive or other advantage and does not include any significant recruiting inducement or extra benefit. Multiple secondary violations by a member institution may collectively be considered as a major violation. (Revised 1/11/94) Major Violation: All violations other than secondary violations are major violations, specifically including those that provide an extensive recruiting or competitive advantage. (Revised 1/11/94) Prohibition Of Competition The coach agrees that during, and/or for a period of eighteen (18) months following the expiration or termination of this contract [he/she] is prohibited from participating in any camps that are in direct or indirect competition with camps hosted by the University of Alaska. Extension Of Contract This contract may be extended by mutual written agreement of both parties. Logo The University of Alaska retains all rights to use of the institutional names, logos, and seals; any use is subject to review and approval. Sponsorship The University of Alaska Fairbanks retains all rights to review and approve any and all sponsorship agreements, and revenue is the property of UA__. Examples might include moving expenses, housing, alternative duty station, etc.] General Conditions of Employment This appointment and other conditions of employment are governed, in order of priority, by Regents’ Policy, University Regulation, applicable campus rules and procedures as they presently exist or as they may be amended from time to time at the discretion of the university, and the terms of this letter. Your position is a “Term” appointment. Unless your employment is terminated earlier in accordance with Regents’ Policy, University Regulation and the terms of this letter, your employment will continue until the end date, or the end date of any extension, specified above. At that point employment will end automatically without further notice or obligation on the part of the University, unless a new written employment agreement is entered into. At the end of this appointment you may or may not be offered a new appointment, at the sole option of the university. Neither this appointment, any prior appointment, any representation regarding future employment possibilities, nor the continuation of work beyond the end of the appointment period entitles you to a new appointment or any notice at the end of this appointment. As a new employee of the University you are employed in an at-will probationary status for the first six months of employment. During this period your employment may be terminated for no reason or any reason. Pursuant to University Regulation 04.09.040, the University also may elect to discontinue employment through non-retention with notice or pay in lieu of notice. The notice period, however, will not extend beyond the end of the appointment period specified above. Non-retention does not reflect discredit on an employee. This letter is the sole agreement between you and the University, and no other agreements, discussions or representations shall affect the University’s or your obligations under this agreement. Alterations to the terms of this letter are ineffective unless approved in writing by the Coach, the hiring authority, and Human Resources. Any action or claim brought upon this agreement, or relating to service pursuant to this agreement, must be brought in the State of Alaska and shall be governed by the laws of the State of Alaska. If any aspect of this contract is held to be unenforceable, it shall not operate to nullify or terminate this contract unless the portion held unenforceable is significant in terms of the agreement as a whole. You are a “responsible employee” under Title IX. Being a responsible employee means that you must report all relevant details regarding alleged incidents of sexual harassment or sexual assault that you become aware of to your campus Title IX coordinator within 24 hours. You are also subject to the Alaska Executive Branch Ethics Act (AS 39.52), as amended from time to time, and are required to complete and submit, to your dean or director, disclosure forms, including forms for “Outside Employment or Services,” “Notice of Potential Violation,” “Receipt of Gifts,” or “Interests in State Grants, Contracts, Leases or Loans.” When disclosures are required they are due upon the occurrence of a disclosable event and, for outside employment and services, at least every July 1. A copy of the form for disclosing outside employment or services is included with this letter. In addition, the Ethics Act requires, among other things, that you may not disclose or use information gained in the course of or by reason of your official duties that could result in the receipt of any benefit for you or an immediate family member, if the information has not also been disseminated to the public.
