ARTICLE XVII STUDENT DELEGATES Section 1 – Objective/Purpose Clause I. It is the intent of the Associated Student Organization to provide students the opportunity to be involved in the activities and representation of the Associated Students of Palomar College, who otherwise would or could not participate as elected members of the Associated Student Organization. Section 2 – Selection Process Clause I. In order to be eligible to become a Student Delegate the candidate must meet and fulfill the following criteria: a. Maintain and complete a minimum of six (6) units. b. Maintain a grade point average of 2.0 or better, throughout the entirety of their college coursework, or in the final semester of high school coursework if the student has yet to obtain a college-level GPA. 1. It shall be the sole discretion of the Director of Student Affairs to make determinations regarding grade point averages. Nothing in this Bylaw shall be construed to abridge the right of the Director of Student Affairs to count or otherwise disregard any coursework for the purposes of ascertaining eligibility. Clause II. Eligible students must arrange for a preliminary meeting with the Vice-President and President to discuss the ASG and the students’ interests. Clause III. If the student decides he/she, at this point, would like to be appointed as a student delegate, a. If seats are available for all eligible delegate applicants, 1. The President may place the students eligible for appointment on the agenda for an appointment review at the regular ASG meeting. 2. Having received confirmation from the OSA regarding the candidate’s eligibility, the ASG shall ascertain the eligibility of potential candidates for the student delegate position. 3. At the beginning of the next ASG regular meeting, the ASG shall approve or deny student delegate appointments with a 2/3 majority vote. b. Alternatively, at the President’s discretion, or in the case of more delegate applications than available seats, 1. The Vice-President may place the students eligible for appointment on the agenda for an appointment review at the Policies, Procedures, and Executive Review Committee. 2. Having received confirmation from the OSA regarding the candidate’s eligibility, the PPER shall ascertain the eligibility of potential candidates for the student delegate position. 3. The committee will make and send their decision to the ASG board for final approval of appointment with the understanding that the appointment review will be primarily relied upon. Clause IV. The Delegate membership of the Associated Student Government shall not exceed seven (7). Section 3 – Duties and Responsibilities Clause I. Student Delegates are to remain non-voting members of the Associated Student Organization. Clause II. Must maintain the minimum requirements found in (Article I, Section I). a. In addition, the specific duties inherent to the position of Student Delegate shall be found in (Article I, Section 3, Clause II). Clause III. If a Delegate fails two assignments or tasks, and they are unexcused, PPER will review and make a decision whether or not to excuse the violations. If the violations are not excused the Delegate will be dismissed. a. Tasks are defined as anything assigned by the President or by a 2/3 majority vote of the ASG board. b. It shall be the duty of the President to define the terms of failure. Clause IV. PPER will determine if the Delegate will be placed on probation. a. If a violation occurs during the probationary period, the delegate will be removed. Clause V. Should a delegate be recommended to probation the following conditions shall apply: a. Probationary status shall last for ten (10) regular school days. b. The Delegate will lose the right to vote during the probationary period in their respective committees. c. The Delegate shall lose the privilege of making and/or seconding a motion during the probationary period in their respective committees. d. The Delegate shall be prohibited from official ASG travel during the probationary period. e. The Delegates will submit a written plan to the President clearly stating how he/she will correct his/her unsatisfactory behavior. f. The office use privileges afford to the member(s) shall be revoked for the period of probation. g. Other members of the Associated Student Government will be notified of the Delegate’s probationary status during the subsequent General Session following the Executive Review. Section 4 – Benefits and Privileges Clause I. The benefits and privileges of the Student Delegate position shall be as follows: a. Office use (computers, phones, materials, other resources) with limitations to be determined by the Director of Student Affairs b. May participate at the ASG Retreat(s) c. May be issued Student Identification cards indicating Student Delegate position d. Any other benefit or privileges as deemed by the President or majority of the ASG Board Clause II. Limitations may be set by each ASG Board as a standard policy as stated in the ASG Policy Manual for that term. Clause III. Any delegate may request to become a senator after one month of serving his/her delegacy by sending a formal request to both the President of the ASG as well as the chair for Policies, Procedures, and Executive Review Committee (PPERC). In order for a delegate to become a senator, the procedures are as follows: a. PPERC will allow the delegate to present for up to 3 minutes about why they are qualified to become a senator. b. The Vice-President shall report on the student delegate’s progress and contributions to PPERC. c. The PPERC shall vote with simple majority to recommend the student delegate to the ASG board as an agenda item to formally request a senator position. d. The ASG Board may vote on this item and subsequently with a 2/3 vote the candidate will become a senator and are subject to ratification at the ASG General Session two (2) weeks following their initial appointment. e.
