AGREEMENT OF AFFILIATION

And

PURPOSE

This document constitutes an agreement between the following parties:

Regents of the University of Minnesota

(hereinafter referred to as the University)

And

< Affiliate/business/organization name >

(hereinafter referred to as the Affiliate) for the purpose of providing supervised internship experience for HPER Recreation – Outdoor Education students.

The parties agree that by working together they will be contributing to the fulfillment of client needs and developing excellence in education and research by providing utilization of community resources. This cooperative effort will supplement service to clients and otherwise benefit and enrich the Affiliate through the stimulus of association with the

University, its faculty and students. The two acknowledge that the affiliation is needed by the University for the completeness of the curriculum and the professional competence of the students.

DESCRIPTION OF AFFILIATION

With this agreement, the University and the Affiliate establish a program of education and training which requires facilities, equipment, services and personnel appropriate for students to obtain necessary internship experience.

MUTUAL AGREEMENTS

1.

The parties agree to provide equal opportunity to students and/or faculty in accord with the law.

2.

Periodic conversations and/or meetings between the University and Affiliate staff, and consultation with students will be held to assure continuous evaluation of this internship program.

3.

Unless otherwise stated, this contract may be terminated by either party with a 60-day written notice. In unusual circumstances, the contract may be terminated immediately, after consultation and with the approval of both parties.

4.

The University and the Affiliate shall have equal rights to withdraw any student from assignment to the Affiliate at any time.

5.

Internships shall be scheduled on a mutually agreeable basis . HPER Recreation – Outdoor Education students spend approximately 600 hours (40 hours/week x 15 weeks) conducting their internship.

6.

The internship shall provide learning experiences that give the student the opportunity to: a.

Observe the role of the <Agency name & Name, Title of immediate site-supervisor of intern > in the

Affiliate setting. b.

Gain an understanding of community and professional resources. c.

Acquire knowledge and skill in working with clients, their families and significant persons if appropriate.

7.

This experience is intended to supplement the student’s educational curriculum as well as to assist in developing future resources. There will be no financial commitment between the Affiliate and the University.

8.

It is agreed that the primary responsibility of the Affiliate is client service and that internship experiences are secondary to that responsibility.

UNIVERSITY RIGHTS/RESPONSIBILITIES

The University will:

1.

Notify the Affiliate of changes in University supervisory staff and/or curriculum.

2.

Prepare the student for the internship through classroom instruction and laboratory practice.

3.

Provide liaison with the Affiliate by means of telephone and written contact.

4.

Assume overall responsibility for the general educational experience assigned to the Affiliate including: determination of educational goals for each student; establishing a prerequisite criteria for placement with the Affiliate; determination of completion of the assignment; guidelines for final evaluation of student’s performance; and approval of Affiliate staff members who will participate in the education of University students.

5.

The University will not routinely perform background checks on program applicants and makes no representations or warranties as to the fitness of applicants for program participation. At the request of the Affiliate, students who have direct contact with Affiliate clients will be required to participate in background studies pursuant to Minn. Stat. §§

144057 and 245A.04 as a prerequisite to participation in the program.

AFFILIATE RIGHTS/RESPONSIBILITIES

The Affiliate will:

1.

Orient the student to Affiliate policies and procedures.

2.

Maintain a work environment free from harassment in all forms as described in the established Human Resources policy.

3.

Provide emergency medical care if necessary in the event of a student’s accident or illness while the student is on the premises, but will not be financially responsible for the charges involved, follow-up care or hospitalization.

4.

Provide qualified supervision with ongoing supervision to the student.

5.

Provide appropriate learning experiences and work with the student to meet learning objectives as outlined in his/her learning contract.

6.

Complete a written evaluation of the student’s performance at the close of the internship.

7.

Notify the University of any emergency or of any problem(s) which may threaten the student’s ability to successfully complete the internship.

8.

Have the right to remove a student from this placement at any time.

9.

Perform all necessary background studies of students if deemed necessary.

STUDENT RIGHTS/RESPONSIBILITIES

1.

The student will adhere to professional standards established by the discipline and the Affiliate in the provision of services.

2.

The student shall accept assignment for internship as arranged by the University and the Affiliate and shall accept professional guidance from the assigned supervisor.

3.

The student shall adhere to the policies, procedures and regulations of the Affiliate.

4.

A copy of this agreement shall be made available to the student.

5.

The student shall be responsible for providing transportation needed for the placement within reasonable distances and will provide a copy of a valid driver’s license and proof of insurance if using a private vehicle.

6.

Students will not transport clients.

7.

Students will maintain open lines of communication with the Affiliate and University supervisors.

OTHER TERMS

1.

The agreement shall be effective <date> and shall remain in effect until <date>.

(Term may not exceed five years.)

2.

Neither the University nor the Affiliate shall discriminate on the basis of race, religion, creed, color, sex, national origin, disability, age, marital status, public assistance status, veteran status, or sexual orientation.

3.

Nothing in this Agreement is intended or should be construed as creating the relationship of copartners, joint ventures, or an association among the parties, nor shall any party, its employees, agents, students or representative be considered employees, agents or representative of any other party.

4.

It is specifically agreed that neither party shall be responsible for costs or expenditures incurred by the other in the conduct of the education and training program.

LIABILITY INSURANCE AND INDEMNITY

The University shall maintain professional and general liability insurance in minimum amounts of $1,000,000 per claim /

$3,000,000 annual aggregate covering University students for activities performed within the course and scope of their duties under this affiliation agreement. General liability coverage for students is limited to bodily injury and property damage claims. Upon request, the University will provide a certificate of insurance evidencing such coverage. The University’s liability is limited to the extent of its insurance coverage pursuant to the Minnesota State Tort Claims Act, Minn. Stat. §

3.736.

The Affiliate agrees to defend, hold harmless, and indemnify the University, its officers, agents, employees and representatives against all claims for loss or damage to property or injury or death to persons, including reasonable attorney’s fees, arising from the negligent or wrongful acts or omissions of the Affiliate, its employees, agents, or representatives

(including students) during the performance of its obligations under this agreement.

ADDENDUM

Subject to the written authorization by appropriate representatives of the University and the Affiliate, addenda to this agreement may be developed to facilitate day to day and year to year execution of the goals of the agreement. Each addendum shall be in writing and executed by an authorized representative of each of the parties. To the extent an addendum is not properly executed by persons authorized to do so and to the extent it conflicts or contradicts the terms herein, it shall be considered null and void.
