NZQA registered unit standard 12841 version 5 Page 1 of 2 Title Demonstrate knowledge of New Zealand legislation related to the mediation of disputes Level 5 Credits 4 Purpose People credited with this unit standard are able to demonstrate knowledge of legislation covering a dispute and explain and apply the legislation. Classification Public Sector Services > Mediation Available grade Achieved Explanatory notes 1 The knowledge in this unit standard is intended to enable the mediator to mediate within a given legislative context, but not to give advice on the law. 2 For the purposes of this unit standard, legislation to be complied with is that which is related to the mediation context. These may include but are not limited to – Residential Tenancies Act 1986; Resource Management Act 1991; Family Proceedings Act 1980; Disputes Tribunals Act 1988; Employment Relations Act 2000; Children, Young Persons, and their Families Act 1989; Human Rights Act 1993. Outcomes and evidence requirements Outcome 1 Demonstrate knowledge of legislation covering a dispute. Evidence requirements 1.1 Demonstration identifies legislation covering the dispute situation. 1.2 Demonstration identifies any legislative boundaries to the mediation process. Outcome 2 Explain and apply the legislation. Evidence requirements 2.1 Explanation identifies legislative constraints or requirements as to the procedure for mediation. Please note Providers must be granted consent to assess against standards (accredited) by NZQA, or an inter-institutional body with delegated authority for quality assurance, before they can report credits from assessment against unit standards or deliver courses of study leading to that assessment. Industry Training Organisations must be granted consent to assess against standards by NZQA before they can register credits from assessment against unit standards. Providers and Industry Training Organisations, which have been granted consent and which are assessing against unit standards must engage with the moderation system that applies to those standards. Consent requirements and an outline of the moderation system that applies to this standard are outlined in the Accreditation and Moderation Action Plan (AMAP). The AMAP also includes useful information about special requirements for organisations wishing to develop education and training programmes, such as minimum qualifications for tutors and assessors, and special resource requirements.
