Explanatory notes

1 Performance in relation to the outcomes and evidence requirements must comply with current legislation, policies and procedures, including:

Health and Safety in Employment Act 1992;

2 Organisational requirements refer to instructions to staff on policies, procedures, and methodologies which are documented and are available in the workplace. They must be consistent with applicable legislation and any other applicable compliance requirements.

3 Throughout the conduct of an internal concealment detention, the health and safety of the detainee remains paramount.

4 The competency and skills covered by this unit standard are able to be fully demonstrated under simulated conditions.

Outcomes and evidence requirements

Outcome 1

Describe the legal requirements associated with a detention for internal concealment under the Misuse of Drugs Amendment Act 1978.

Range sections 13a

– 13m.

Evidence requirements

1.1 Indicators of possible internal concealment are identified.

Range may include but is not limited to – discomfort of suspect, intelligence report.

1.2 Customs policy and rules for a detention are explained in terms of current legislation.

Range Class A and Class B drugs, reasonable cause to believe, cessation of detention.

1.3 The process for carrying out a detention is explained in terms of section 13a of the Misuse of Drugs Amendment Act 1978.

1.4 The duties and roles of all people involved throughout a detention are explained.

Range includes but is not limited to – interviewer, detaining officer, logistics officer.

1.5 The rights of a person suspected of carrying drugs internally and who is detained for examination are explained in terms of current legislation.

Range includes but is not limited to

– New Zealand Bill of Rights Act

1990.

1.6 Documentation associated with a detention and the importance of accuracy with documentation is explained.

Range documentation includes but is not limited to – notice of detention for the purpose of personal search, notice of detention, Customs internal concealment checklist, medical advice sheet, consent to medical examination, certificate by person conducting examination, statements of service, application for detention warrant, detention warrant and renewal of detention warrant, medical log, monitor logs.

1.7 The resources required to support a detention are identified.

The health and safety issues surrounding a detention are explained in accordance with organisational requirements.

Range includes but is not limited to

– personal safety, use of protective clothing.

1.9 The procedure for examining waste is explained in accordance with organisational requirements.

1.10 Security requirements during a detention are explained in accordance with organisational requirements.

Outcome 2

Prepare to carry out a detention for internal concealment as a Customs officer.

Evidence requirements

2.1 Detention team is assembled and fully briefed in accordance with organisational requirements.

Range includes but is not limited to – interviewing officer, logistics officer, detaining officer.

2.2 Application for detention warrant and accompanying documentation is completed in accordance with organisational requirements.

Detention warrant is secured in accordance with organisational requirements.

Resources are assembled, checked and readied for use during the detention.

Range includes but is not limited to – detention room, medical practitioner, documentation.

Outcome 3

Carry out a detention for internal concealment.

Evidence requirements

3.1 Detainee is monitored at all times during the period of the detention with particular attention to their welfare.

3.2 Detention log of all activity is maintained in accordance with organisational requirements.

3.3 Examination of waste product is completed in accordance with organisational requirements.

3.4 Items of suspect nature are recorded and placed in secure storage in accordance with organisational requirements.

4.1 Documentation is completed and filed in accordance with organisational requirements.
