Explanatory notes 1 Performance in relation to the outcomes and evidence requirements must comply with current legislation, policies and procedures, including: Customs and Excise Act 1996; Criminal Disclosure Act 2008; Health and Safety in Employment Act 1992; New Zealand Bill of Rights Act 1990; Evidence Act 2006; Official Information Act 1982; Privacy Act 1993; New Zealand Customs Service Code of Conduct; (available from New Zealand Customs Service, PO Box 2218, Wellington 6140, www.customs.govt.nz); The State Services Code of Conduct, Standards of Integrity and Conduct (available from www.ssc.govt.nz). 2 Definitions Forfeiture generally refers to the state of the goods concerned in law and occurs automatically on the commission of some act or omission independent of any Customs action. Goods refer to all kinds of moveable property including animals. Organisational requirements refer to instructions to staff on policies, procedures, and methodologies which are documented and are available in the workplace. They are consistent with applicable legislation and any other applicable compliance requirements. Outcomes and evidence requirements Outcome 1 Prepare for a Customs fraud investigation. Evidence requirements 1.1 The investigation objectives and category of the operation are established in accordance with organisational requirements. 1.2 Information sources and the information to be collected from each source are identified. 1.3 Resources required to support the investigation are identified. 1.4 The investigation plan is developed in accordance with organisational requirements. Outcome 2 Implement the fraud investigation plan in accordance with organisational requirements. Evidence requirements 2.1 Relevant evidence is collected, evaluated and processed in accordance with the chain of evidence. 2.2 Operational activity to obtain evidence is undertaken. 2.3 Any forfeited goods are seized and processed. 2.4 Interviewing of suspects and witnesses is completed. 2.5 Recommendations to initiate a prosecution proceeding, where required, are completed. Range includes but is not limited to – offence reports. 2.6 Any outstanding Crown debt is recovered. 2.7 Case management principles are applied. Outcome 3 Carry out post-investigation activities.
