NZQA registered unit standard 29216 version 1 Page 1 of 4 Title Plan, manage and conduct, and evaluate interviews in a regulatory compliance context Level 5 Purpose Credits 15 This unit standard is for people currently employed as senior regulatory compliance practitioners. People credited with this unit standard are able to: – plan and prepare for interviews to obtain information in a regulatory compliance context; – engage with and prepare the interviewee for interviewing in a regulatory compliance environment; – manage and conduct interviews; and – conclude, review, and evaluate the interviews. This may be audio or video recording or written documentation. If interviews are with suspects, written documentation must include questions asked and responses. Assessment evidence and process must be in accordance with the Privacy Act 1993. c At least two interviews – at least one interview each of two different people. Interviews may be simulated. Simulation must reflect organisational requirements. Interviewee may be referred to by a range of terms such as participant, subject, witness, victim, complainant, or suspect. Outcomes and evidence requirements Outcome 1 Plan and prepare for interviews to obtain information in a regulatory compliance context. Evidence requirements 1.1 When planning and preparing: clarify the purposes of the interview, determine aims and objectives, determine interview strategies and record-keeping methods, assess interviewee fitness for interviewing, identify appropriate location, assess information to hand to determine possible offences and/or noncompliance. 1.2 Plan and prepare consistent with ethical, legal, and organisational requirements and taking into account the safety of regulatory staff and others. Range ethical requirements refer to – ethical principles of investigative interviewing, code or codes of conduct applicable to an organisation; legal requirements – relevant powers, obligations of the interviewee, obligations of the interviewer, rights of the interviewee; applicable legislation may include but is not limited to – the New Zealand Bill of Rights Act 1990, the Evidence Act 2006, and any legislation relating to an organisation’s specific regulatory role. Outcome 2 Engage with and prepare the interviewee for interviewing in a regulatory compliance environment. Evidence requirements 2.1 Establishment of rapport is consistent with good interviewing practice and needs of the regulatory compliance activity. 2.2 The interviewing process is explained to interviewee in a manner consistent with good interviewing practice, and in accordance with organisational requirements and needs of the regulatory compliance activity. Outcome 3 Manage and conduct interviews. Evidence requirements 3.1 Manage and conduct the interviews in accordance with the interview plans, purposes, and objectives. 3.2 Use questioning and information-gathering techniques that obtain full and detailed information relevant to the regulatory compliance activity and meet the objectives of the interviews. 3.3 Manage and conduct the interview consistent with ethical, legal, and organisational requirements and taking into account the safety of regulatory staff and others. 3.4 Record and/or document the interview consistent with ethical, legal, and organisational requirements. Outcome 4 Conclude, review, and evaluate the interviews. Evidence requirements 4.1 Compare interview outcomes with intended outcomes, and determine whether the interviews met the objectives. 4.2 Identify opportunities for improved future interviews, consistent with ethical, legal, and organisational requirements and taking into account the safety of regulatory staff and others. 4.3 Contribute to intelligence processes, where they exist, consistent with ethical, legal, and organisational requirements and taking into account the safety of regulatory staff and others. 4.4 Complete post-interview procedures, consistent with ethical, legal, and organisational requirements and taking into account the safety of regulatory staff and others.
