This is a theory-based unit standard for people who require an
understanding of contract law as it applies to infrastructure civil
works projects.
People credited with this unit standard are able to: demonstrate
understanding of infrastructure civil works contracts; describe
types of infrastructure civil works contracts; demonstrate
knowledge of New Zealand Standard 3910; and describe
procurement procedures for New Zealand Transport Agency
(NZTA) contracts for infrastructure.

Assessment against this unit standard may take place in a workplace and/or provider

1.1
The need for contract law is explained in relation to infrastructure civil works
projects.

Essential components required for a contract to be enforceable are described in
relation to infrastructure civil works projects.

rewards, penalties, damages, specifications, tendering, quoting,
estimating.

The invalidation of contract agreements is described in terms of circumstances
where conditions of contract, exemption clauses, and extent of liability may
cause invalidation.

may include – failure to give possession of site, failure to
commence work, abandonment of contract, liquidation, failure to
pay within prescribed timeframes, failure to proceed with due
diligence.

Contracts are described in terms of their systems and types.

types – lump sum, schedule of quantities, schedule of rates, costplus-percentage, cost-plus-fixed-fee, cost-plus-fluctuating-fee.
Contracts are described in terms of the advantages and disadvantages of
different systems and types.

3.1
The contract agreement and parties identified in the contract are described in
accordance with NZS 3910.
3.2
General Conditions of Contract are described in accordance with NZS 3910.
3.3
Numbered Schedules and Special Conditions in the First Schedule are
described in accordance with NZS 3910.
3.4
Specifications relating to special conditions of contract are described in
accordance with NZS 3910.
Range
specifications may include – drawings, resource consents,
technical information, health and safety requirements, service
authority requirements, notifications, insurance.
3.5
Contract variations and payment clauses are described in accordance with NZS
3910.
3.6
The importance of having site instructions and contract variations in writing is
described in accordance with NZS 3910.
3.7
Extensions of time are described in accordance with NZS 3910.
3.8
Practical completion and defects liability periods are described in accordance
with NZS 3910.

Describe procurement procedures for NZTA contracts for infrastructure.

Providers must be granted consent to assess against standards (accredited) by NZQA, or
an inter-institutional body with delegated authority for quality assurance, before they can
report credits from assessment against unit standards or deliver courses of study leading

NZQA before they can register credits from assessment against unit standards.
Providers and Industry Training Organisations, which have been granted consent and
