2 Glossary
Brief means the detailed instructions for the goods or services to be provided, contained in a document that aligns with the contract.
Contract for service exists when a person (or organisation) agrees to carry out work as an independent contractor (or entity), not as part of the employer’s organisation nor under the employer’s total control.
A business operation may form part of an organisation’s activities or it may constitute a complete organisation.
3 This unit standard could apply to contract for service for supply or maintenance of goods and/or services, and related material, plant and equipment resources. It builds on Unit 19030, Demonstrate knowledge of tendering, negotiating, and managing a contract in a business operation , and may lead on to Unit 7462, Secure tenders, negotiate, and monitor contracts for supply or maintenance of materials, plant, and equipment.
4 This unit standard will be assessed on the basis of evidence of demonstrated performance in the workplace.

Describe the contractual relationship between the parties in a contract for service.
Evidence requirements
1.1 The relationship between the parties is described in terms of legal status of the contract and legal responsibilities of the parties.
Range contracts
– written, verbal (oral).
1.2 Contract for service and contract of service are explained in terms of their differences.
Outcome 2
Develop a brief for a contract for service for a business operation.
Evidence requirements
The brief includes the areas of responsibilities of the two contracting parties. 2.1
2.2 The brief includes the purpose, scope, and outcomes and quality measures required by the party receiving the services.
2.3 The brief includes required quality standards, pricing expectations, payment terms, and contactor competencies.
2.4 The brief includes regular monitoring procedures and specified times for review of performance against the contract.
2.5 The brief includes draft clauses on commencement, term of the contract, dispute resolution, termination, and variations to contract.

Negotiate a contract for service for a business operation.
Evidence requirements
3.1 Draft contract is submitted to contracting party in advance of negotiation meeting.

Written agreement conforms with verbal (oral) agreements reached during negotiation, and with any regulatory requirements.

Performance of the contractor is monitored according to the procedures for monitoring in the contract, and evaluated against the minimum standards defined in the contract.
4.2 Performance variations and/or breach of contract are managed according to the terms and conditions of the contract and the agreed procedures for managing performance of the contract.
