Demonstrate knowledge of the requirements of employment agreements

This unit standard is for people involved in carrying out employment relations roles and activities consistent with employment law. These people may include union delegates, union officials, human resources staff, employees, and employers (including supervisors, managers, and business owners).

People credited with this unit standard are able to describe legal requirements for employment agreements, and analyse individual and collective employment agreements.

Explanatory notes

1 This unit standard does not cover negotiation of employment agreements.

2 Legislation

Legislation relevant to this unit standard must include the Employment Relations Act

2000 (ERA), and at least one Act from each of the following four classifications:

Holidays and Leave

– Holidays Act 2003, Parental Leave and Employment

Protection Act 1987;

Health and Safety – Health and Safety in Employment Act 1992; Injury Prevention,

Rehabilitation, and Compensation Act 2001;

Wages

– Minimum Wage Act 1983, Wages Protection Act 1983, Equal Pay Act 1972;

Other – Human Rights Act 1993, Privacy Act 1993, State Sector Act 1988, State-

Owned Enterprises Act 1986, Industry Training Act 1992, or any other act named in

Schedule 5 of ERA.

Outcome 1

Describe legal requirements for employment agreements.

Range collective, individual.

Evidence requirements

1.1 Description includes the role of the ERA in supporting the employment agreement.

1.2 Description identifies types of employment agreement, and explains where and how different types are used and/or required.

1.3 Description compares types of employment agreement in terms of their legal requirements, including formation.

Range includes but is not limited to – union, non-union member, new employee, 30 day rule, application of coverage.

Outcome 2

Analyse employment agreements.

Range individual, collective.

Evidence requirements

2.1 Analysis identifies statutory requirements, and other express and implied terms.

2.2 Analysis identifies all other documentation relevant to, part of, and/or referred to in each employment agreement.
