NZQA registered unit standard 23970 version 2 Page 1 of 3 Title Demonstrate understanding of the racing industry judicial system and processes Level 4 Purpose Credits 5 This unit standard is intended for people who are working in the racing industry who are required to have an understanding of the Judicial Control Authority (JCA), and JCA processes on raceday. People will be working under broad guidance with full responsibility for their work routines. Classification Equine>Equine Care Available grade Achieved Explanatory notes 1 Demonstration of competency must be consistent with: Workplace and/or stable procedures Race club procedures The rules and regulations of the particular Racing Code that directly relates to holders of New Zealand Harness Racing Inc. and/or New Zealand Thoroughbred Racing Inc. licences Legislation o Health and Safety in Employment Act 1992 o Racing Act 2003 The Rules of Harness Racing and the Regulations of Harness Racing The Rules of Racing Code of Welfare: Horses and Donkeys available at http://www.mpi.govt.nz. 2 Candidates must demonstrate competency in a commercial horse enterprise. 3 In the context of this unit standard, understanding means that there should be evidence of a learners’ thorough comprehension of a topic. A learner with a good understanding of a topic should have applied, or should be able to apply what they have learnt to a workplace situation and will be able to alter their practices to the different contexts they are applying their learning to. Assessors should be confident that the learners’ understanding is embedded in their practices and behaviour. 4 The Protest and the Breach of Rules application may be in the form of either an official enquiry or a mock enquiry. The candidates must be actively involved in the enquiries and both enquiries must have the participation of industry officials. Evidence requirements 1.1 Describes the purpose and function of the JCA on race day. 1.2 Describes the structure of the JCA and its race day panels. Outcome 2 Demonstrate understanding of the judicial processes carried out on race day. Evidence requirements 2.1 Describes the procedures involved in a judicial hearing. 2.2 Describes the procedures for lodging a protest. 2.3 Describes the procedures for a Breach of Rules conducted at a race day or non-race day hearing and the possible penalties. 2.4 Describes the procedures for a ‘Request for a Ruling’. 2.5 Describes the procedures for appealing a decision or penalty. 2.6 Describes the procedures for Protest and Breach of Rules application hearings. Providers and Industry Training Organisations, which have been granted consent and which are assessing against unit standards must engage with the moderation system that applies to those standards. Requirements for consent to assess and an outline of the moderation system that applies to this standard are outlined in the Consent and Moderation Requirements (CMRs).
