Commissioner of Elementary and Secondary Education COORDINATED PROGRAM REVIEW MID-CYCLE REPORT SE Criterion # 7 - Transfer of parental rights at age of majority and student participation and consent at the age of majority Rating: Implemented Basis for Findings: Administrative interviews and student record review indicated that one year prior to the student's 18th birthday, the district informs the student and parent/guardian of the transfer of educational decision-making rights from the parent/guardian to the student upon reaching the age of majority. Notice is provided to both the student and the parent/guardian, which explicitly states that all rights accorded to parents under special education law will transfer to the 18 year old student. The district documents its notification to parents and students with a statement in the IEP's Additional Information section. Student records confirmed that upon reaching the age of majority, the district obtains the student’s consent if s/he is sole decision maker or shares decision making with her/his parent/guardian. SE Criterion # 8 - IEP Team composition and attendance Rating: Implemented Basis for Findings: Administrative interviews and student record review confirmed that IEP Teams consistently have all required Team members in attendance. A review of documents and student records indicated that when required IEP Team members cannot attend, the district contacts the parent in advance and obtains the parent's agreement in writing to excuse that Team member. Administrative interviews, student records and documents indicated that excused required Team members provide written input to the parent and the IEP Team prior to the meeting. Document review also demonstrated that the school has a process to excuse team members whose areas are not being modified or discussed at the Team meeting. Massachusetts Department of Elementary & Secondary Education – Program Quality Assurance Services Mansfield Mid-Cycle Report - May 30, 2013 03:16:06 PM Page 2 of 4 SE Criterion # 18A - IEP development and content Rating: Implemented Basis for Findings: Review of student records and documents demonstrated that whenever the IEP Team evaluation indicates that a student's disability affects social skills development, or when the student's disability makes him or her vulnerable to bullying, harassment, or teasing, the IEP addresses the skills and proficiencies needed to avoid and respond to bullying, harassment, or teasing. Student record review demonstrated that when a student is identified with a disability on the autism spectrum, the IEP Team will consider and specifically address the skills and proficiencies needed to avoid and respond to bullying, harassment, or teasing. IEP Teams document this under the Additional Information section of the IEP and write appropriate goals to address the student's needs. SE Criterion # 25 - Parental consent Rating: Implemented Basis for Findings: Administrative staff interviews indicated that approximately 10 parents have exercised their rights of revocation after consenting to a student's special education services in the past year. Administrative interviews and record review verified that when a parent revokes consent for special education in writing, the district responds promptly by sending the parent written notice of its proposal to discontinue services within a reasonable time, generally 30 days or by the end of the school term, depending on the student’s schedule and needs, as well as a copy of the notice of procedural safeguards. Additionally, administrative interviews confirmed that the district does not use mediation or request a due process hearing to obtain agreement or a ruling requiring the continuation of services, consistent with federal regulation. SE Criterion # 26 - Parent participation in meetings Rating: Implemented Basis for Findings: The district provided its special education student roster as required by the Department. Administrative interviews revealed that the district uses oral interpreters who are familiar with special education procedures, programs and services, and record review demonstrated that the district documents this provision of oral translation.
