(In the remainder of this letter, please read “district” as meaning “school district or charter school.”) As you know, one component of the Department’s Mid-cycle Review process is the review of your district's self-assessment in the area of English learner education (ELE). The purpose of this activity is to determine if your district is beginning to implement the significant changes in M.G.L. Chapter 71A, this state’s law governing the education of limited English proficient students that was adopted by voters as Question 2 in 2002. The Department has reviewed your district’s ELE self-assessment documents and is providing you now with advisory comments and actions to be implemented in anticipation of your district’s next scheduled Coordinated Program Review. Where indicated in our report, your district is urged to request technical assistance in areas that, based solely on your self-assessment documents, were found not likely to be fully implemented. As the Department previously informed you, in cases where a district fails to fully and effectively implement a Corrective Action Plan, which was proposed by your district and approved by the Department, the Department must then prepare a Corrective Action Plan for the district, which must be implemented without further delay. You will find these requirements for corrective action and further progress reporting included in the attached report together with any steps that must be taken by the district to fully implement new special education requirements. ELE 2 MCAS Participation The district has a policy that ensures the participation of all ELE students in all tests of the annual MCAS administration, and has purchased approved bilingual dictionaries in various native languages as an accommodation during MCAS. ELE 3 Initial Identification The district has some written policies and procedures for the identification of ELE students for each of the grade/school levels. Once a student is identified and assessed to determine their level of proficiency, the student is then placed in appropriate classrooms setting with supports such as ESL instruction. The District offers a programming for ELLs consistent with Chapter 71A. Please submit a proposed process for the annual assessment of LEP students and include staff name, title, and role in the annual assessment process. Indicate which staff members are trained in MELA-O by October 2, 2006. The district states that it is in the process of reviewing its procedures for the initial identification and reclassification of its students are part of the restructuring of the Sheltered English Immersion (SEI) and English as a Second Language (ESL) programs K-8. ELE 8 Declining Entry to a Program The district indicated that it provides ESL support to students who have declined entry into the SEI program. Submit a description and appropriate documentation of the district’s policy and procedures for providing English language support to students whose parents have or will decline entry to a sheltered English immersion, two-way bilingual, or other ELE program by October 2, 2006, that will include: a) Policy and procedures for placing students in a regular education classroom after parents have opted out of an ELE program. b) Policy and procedures for monitoring student’s educational progress and for providing additional support, if needed, to ensure that the student has equal opportunity to have his or her English language and academic needs met. c) Policy and procedures for keeping parents of ELE students informed about their child’s progress. Also, provide a copy of the ELE student roster for school year 2006-2007 by October 2, 2006. ELE 9 Instructional Grouping The district indicates that appropriate instructional groups are maintained by grade level and according to the guidelines in MGL 71A. Submit an updated ELE Class Roster for school year 2006-2007 by October 2, 2006, that includes: a) student’s initials, home language, type of ELE program, years in the program, and current language proficiency. ELE 10 Parental Notification The district indicated that this portion of the program is not consistent in all areas and therefore is part of their restructuring process to be completed in the summer of 2006. Submit a description and appropriate documentation of the district’s implementation practices for parental notification by August 31, 2006, including: a) Parent notification in English and in all available languages. ELE 11 Equal Access to Academic Programs and Services The district indicates that ELE students have equal access to academic and services available to their English-speaking peers in the school district. Submit a description of the type of appropriate language support services provided to LEP student to ensure that LEP students have equal access to academic programs and services available to their English-speaking peers by october 2, 2006. ELE 12 Equal Access to Nonacademic and Extracurricular Programs The district indicates that LEP students have equal access to nonacademic programs and extracurricular activities available to their English-speaking peers. Submit a description of the type of appropriate language support services provided to LEP student to ensure that LEP students have equal access to nonacademic programs and extracurricular activities available to their English-speaking peers by October 2, 2006. ELE 13 Follow-up Support The district indicated that they are providing training for all staff on how to provide follow-up of former LEP students for the two year period following their exit from the program. Submit a description of the revised policy and procedures for monitoring students for two years after exiting the ELE program and the type of language support services that will be provided by October 2, 2006. The district indicated this process is under review and will be revised for the 2006-2007 school year. Include all forms developed in support of this standard. In addition, submit sample fliers announcing extracurricular activities in languages other than English by October 2, 2006.
