Commissioner of Elementary and Secondary Education COORDINATED PROGRAM REVIEW MID-CYCLE REPORT SE Criterion # 7 - Transfer of parental rights at age of majority and student participation and consent at the age of majority Rating: Implemented Basis for Findings: Review of student records, documents and an interview indicated that one year prior to the student reaching age 18, the district informs the student and the parent/guardian of the rights that will transfer from the parent/guardian to the student upon the student’s 18th birthday. The notification provided to both the student and the parent/guardian explicitly states that all rights accorded to parents under special education law would transfer to the 18 year old, unless the parent had been granted guardianship from the court, or the student elected to share education decision-making, or delegate decision-making to another adult. ,. SE Criterion # 8 - IEP Team composition and attendance Rating: Implemented Basis for Findings: Review of student records and an interview indicated that members of the Team attended Team meetings unless the parent and the district agreed to use alternative means, such as a video conference or a conference call; or the district and the parent agreed, in writing, that the attendance of the Team member was not necessary because the member’s area of the curriculum or related services was not being modified or discussed; or the district and the parent agreed, in writing, to excuse a required Team member’s participation and the excused member provided written input into the development of the IEP to the parent and the IEP Team prior to the meeting. SE Criterion # 18A - IEP development and content Rating: Implemented Basis for Findings: Review of student records, documents and an interview indicated that when the IEP Team evaluation indicates that a student's disability affects social skills development, or when the student's disability makes him or her vulnerable to bullying, harassment, or teasing, the IEP addressed the skills and proficiencies needed to avoid and respond to bullying, harassment, or teasing. For students identified with a disability on the autism spectrum, the IEP Team considered and specifically addressed the skills and proficiencies needed to avoid and respond to bullying, harassment, or teasing. Massachusetts Department of Elementary & Secondary Education – Program Quality Assurance Services Lenox Mid-Cycle Report – April 18, 2013 11:46:53 AM Page 2 of 3 SE Criterion # 18B - Determination of placement; provision of IEP to parent Rating: Implemented Basis for Findings: Student record review and an interview indicated that immediately following the development of the IEP, the district provided the parent or guardian with two (2) copies of the proposed IEP and proposed placement along with the required notice. In one case the student was presented the IEP as she is her own guardian. SE Criterion # 25 - Parental consent Rating: Implemented Basis for Findings: Student record review and an interview indicated that no parent revoked consent during the period covered in the review. The district had procedures in place if a parent gives consent for special education services and then, at any time following, revokes consent to the student’s special education services in writing, to discontinue all special education services, and does not use mediation or request a due process hearing to obtain agreement or a ruling requiring the continuation of services, consistent with federal regulation. If a parent revokes consent in writing, the district would promptly provide written notice to the parent/guardian of the district’s proposal to discontinue services, as well as information on how the parent could obtain a copy of his/her right to procedural safeguards. The district would provide the notice in a reasonable time before the district intended to discontinue the services.
