Department CPR Findings:
A review of student records and staff interviews indicated that although interpreters were
provided at meetings, translated communications, in particular, IEP documents and
progress reports, are not consistently provided when the primary language of the home is
other than English.
Description of Corrective Action:
Middleborough Public Schools will develop a plan to ensure that Communication are in
English and primary language of the home. This is the procedure that the district will
follow. Special Education will obtain a list of ELL students from the Home language
survey. The primary language section of the Administrative Data page will reflect the
home language. A Translation request form will be submitted to the PPS office while
processing the IEP. PPS Office will first contact our Foreign Language Department where
we have staff that can translate documents in Spanish, Portuguese, French and Russian.
If document cannot be translated internally, Catholic Charities Community Interpreter
Services will be contacted and contracted with to complete translation. All written
communication is then sent home to the parent in their primary language. Two IEPs are
given to the parent in primary language and English forms and translated forms are kept
in file. The district will continue to ensure and formalize procedures and processes for
translation of documents when requested by parents with limited English skills.

Description of Internal Monitoring Procedures:
The yearly distribution of updated Special Education Handbooks to principals, Special
Education Facilitators, Special Education Teachers that review communications pertaining
to the procedures and processes set in place for translations as indicated on the Home
Language Survey forms, the list of such parents in each building requesting such
translations will be compiled by the Special Education facilitators and special education

A review of the documentation and interviews indicated that the Parent Advisory Council
has not been provided with opportunities to advise the district on matters that pertain to
the education and safety of students with disabilities or in the planning, development, and
evaluation of the school district´s special education programs.
Description of Corrective Action:
The District will develop a plan for the Parent Advisory Council on advising the district on
planning development, and evaluation of the school district's special education programs.
The Director of PPS will attend Parent Advisory Council Meetings. A survey will be
developed in conjunction with PAC to assess parent interest areas. A Special Education
Program Description was developed during the 2011-2012 school year and this will be
reviewed with the MPAC as a starting point. This document is also located on the school
district's web page. Input would be solicited from MPAC as to areas of need. Special
Education will participate in a Climate Survey on Site Level Issues and special education
programs. Results of survey and parent advisory council members input will be reviewed
at each MPAC meeting.

Description of Corrective Action:
The Therapeutic Learning Center Program classroom does not have students with an age
span that exceeds 48 months for instruction. On Fridays there is the possibility that if all
students were on their target behavioral level, they may have the option for a reward
time during the same span. Classroom schedules have been adjusted so that no students
with an age span of more than 48 months exists.

Description of Corrective Action:
The Speech Therapy room at Middleborough High School has been relocated to another
area which would allow groups as large as 8 to meet in a comfortable and therapeutic
classroom setting. Materials, computers, assistive technology needs as well as locked file
cabinets were set up to meet the needs of students served in this location.

The document review indicated that the district has procedures for translating documents
and providing information to students/families whose first language is not English;
however, staff interviews and a review of student records showed that the procedures are
not always implemented in the district.
There was a lack of evidence that important documents, such as handbooks and codes of
conduct were translated and distributed to parents with limited English skills including
those who speak low-incidence languages.
Although there were families who indicated translation preferences on home language
surveys, a review of these student records provided no evidence that the parent received
translated information.
Description of Corrective Action:
The district will continue to ensure and formalize procedures and processes for translation
of documents such as handbooks and codes of conduct when requested by parents with
limited English skills. The ELL District Administrative Handbook will be reviewed with all
building principals prior to the start of every school year to go over such procedures and
processes to ensure all administration is well informed. This ELL Administrative Handbook
will be posted on the District's Website under the English Language Learner link.
Principals will ensure that appropriate building level staffs also are made aware on a
yearly basis of such procedures and processes as well. All principals will ensure a list of
requests for translation of documents by English limited parents is maintained and
updated throughout the school year.

spends annually to former students who have not yet earned their competency
determination and who have not transferred to another school only refers to students who
have not passed the MCAS, but does not inform these students of the availability of
publicly funded post-high school academic support programs and to encourage them to
participate in those programs. This letter is also only addressed to the parent and not the
student.
Description of Corrective Action:
The high school will revise their procedure and ensure that the letters mailed home to
parents of a student over 16 leaving school are also addressed to the student as well. In
addition, a new letter will be drafted and sent to both parents and student informing all
students who do not earn their competency determination and who have not transferred

Plan (DCAP) was revised in March 2007 and staff interviews indicated that it does not
reflect the current practices of the district nor is it implemented in its entirety in the
district's buildings.
Description of Corrective Action:
The district will review and update where needed the District's Curriculum Accommodation
Plan to ensure that all efforts have been made to ensure the needs of all learners in the
general education program. All schools will have operable student assistance teams in
place before the end of the first term. All student supports and intervention efforts will
consistently be documented and placed in the student record.

Throughout the year, building administrators working in tandem with the student

The district reported in its documentation that teachers are advised to review all
educational materials for simplistic and demeaning generalizations, lacking intellectual
merit, on the basis of race, color, sex, religion, national origin and sexual orientation;
however, interviews indicated that teachers are not doing this consistently.
Description of Corrective Action:
For the 2012-2013 school year, principals will present CR Criterion #24 during a staff
meeting to all staff prior to the end of the first term. As part of the opening day agenda
for all staff for the 2013-2014 school year and future first teacher day openings, building
principals will instruct all staff to review all curriculum materials used in classrooms
throughout the year no matter what form of media used. The staffs are to review the
curriculum for any simplest and demeaning generalizations, lacking intellectual merit on
the basis of race, color, sex, religion, national origin, and sexual orientation and provide
balance and context for any such stereotypes depicted in such materials. All professional
staff will sign off on attending this staff meeting and the CR #24 will be added to faculty
handbooks. Criterion CR 24 will remain posted on the staff only link on the District's
website. Materials will be monitored during administrative walk through.

The District Leadership Team under the guidance of the Superintendent of Schools will
develop a procedure and timeline regarding a annual institutional self-evaluation. The
purpose of this self-evaluation is to ensure that all students, regardless of race, color,
sex, religion, national origin, limited English proficiency, sexual orientation, disability, or
housing status, have equal access to all programs, including athletics and other
extracurricular activities. Then student, family and staff surveys developed by K-12
Insight will take place. The result of these surveys will be used to make any necessary
changes in need of strengthening programs. It would be the goal to put these surveys out
at the start of the next school year.

1. All building principals and the ESL teacher will be given the District’s ELL Procedural
Handbook prior to the start of each school year. This handbook will be updated annually to
ensure consistency with the Department of Elementary and Secondary Education regulations as
they relate to ELL and FLEP students and their families.
2. All ELL students will be assessed using multiple measures to include but not limited to
ACCESS, W-APT, LAS, classroom observations, district formative and summative
assessments, where applicable the MCAS/PARCC.
3. The ESL teacher for the district will provide the Director of Elementary Education and the
building principals a list of LEP students and their schedule for servicing those students at the
start of the school year.
4. The ESL teacher will provide the Director of Elementary Education and the principals a list of
all students screened in their schools as a result of the District’s Home Language Survey and

Department CPR Finding: Documentation reviewed indicated that the district has not developed an
ESL/ELD curriculum. The district reported that content instruction is based on the Massachusetts
English Curriculum Frameworks and the English Language Proficiency Benchmarks and Outcomes at
each grade level.
Regarding the ESL curriculum, the district should note that the Department has new regulations in
place which may affect the district’s corrective action plan (CAP). Please refer to:

Concerning hours of ESL instruction, documentation reviewed indicated that except for English
language learners (ELLs) at levels 4 and 5 on the MEPA (Massachusetts English Proficiency
Assessment), all other ELLs are not receiving hours of ESL instruction that are consistent with
Department guidelines. (Please refer to http://www.doe.mass.edu/mcas/mepa/guidance.html - p. 5).
Please refer to ELE 15 for comments on professional development requirements.
The Department concluded that the district does not have a fully implemented SEI program as required
by Chapter 71A. The district does not have an ESL curriculum, there are content area teachers who
have not met the SEI training requirements, and the amount of hours of ESL instruction provided to
most ELLs is inconsistent with Department guidance.

Narrative Description of Corrective Action:
1. The administrative team and the ESL teacher will work together on creating staff/student
schedules to reflect the DESE’s recommended number of service hours based on students’
proficiency levels, ACCESS scores, other pertinent testing information associated with the
students. When creating the student schedules, the district will try to keep ELL students
together in a particular block of teachers who have had the trainings in order to align with the
DESE’s RETELL trained staff regulations. This will be implemented for September 2013
when possible as students schedules have been set for the school year. This will go into full
effect in September 2014 when Cohort 1 of our 3 Cohorts will have completed the SEI
Endorsement course.
2. The district has a master list of teachers who will be trained this year as mandated by RETELL.
The list of teachers and administrators assigned to the Cohort Year 1 for the SEI Endorsement
course will be attached to this CAP. Please note that the identified teachers in the security
portal do not accurately reflect the entire district of teachers who had category training. The
District continued to send teachers to category training through 2011-2012 school year. We
were told not to send any after that as the RETELL initiative would soon be underway. Please
know that we had a enrollment allotment of 6 for the SEI Endorsement and we have 10
teachers enrolled. Thus, we surpassed our requirement as well as the 10% cap. (The master list
will be attached).
3. The district has begun the process of realigning the K-12 curriculum program with the 2011
Massachusetts Curriculum Framework for ELA and Literacy and the 2011 Massachusetts
Curriculum Framework for Mathematics. The ESL teacher will assist with the curriculum
teams to have our curriculum aligned with the WIDA standards. The district will also refer to
the MA DESE Guide for Developing A Content-Based English as a Second Language
Curriculum for guidance. We have sent our ESL teacher to the two day WIDA training along
with an ELA teacher from the secondary level. The curriculum is being piloted as units are
developed. The district is using Understanding by Design from K -12 for unit design. Once
the curriculum is fully implemented, our ESL teacher will check with the teachers of ELLs as
to how the lesson plans are reflective of the WIDA standards and offer assistance in supporting
the lessons with such standards. ESL materials specially Language Power for ELL learners by
Teacher Created Materials have been purchased and are used at the K-5 in the SEI program.
Most recently we purchased the enVisionMATH CCSS mathematics program for grades K-5
which has differentiated instruction clearly listed for every lesson for ELL students. WIDA
Can Do Booklets have been purchased and referenced for use at all levels by our ESL teacher
as well as the infusion of WIDA ELD standards to support the social, instructional and
academic language that our ELL students need to engage with their peers and teachers and
curriculum in their everyday world.

parent night. ELL parents were invited to this event by a personal phone call made to them by

ACCESS parent report as the event was held just prior to the reports being sent to the homes of
students who took the assessment in January 2013. The plan is to continue to offer ELL

Description of Internal Monitoring Procedures:
1. By October 1st of each school year, the Director of Elementary Education/Director of ELL will
provide a master list of all students that have been reclassified. This will include data for two years.
2. The monitoring process will include the following steps: a) Each principal and ESL teacher will
receive a copy of the master list for each their assigned school, b)principals will disseminate the
monitor forms found in the procedural handbook to all core academic teachers and guidance counselors
and school adjustment counselors, c) principals and ESL teachers(s) will monitor any forms turned in
by teachers requiring action be taken for FLEP students who are not performing successfully and
identified students will be reevaluated to determine if they are to be reclassified as an ELL student and
then reenter ESL services. ACCESS testing will then resume and then the cycle to determine services
will continue as it does for an ELL student.

Department CPR Finding: Documentation reviewed indicated a multi-year plan for Sheltered
English Immersion (SEI) Professional Development. The plan included information on SEI training
only for school year 2011-12. Also, the district reported that some content area teachers have been
trained in some of the SEI categories; however, no teacher has completed the required SEI
categories. Therefore, ELLs are not receiving instruction from qualified content area teacher as
required by Chapter 71A

Department CPR Finding: A review of student records indicated that required information and
documentation was not consistently evident. The records did not always include the following: the
home language survey, results of identification and proficiency tests and evaluations, progress reports
and report cards, information about the student’s previous school experiences and parent notification
letters. In addition, there was no information translated into the parent’s native language where
translations were requested by the parent.

1. Records will continue to be maintained for every identified ELL and former ELL student.
These will be housed in both at the school office and in the office of the Director of
Elementary Education.
2. There will be a checklist used to ensure that the following records are included in the files: the
home language survey, results of identification and proficiency tests and evaluations, annual
progress reports and report cards, information about the student’s previous school experiences,
if applicable, and parent notification letters. When translation of documents is requested by
parents, copies of such translations will be in the student files as well.
