Each grade level inclusion teacher will indicate on the monitoring form that a discussion was held at the IEP meeting, an appropriate goal and benchmarks are established, and the service delivery page indicates the time(s) per week for support session(s). The teacher will submit the form to the Director of Special Education for review. The director of special eduction will consult with staff providing the service at least twice during each trimester and document the meeting discussion. Furthermore, pertinent information/interventions/action plans will be discussed with all teachers at the next weekly consult meetings with the director. Progress reports in student files will give further evidence that the student's skills and proficiencies are being addressed. These will be monitored by special education teachers during monthly reviews and completion of their monitoring forms. The policy does not include information regarding the use of a 45-day placement in an interim alternate educational setting nor does it articulate the district's obligation to provide services for students with disabilities who have been suspended for more than 10 consecutive or cumulative days in order to progress in general education and on the goals and objectives articulated in their IEPs. Description of Corrective Action: An amendment to the 2012-2013 Student Handbook to include the following: Student Discipline The information regarding the use of a 45-day placement as an interim alternative educational setting and obligation to provide services to students with disabilities who have been suspended for more than 10 consecutive days can be found in section 300.530 in the 2006 regs to the IDEA 2004. Special circumstances. School personnel may remove a student to an interim alternative educational setting for not more than 45 school days without regard to whether the behavior is determined to be a manifestation of the child's disability, if the child: (1) Carries a weapon to or possesses a weapon at school, on school premises, or to or at a school function under the jurisdiction of an SEA or an LEA; (2) Knowingly possesses or uses illegal drugs, or sells or solicits the sale of a controlled substance, while at school, on school premises, or at a school function under the jurisdiction of an SEA or an LEA; or (3) Has inflicted serious bodily injury upon another person while at school, on school premises, or at a school function under the jurisdiction of an SEA or an LEA. General: (1) School personnel under this section may remove a child with a disability who violates a code of student conduct from his or her current placement to an appropriate interim alternative educational setting, another setting, or suspension, for not more than 10 consecutive school days (to the extent those alternatives are applied to children without disabilities), and for additional removals of not more than 10 consecutive school days in that same school year for separate incidents of misconduct (as long as those removals do not constitute a change of placement under Sec. 300.536). The charter school will instead use the student’s previous district record information, including MCAS scores to determine whether a student is an English language learner. Narrative Description of Corrective Action: A standardized test of English proficiency in reading and writing (IPT) is administered by the Student Services Coordinator or assigned staff member before the student is scheduled into classes or within two weeks after the student has registered. Proficiency data from standardized assessment in reading, writing, listening and speaking are reviewed by the Student Services Coordinator. Student academic records (if any) are reviewed as well. This data is used to determine whether the student will be placed in a Sheltered English Immersion classroom or in a regular education setting. ELL students that meet the criteria are eligible for any and all support services provided by the Marblehead Community Charter Public School.
