prior to the student's 18th birthday, inform the student and the parent/guardian that all
rights accorded to parents under special education law will transfer from the
parent/guardian to the student upon the student's 18th birthday.
Description of Corrective Action:
The District will mail annually notification to parents and students of parents/guardians at
least one year prior to the student's 18th birthday which will inform students and
parents/guardians that all rights according to parents under special education law will
transfer from the parent/guardian to the student upon the student's 18th birthday.

Record review and interviews indicate that the district does not always provide to the
parent either a proposed IEP and proposed placement or a written explanation of the
finding of no eligibility within 45 school working days after receipt of the parent's written
consent to an initial evaluation or re-evaluation.
Description of Corrective Action:
The District will utilize our internal psychologists as long as the 45-day timeline can be
adhered to. If the internal evaluators are not able to meet this criteria, the District will
utilize consulting evaluators/psychologists to complete evaluations within the 45-day
timeline.
Title/Role(s) of Responsible Persons:

Completion:

Evidence of Completion of the Corrective Action:
A record review of initial referrals and re-evaluations completed in the 2013-2014 school

Basis for Status Decision:
The district's description of their plan to utilize internal psychologists unless they cannot
meet the timeline and then use consulting psychologists to pick up those evaluations does
not explain in sufficient detail how this will be accomplished.
Department Order of Corrective Action:
The district must develop and provide to the Department a detailed procedure outlining
who has direct responsibility at each level and school for recognizing when internal
evaluators will likely be unable to meet timelines, triggering the use of consulting
psychologists, and indicate how this need is communicated to administration at the
district level in order to ensure that a meeting takes place within 45 school working days
after receipt of the parent's written consent to an initial evaluation or re-evaluation.
The district must provide evidence of training for responsible personnel including agenda,
materials used and signed attendance logs.
The district must also provide a description of a comprehensive monitoring plan including
the names and roles of responsible personnel.

Disapproved
Basis for Partial Approval or Disapproval: The district described a procedure to improve
communication and documentation of such communication with parents of ELL students, but did not
outline a procedure for ensuring that parents receive the Parental Notification Letter annually, in a
language they understand, or a description of the procedure for ensuring that students receive ELE
progress reports in the same manner, and with the same frequency, as general education reporting.
Department Order of Corrective Action: In addition to the plan proposed by the district, outline a
procedure for ensuring that parents receive the Parental Notification Letter annually, in a language they
understand, or a description of the procedure for ensuring that students receive ELE progress reports in
the same manner, and with the same frequency, as general education reporting.
Required Elements of Progress Report(s): Provide a description of the newly developed procedures
for communication for ELL teachers, including documenting and filing correspondence. Provide a
description of the newly developed procedures for ensuring that the Parent Notification Form is sent
out initially, and annually thereafter, in a language the parents will understand along with a description
of the procedure for ensuring that students receive ELE progress reports in the same manner, and with
the same frequency, as general education reporting, along with evidence (including agenda and
attendance log) of the workshop held for ELL teachers in June of 2014, by September 30, 2014.

Parent Notification
Department CPR Finding: Document reviews, interview and student record review indicated that
The Parental Notification Letter does not consistently contain all the required elements, was not
provided to parents annually, as required, and was not consistently translated when requested by the
parent. Additionally, record reviews indicated that parents of ELL students are not consistently
provided with progress reports in the same manner, and with the same frequency, as general education
reporting and such reports are not consistently written in a language understandable to the
Parent/Guardian, when requested.
Narrative Description of Corrective Action: The District has adopted the Parent Notification Form
as recommended in the “Transitional Guidance on Identification, Assessment, Placement and
Reclassification of ELL’s”. The form has been translated into the top-three languages and will be
translated into any native language upon request. The District will begin using these forms in
September of 2014. A teacher training will be held in June of 2014 indicating the procedures for
parent notification.

Basis for Partial Approval or Disapproval: The district describes an appropriate plan for ensuring
that the parent notification form is sent out to parents initially, and annually thereafter, in a language
the parents will understand, but does not indicate how it plans to address the issue of providing students
and parents with progress reports in the same manner, and with the same frequency, as general
education reporting.
Department Order of Corrective Action: In addition to the plan proposed by the district, submit
plans to address the issue of providing students and parents with progress reports in the same manner,
and with the same frequency, as general education reporting.

Equal Access to Academic Programs and Services
Department CPR Finding: Document reviews, interviews, and student record reviews indicated
that, while the district does not segregate ELL students and ensures such students are
provided support in non-core academic courses; have the opportunity to receive support
services, such as guidance and counseling, in a language that the student understands; are
taught to the same academic standards and curriculum as all students; are provided the same
opportunities to master such standards as other students and have access to the full range of
programs; are given grade appropriate content objectives taught by qualified staff members;
and are given access to the full range of academic opportunities and supports afforded nonELL students, information in notices such as activities, responsibilities, and academic
standards provided to all students is not consistently provided to ELL students in a language
and mode of communication that they understand.
Narrative Description of Corrective Action: Documents offering guidance counseling, social
emotional counseling, information regarding course selection, extra-curricular academic experiences,
scholarship information, have been made available in the top-three non-native languages and
information regarding additional translation has been posted in all guidance offices.
