Student record review and interviews indicated that when a student suspected of having a
specific learning disability is evaluated, the district does not consistently create a written
determination as to whether or not the student has a specific learning disability, which is
signed by all members of the Team, or document any disagreement as to the
determination by having those members of the Team in disagreement sign to that effect.
Description of Corrective Action:
L. Loomis met with Principal Yagodzinski on 9/16/13 to discuss the need to complete SLD
forms. Principal will now comply with all SLD forms moving forward.

The Director of Special Education met with the principal to review the need to complete
SLD forms. Copies of the materials provided to the principal and a description of the
procedure that was shared with the principal should be provided to the Department.

internal monitoring of student records is required.

with copies of any materials used by November 22, 2013.

Interviews and document reviews indicated that although the district conducts at least
one workshop annually within the district on the rights of students and their parents and
guardians under state and federal special education laws, and holds additional meetings
with the aim of establishing a Parent Advisory Council (PAC), the district has been unable
to establish a working PAC with officers and bylaws.

Document review and interviews indicated that the district's procedures for the discipline
of students with disabilities do not contain all of the required elements. Missing are: the
requirement to convene within 10 days of the decision to suspend when suspension
constitutes a change in placement; the requirement that if the Team determines that the
behavior is a manifestation of the disability, the student returns to the original placement
unless the parents and district agree otherwise; and the district's right to place the
student in an interim alternative educational setting (as determined by the Team) for up
to 45 school days on its own authority if the behavior involves weapons or illegal drugs or
the infliction of serious bodily injury on another person, or on the authority of a hearing
officer on evidence that the student is "substantially likely" to injure him/herself or others.

Document review and interviews indicated that the district has a code of conduct for
students and teachers. While the district has a non-discrimination policy that does
reference M.G.L. c. 76, s. 5, affirms the district's non-tolerance for discrimination, and
contains a complete list of the required protected categories, it does not confirm the
district's non-tolerance of harassment for all protected categories.

Document review and interviews indicated that although teachers had an awareness of
the need to review materials for simplistic and demeaning generalizations, lacking
intellectual merit, on the basis of the protected categories, and district leaders stated that
a new, appropriate policy has been developed, none of the teachers interviewed were
aware of the newly developed district policy and therefore were not implementing the
policy in any systematic way.
Description of Corrective Action:
L. Loomis met with principal Yagodzinski to craft training for 9/18/2013. Teachers will be
asked to sign PD sign in sheet that they have heard and understand the curriculum review
requirements.
