curriculum or related services is not being modified or discussed; or (b) the district and
the parent do not always agree, in writing, to excuse a required Team member´s
participation and the excused member does not provide written input into the
development of the IEP to the parent and the IEP Team prior to the meeting.
Documentation indicates that the district has developed a form contrary to regulatory
requirements that seeks a parent's written consent to excuse a required Team member,
when the member's area of the curriculum or related services are being modified and
discussed, without the excused Team member needing to submit written input into the
development of the IEP.
Description of Corrective Action:
The Director of Pupil Personnel has met with a group of administrators to develop
appropriate excusal forms. This workgroup of Assistant Principals/Team Chairs and SPED
Department Heads meets biweekly. The Coordinated Program Review and now the CAP
are areas of ongoing discussion and training in this venue. Training will be provided to
the district Team Chairpersons regarding the use of an appropriate excusal form including
written parental consent to excuse a team member, and the requirement pertaining to
written input on the part of the excused team member.

Description of Internal Monitoring Procedures:
Director of Pupil Personnel Services will be responsible for conducting 3 on-site record
reviews per school year. Each building in the district will be included in the review, during
which 6 files will be reviewed per building, with a mix of annual reviews, initial evaluations
and 3 year evaluations. A form will be developed that will include a checklist for each
area cited in this case that would include a check for excusal forms when a team member
is absent from a meeting. In addition to the checklist, a narrative will be written including
a summary of the findings. The development of the new excusal forms included input
from the team chairs and SPED Dept. Heads. As a result of the Coordinated Program
Review process, the PPS Director has already implemented this on-site monitoring
process. Visits were made to each building over the past several months, and summaries
were written. The next step is to develop a monitoring form for these visits.

principals/team chairpersons to review this finding and to brainstorm about ways to
improve in this area. We will make a concerted effort to schedule meetings with enough
time to reschedule within the 45 day timeline in the event that a parent cancels at the last
minute, which is often the root cause of this issue. Training has and will be provided to
this administrative group, with building based follow-up visits as described later in the
Internal Monitoring Process section.

Description of Corrective Action:
The Director of Pupil Personnel Services has provided training to the Assistant Principals,
Team Chairs and SPED Department Heads regarding this finding. She will continue to
provide oversight and training. As a result of working with this focus group, it was
determined that the root cause of the problem might have involved a misunderstanding
on the part of the team chair about moving the date of an annual review meeting to
match the date of a 3 year re-evaluation meeting. That misunderstanding has been
cleared up. The Director of Pupil Personnel Services will conduct on-site file reviews 3
times per year in each building in order to monitor compliance.

Interviews and observations indicate that there is one class at the Morse Pond School that
has 17 students with disabilities with one teacher and one aide.
Description of Corrective Action:
The Director of Pupil Personnel Services will implement an on-site review at the Morse
Pond School, by visiting the classroom that had 17 students in it at the time of the DESE
visit. She will also review schedules for the students and rosters for the classroom to
ensure compliance. Training has already been provided for the administrator responsible
for these programs at the Morse Pond School. Visits will take place 3 times per year to
monitor compliance.

Department CPR Finding: The Falmouth Public School district has a low incidence of English
language learners (ELLs). About half of all ELLs are enrolled in the early grades (Pre-K-4th) and
reported in ESE’s District Analysis, Review and Assistance Tools (DART) followed by a smaller
number of ELLs enrolled in middle school and an even smaller group enrolled in high school.
Sheltered English Immersion (SEI) programming includes Pull-out for ESL instruction one-on-one or
in smalls groups for students in the Massachusetts English Proficiency Assessment (MEPA) levels 1
and 2 and mostly Push-in for student in levels 3-5.
The district reported that ESL/ELD instruction is based on the Massachusetts Curriculum Frameworks
and the English Language Proficiency Benchmarks (ELPBO). The ESL teacher uses teacher designed
materials and the “Reading Street” series for a reading program, which according to the district,
includes materials for ELLs. However, no ESL curriculum was submitted to demonstrate how
materials used align with the ELPBO. Refer to letter attached for major changes at the Department
that will affect your proposed Corrective Action Plan, including the ESL curriculum. Also refer to
“Update on RETELL for Monitoring Purposes,” at: http://www.doe.mass.edu/retell/. Additional
information from the Department will be forthcoming.
District documented procedures indicated appropriate hours of ESL instruction for each MEPA level
of English proficiency; in practice, as noted in student schedules and other documents, however, the
hours of ESL instruction provided at all levels of the students’ English proficiency do not meet
Department guidelines. (See pg. 5 http://www.doe.mass.edu/mcas/mepa/guidance.html). Currently,
ELE students in the district assessed at MEPA levels 1-2 receive 40-60 minutes a day of ESL
instruction followed by those in level 3 and 4 who receive similar hours of instruction, but with
diminished frequency during the week. Students in levels 4 and 5 in the higher grades receive less
hours of ESL instruction or none at all. Unless ELE students at these MEPA levels have met the
criteria for exiting the ESL program, they must be provided with ESL instruction that is in accord to
Department guidelines.

In sum, the district has not developed an ESL curriculum, ELLs in the district are not receiving direct
hours of ESL instruction that are consistent with Department guidelines, and content area teachers
instructing ELLs have completed one out of four SEI professional development trainings.
Consequently, the Department concludes that the district does not have an ELE program that is
consistent with Chapter 71A.

Narrative Description of Corrective Action:
1. Curriculum: ELE teachers will develop a K-12 ELD curriculum map that aligns with the
Common Core State Standards and the WIDA standards. Curriculum development will
include the newly purchased National Geographic materials as recommended in the 2011
program review: Reach grades K-5; Inside grades 6-8; and Edge grades 9-12. These resources
are a core Reading/Language Arts/ELD program that is aligned with both the Common Core
and WIDA standards. ELE teachers are building a working group to include educators from
surrounding districts to collaborate on curriculum development. ELE teachers have been
accessing the WIDA, MATSOL, and Center for English Language Education websites to stay
informed about timelines and training opportunities relative to WIDA and ACCESS. ELE
teachers will provide training to content area specialists to ensure all educators understand the
transition to WIDA and the connections to the Common Core.
2. Hours of ESL Instruction: This district understands the importance of adhering to the
recommendation of the Department regarding service level to effectively service each student.
The team will take appropriate steps to more closely align service level with the Department’s
recommendations.
A district ELE Team will be created and comprised of the Director of Pupil Personnel
and all ELL teachers. The work of this committee will include the review of the
current direct ELD service hours provided to ELL students across all proficiency
levels. Given the new WIDA standards, the Team will evaluate and design the best
strategy to increase the hours of instruction to more closely align with the
Department’s recommendation during the 2013-2014 academic year.
3. SEI PD: The Falmouth Public Schools is a Cohort 2 district and began the planning for the
implementation of the SEI endorsement in the spring of 2012-2013 academic year. Falmouth
educators and administrators were informed of the RETELL initiative while district
administrators created and received (July 2013) the approval from the state for the
implementation plan. At this time, many of the targeted academic content teachers have
registered for the SEI endorsement course offered by the Falmouth Public Schools.
ELE teachers have attended WIDA standard and the curriculum mapping across the content
area trainings offered by the state in the Spring 2013. ELE teachers will continue to receive
professional development throughout the 2013-2014 academic year around both WIDA and
Common Core Standards and the implementation of the purchased National Geographic
curriculum.

1. The Falmouth Public Schools is implementing an SEI Endorsement Plan according to the
DESE Implementation Guide. The district implementation plan was approved by DESE in
July 2013. The intention of the plan is to increase proficiency of all staff in sheltering English

curriculum as their English speaking peers. Falmouth has an SEI Endorsement Instructor who

Department CPR Finding: Despite the district’s plan to train high numbers of teachers in SEI since
school year 2006-07, district documentation indicated that only Category 1 had been completed by
some content area teachers as follows: the middle school had 2-3 teachers trained per school; the high
school had 1-2 teachers per school trained, but none in Social Studies, and finally, the elementary
schools have one teacher per elementary school trained, except for one school that had two teachers
trained, and another where no teachers had been trained. The district’s SEI professional development
plan must incorporate the upcoming professional development changes as stipulated by the RETELL

Narrative Description of Corrective Action:
1. The district created a plan for implementation of the RETELL initiative that includes a
continuous monitoring of the RETELL website to remain current with information regarding
the training and the SEI endorsement. As previously mentioned in ELE 11, the district has an
approved plan in place for educators to enroll in SEI courses based on eligibility criteria set
forth by the Department. Targeted educators will have ELLs in their classrooms with
opportunities to practice SEI strategies with ELLs between course sessions. The district is
fortunate to have employed an educator who will teach the SEI course and be available to all
staff for consultation and guidance. Principals will be updated with new information on the
RETELL initiative as it becomes available and be kept abreast of progress as educators go
through SEI training.
