The student record review and interviews with staff members indicated that the Team
does not always consider and specifically address in the IEP the skills and proficiencies
needed to avoid and respond to bullying, harassment or teasing when the student has a
disability that affects social skills development.
Description of Corrective Action:
*BCHMCPS is implementing the Positive Behavior Intervention System (PBIS) schoolwide.
Students are taught to be safe, respectful and responsible in all areas of the school
including the lunchroom and playground.
*All School Community Meetings are held monthly and PBIS expectations are emphasized
during each program.
*Classroom teachers integrate Responsive Classroom strategies daily during Morning
Meeting Time.
*The School Leader, Adjustment Counselor and Behavior Prevention Specialist visit
classsrooms to talk about the PBIS expectations and how to respond to bullying,
harassment or teasing.
*The Adjustment Counselor leads "Lunch Bunch" groups weekly focusing on the
development of social skills which are based on the needs of the children.
*IEPs will address when a child is vulnerable to bullying, harassment, or teasing by
discussing the strategies and writing in accommodations that will assist the child (check
in and check out, transitions between scheduled activities, providing alternate recess,
support during specialists, etc.)

There will be an option on the IEP Meeting Checklist (Sped Form #38) to check off that
social skills and proficiences needed to avoid and respond to bullying, harassment or
teasing have been discussed. If further action is needed by the team, they will note it on
the IEP.
Description of Internal Monitoring Procedures:
This option will be added to the IEP checklist which is submitted with each IEP to insure
that all sections have been completed.

The district has proposed procedures to document when the IEP Team considers and
specifically addresses the skills and proficiencies needed to avoid and respond to bullying,

development. The district did not propose staff training on these procedures. The
internal monitoring process did not include a sampling of records to ensure that when a
student has a disability that affects social skills development, the IEP addresses the skills
and proficiencies needed to avoid and respond to bullying, harassment, or teasing.

Department Order of Corrective Action:
Train staff on the procedures that have been developed to ensure that the IEP Teams
consider and specifically address the skills and proficiencies needed to avoid and respond
to bullying, harassment or teasing when the student has a disability that affects social
skills development. The district must include a student record review in the internal
monitoring procedures.
Required Elements of Progress Report(s):
By March 1, 2013 submit the following as evidence of training on the requirement that
Teams always consider and specifically address the skills and proficiencies needed to
avoid and respond to bullying, harassment or teasing when the student has a disability
that affects social skills development: (1) agenda; (2) signed attendance sheet(s)
indicating the role of staff; (3) training materials; (4) date of training. In addition, for the
student name provided to the district as being in non-compliance during the record
review, provide a copy of the updated IEP.
By June 3, 2013 submit a summary report of the internal monitoring of students who
have a disability that affects social skill development and who have had a Team meeting
subsequent to the implementation of corrective actions. Include the following: (1) the
number of records reviewed, (2) rate of compliance, (3) description of root cause(s) of
any non-compliance, (4) and the specific actions taken to remedy any identified noncompliance.
Please note when conducting internal monitoring the district must maintain the following
documentation and make it available to the Department upon request: list of student
names and grade levels for the records reviewed, date of the review, name(s) of
person(s) who conducted the review with roles and signatures.

Interviews indicated that the parent advisory council (PAC) for special education does not
advise the district on matters that pertain to the education and safety of students with
disabilities nor do they participate in the planning, development, and evaluation of the
district's special education programs.
Description of Corrective Action:
*The School Leader will work with the Barnstable Public Schools (BPS) Superintendent
and Director of Special Education to identify parents of students with disabilities to
determine interest in assuming a leadership role in the SEPAC. In the meantime, five
activities/meetings/speakers have been scheduled for FY'13 for parents of students with
disabilities.
*Barnstable Community Horace Mann Charter Public School (BCHMCPS) will publish the
2012-2013 Special Education Parent Advisory Council (SEPAC) Meeting Schedule on our
website, in the Principal's Newsletter and the Principal's Monthly Calendar.
*SEPAC Meeting information will be distributed at Back School Evenings, Theme Night and
during Enrollment Open Houses in January each year.
*The School Leader/Principal will discuss SEPAC activities at the Principal's Monthly Coffee
Hour.
*The entry way television will include the SEPAC Meeting information and schedule.
*Copies of the SEPAC schedule are available in the Main Office.
*Each teacher will include a copy of the SEPAC Annual Schedule in their welcome back
packet.
*The 2012-2013 SEPAC Meeting Schedule will be given to each family at IEP Team
Meetings.

The district must develop a plan to allow members of the SEPAC to participate in the

A review of the documentation showed that the student handbook does not indicate that
in instances when the charter school had knowledge that the student may be a student
with a disability prior to the disciplinary action, the charter school makes all protections
available to the student until and unless he or she is subsequently determined not to be
eligible.
Description of Corrective Action:
*The School Leader will change the heading "Disciplining Students with Disabilities" on
page 22 of the Student Handbook to "Disciplining Students with Disabilities and/or
Suspected Disabilities" under the Heading "Discipline Codes" (pg. 16).
*The Barnstable Public School District Handbook insert of legal requirements, which is
added to the BCHMCPS Handbook, was updated with this infromation for this school
year's handbooks (FY'13).
*The BCHMCPS Student Handbook is reviewed with School Staff on Opening Day each
year.

Department CPR Findings:
Onsite observations demonstrated that the charter school contains a shared space used
for special education small group instruction and reading that is not sufficient in size for
the number of students and adults using the space. Specifically, the classroom is divided
in two with partitions and while the reading specialist and her assistant are working in one
area, as many as one special education teacher and two special education
paraprofessionals may be working with students on the other side of the divided room.
The noise level in the room creates a learning environment that leads to student
distractibility.
Description of Corrective Action:
*Barnstable Community Horace Mann Charter Public School (BCHMCPS) provides facilites
and classrooms for eligible studentes that promote inclusion.
*The school will review space and provide an equal Special Education classroom in all
physical respects to the average standards of general education facilites and classrooms.
*BCHMCPS will reassign reading and/or Special Education classrooms.
