Interviews and documentation show that when the student chooses to share decisionmaking, the choice is not always made in the presence of the Team. When students
choose to delegate decision-making, it is not always in the presence of a district
representative and one other witness. Some students are making the age-of-majority
choice prior to their eighteenth birthday.
Description of Corrective Action:
A series of meetings have been held to review the regulation and staff obligations. On
November 20, 2009, immediately following the CPR exit meeting, a TEAM Chairperson
meeting was conducted to review the finding of partial implementation regarding AHS
students in and out of district. On December 11, 2009, at a second meeting with TEAM
Chairpersons, the regulation was reviewed for a second time to insure that the TEAM
Chairpersons/Out of District Coordinators understood their obligation that shared decision
making must be agreed to at a team meeting. At a Special Education Department
meeting at AHS on February 25, 2010, the regulation was reviewed with the entire
Special Education Department to ensure regulatory understanding by all Ashland High
School liaisons and the Team Chairperson.
Anticipated Results:
No student will be requested to make the age of majority choice prior to their 18th
birthday. Any student who chooses to share decision-making, the choice will be made in
a Team meeting setting. When students choose to delegate decision-making, it will be in
the presence of a district representative and one other witness.

education classroom, is isolated from other classrooms and does not maximize the

The Ashland Middle School Principal will relocate the special education classroom,
currently Room 11, to Room 208.

Narrative Description of Corrective Action: The 2010-2011AHS Program of Studies has been
revised by AHS administration to reflect the .25 credit annual requirement for each grade level at AHS.
Guidance Counselors will review this requirement will all students in anticipation of course selection
for the upcoming year and ensure that all students meet this requirement during the course selection
process.

Department CPR Finding: Sheltered English immersion (SEI) is a program model for limited English
proficient (LEP) students composed of two parts—English as a second language (ESL) and sheltered
content instruction. ESL is explicit, direct instruction about the English language, delivered to LEP
students only and designed to promote the English language development of LEP students. Sheltered
content instruction is an approach for teaching content to LEP students in strategic ways that make the
subject matter concepts comprehensible while promoting the LEP students’ English language
development.
A review of district documents shows that the district does currently have an ESL curriculum based on
the Massachusetts English Language Proficiency Benchmarks and Outcomes.
For students who do receive direct ESL instruction, documentation indicates amounts of ESL
instruction below recommended hours as outlined in the Department’s September 2009 guidance
document: “Guidance on Using MEPA Results to Plan Sheltered English Immersion (SEI) Instruction
and Make Reclassification Decisions for Limited English Proficient (LEP) Students." For example,
Beginners at most every grade level receives approximately one hour per day of direct ESL instead of
the recommended amount of 2.5 hours per day.
Content instruction is based on the appropriate Massachusetts Curriculum Framework; however, it is
clear that LEP students do not receive sheltered content instruction as no teachers have completed all
of the required categories of SEI professional development focused on the skills and knowledge
necessary for sheltering instruction, described in the Commissioner’s Memorandum of June 2004 (see
findings ELE 15). Several teachers within the district have completed Category 1 training, and some
have completed Category 2 as well.
Narrative Description of Corrective Action: 1. Professional Development in Categories 2, 3 and 4
will be provided in district according to the following schedule: Category 2- Four Saturdays Fall 2010,
Category 3 Three opportunities for 1.5 days Spring 2010, Summer 2010, Fall 2010, Category 4
Training will be contracted with ACCEPT Collaborative to provide district Category 4 training for 1520 hours on the full day professional development day in November 2010 and on three early release
afternoon trainings. To date 84 staff members have attended Category 1 training, 21 teachers have
attended Category 2 and 5 have attended Category 3.

Department CPR Finding: Ashland Public Schools submitted a draft of a multi-year strategic plan
for offering Sheltered English Immersion Professional Development (SEI PD) to teachers who provide
content instruction to LEP students in the district. However, there was no specific indication that
Categories 3 and 4 would be offered to teachers, and currently no teachers in the district have
completed these trainings.
Content instruction is based on the appropriate Massachusetts Curriculum Framework; however, it is
clear that LEP students do not receive sheltered content instruction as no teachers have completed all
