The Bidder hereby proposes and agrees to furnish all the necessary labor, materials,
equipment, tools and services necessary for the construction of the project listed above all in
accordance with the Drawings, Specifications and other Contract Documents for the

ACKNOWLEDGEMENTS
3.1 The undersigned understands and agrees that the Contract will be awarded to Bidder
submitting the lowest bid who, in the opinion of the Owner is qualified to perform the Work
and is responsible and responsive and that the Owner, reserves the right to reject any
Proposal or all Proposals or any portions thereof.

3.3 The undersigned understands and agrees that if written Notice of Award of the Contract
is delivered to it within forty-five days after the date of opening of Proposals, during which
period Bidder agrees Bid may not be withdrawn, it will
execute the Agreement contained in the Bidding Documents and deliver the same together
with, the Performance Bond and Labor and Material Bond, if required, and certificate or
certificates of insurance within the time period required by the Owner.
3.4 The undersigned understands and agrees that the Work shall be completed within * 4 *
consecutive calendar days after receipt of a written Notice to Proceed signed by the Owner.
3.5 The Bidder agrees that if certain materials (in specifications) shall be bid separately at a
later date that the Bidder is responsible for coordination of its installers.

5.
SUBSTITUTIONS
5.1 The Bidder may offer substitutions for any item noted in the Specifications by listing in
the blanks on Schedule A the name of the substituted item, the manufacturer, the model
name or number, etc., together with the amount to be added or deducted from the Base Bid
if the substitution is approved. The right is reserved to accept or reject any proposed
substitution. All substitutions will be given consideration. See the "Instructions to
Bidders".
5.2 The amount stated shall include any modifications of work or additional work that may
be required by reason of acceptance of the substitution. Substituted materials listed on
Schedule A attached hereto must be checked and approved by the Owner before same may
be used in lieu of those named in the specifications.

6.
SMALL/MINORITY/WOMEN-OWNED BUSINESS ENTERPRISES
The Bidder agrees to make positive efforts to utilize small business an minority/women
owned business sources of supplies and services for the work. The bidder agrees to use its
best efforts to give small and minority-owned business the maximum practicable
opportunity to participate in any subcontracts it may award and shall submit to the Owner a
list of all Subcontractors proposed for the work which shall indicate whether any of such
Subcontractors are small businesses or minority/women-owned businesses. The Bidder
agrees to use the Subcontractors on such list for the work unless others are approved by the
Owner.
