The models and data posted by Transmission Provider and contained within the
Webroom reflect the dynamic nature of the Transmission Provider’s Transmission
System and are modified on a periodic basis. Transmission Provider makes no warranty
or representation whatsoever regarding the accuracy, completeness, or usefulness of any
model, any data contained therein, or any data or conclusions resulting therefrom as
determined by any user of the model and data. Transmission Provider expressly
disclaims any and all warranties, whether expressed or implied, including, but not limited
to, implied warranties of merchantability and fitness for a particular purpose.
Transmission Provider’s provision of any model and data shall not be construed as
confirming or endorsing the suitability of any conclusions resulting from the model or
data with respect to interconnection to Transmission Provider’s facilities or to
transmission delivery service, or as any warranty of the reliability or efficacy of the
model and data for any use or purpose other than strictly for informational purposes. The
users of any model and data agree that Transmission Provider will not be liable to such
users or any third party for any damages of any kind arising out of, related to, or
otherwise resulting from the use of the model and data, whether based in tort, contract, or
otherwise, even where Transmission Provider has been advised of such possibility in
advance. The users of any model and data hereby agree to release Transmission Provider
and its affiliated and associated companies, and their respective shareholders, directors,
officers, agents, representatives, employees, servants, and assigns from any and all such
liability. Without limiting the foregoing, the users of any model and data agree that
Transmission Provider shall not be liable in statute, contract, tort (including negligence),
strict liability, or otherwise to such users, its employees, customers, agents,
representatives, affiliated and associated companies, and/or their assigns, for any
incidental or consequential loss or damage whatsoever, including, but not limited to, loss
of profits or revenue, resulting from either use of the model, the data contained therein,
and any data and conclusions resulting therefrom, or from Transmission Provider’s
performance or alleged non-performance of an obligation imposed herein, if any.
The Webroom is for the use of all Stakeholders to the Transmission Provider’s
Transmission Planning Process. Transmission Provider makes no warranty or
representation whatsoever regarding the accuracy, completeness, or usefulness of any
data posted to the Webroom by any third party, including but not limited to model data,
any data contained therein, or any data or conclusions resulting therefrom as determined
by any user of the data. Transmission Provider expressly disclaims any and all
responsibility for insuring the confidentiality or appropriateness of data posted by third
parties, except that Transmission Provider shall be responsible for maintaining a
restricted access section of the Webroom for the posting of Confidential Information,
access to which shall be restricted to those individuals that have executed confidentiality
agreements as provided for in Section 6.1.1 of Attachment K to Transmission Provider’s
Open Access Transmission Tariff.
