T h i s i s s u e of t h e P u b l i c S e c t o r i n c l u d e s a
special f o r m to deal with what the P r e s i d e n t
c a l l e d , " t h e i n t o l e r a b l e p r a c t i c e of
" r e e v a l u a t i n g " an employee without just
cause."
C S E A h a s r e c e i v e d r e p o r t s t h a t in s o m e instances employees w e r e issued written, signed
evaluations which w e r e subsequently recalled
a n d d o w n g r a d e d . In s o m e c a s e s , a s e c o n d
evaluation f o r m was issued and an employee was
i n s t r u c t e d to " d i s r e g a r d t h e f i r s t e v a l u a t i o n . " In
t h o s e c a s e s , C S E A is a s k i n g t h e e m p l o y e e s to fill
o u t t h e f o r m on p a g e 11 of t h i s i s s u e of T h e
P u b l i c S e c t o r a n d s e n d it to union h e a d q u a r t e r s
to b e i n c l u d e d in a n a c t i o n to b e t a k e n a g a i n s t t h e
G o v e r n o r ' s O f f i c e of E m p l o y e e R e l a t i o n s . \
" T h i s f o r m will h e l p u s d e a l w i t h t h o s e s p e c i a l
cases where an ignorant administrator has
d e c i d e d t o c h a n g e t h e s y s t e m to m e e t his o r h e r
own n e e d s , " P r e s i d e n t McGowan said. " I n other
cases where an employee feels their rights have
b e e n v i o l a t e d , t h e y should c o n t a c t t h e l o c a l
CSEA officials and file an appeal through the
a p p e a l s p r o c e d u r e w e n e g o t i a t e d into t h e s y s t e m
to d e a l w i t h j u s t t h e s e t y p e s of p r o b l e m s . "
T h e union l e a d e r b l a s t e d t h e G o v e r n o r ' s Off i c e of E m p l o y e e R e l a t i o n s a n d i t s D i r e c t o r ,
M e y e r S. F r u c h e r , f o r f a i l u r e to p r o p e r l y a d m i n i s t e r t h e s y s t e m a n d f a i l u r e to p r o v i d e a d e quate training for the manager.
" W e a g r e e d to this s y s t e m conceptually
b e c a u s e it p r o v i d e d a w a y t o a c c e l e r a t e inc r e m e n t s f o r o u r m e m b e r s in t h e s e u n i t s a s w e l l
as a w a y to get around the w a g e and price
g u i d e l i n e s a n d b r i n g $300 b o n u s e s t o s o m e 16,000
e m p l o y e e s w h o w e r e o t h e r w i s e i n e l i g i b l e to
receive anything but annual salary i n c r e a s e s , "
Mr. McGowan said.
" W e still t h i n k it is a good c o n c e p t a n d I ' m
s u r e m a n y of o u r m e m b e r s will a g r e e n e x t
m o n t h w h e n t h e c h e c k s s t a r t g o i n g o u t f o r inc r e m e n t s a n d b o n u s e s , b u t e v e r y o n e could h a v e
b e e n h a p p y if t h e s t a t e had done w h a t it w a s supp o s e d t o do a n d p r o p e r l y i n i t i a t e t h i s s y s t e m . I t ' s
failures have hurt employee morale and created
an additional burden for the appeals p r o c e d u r e , "
he said.
" W h a t w e n e g o t i a t e d in c o n c e p t w a s a f a i r a n d
o p e n s y s t e m of e v a l u a t i o n s w h e r e t h e i n e v i t a b l e
p r o b l e m s could b e e q u i t a b l y r e s o l v e d a n d o u r
p e o p l e could g e t t h e i r i n c r e m e n t s f a s t e r a n d g e t
a n n u a l a w a r d s t h e y could n e v e r g e t b e f o r e , "
P r e s i d e n t M c G o w a n said. " I intend to see to it
t h a t t h e s t a t e lives up to t h e l e t t e r o f ' t h i s
a g r e e m e n t and that these problems and abuses
are resolved."
McGowan asks governor

In a l e t t e r to t h e G o v e r n o r l a s t w e e k , M r .
McGowan wrote, " I cannot believe that this type
of f e a r m o n g e r i n g on t h e p a r t of t h e C o m m i s s i o n e r ( D r . J a m e s P r e v o s t ) c a n b e considered anything other than irresponsible, and I
k n o w of no c o n s t r u c t i v e p u r p o s e w h i c h it c a n
serve."

r e p o r t s v a r y f r o m two facilities to eight.
No information h a s been given identifying

CSEA during a special Delegates meeting at the
1979 C S E A C o n v e n t i o n — h a s n e v e r b r o a c h e d t h e
s u b j e c t w i t h t h e union.
In a d i r e c t l e t t e r to P r e v o s t , P r e s i d e n t
M c G o w a n w r o t e , " I f y o u in f a c t a r e in
p o s s e s s i o n of a n y i n f o r m a t i o n o r k n o w l e d g e t h a t
any facilities m a y be contracted or t e r m i n a t e d , I
i m m e d i a t e l y c a l l upon you to c o m p l y w i t h
S e c t i o n 7.21 of t h e M e n t a l H y g i e n e L a w of t h e
S t a t e of N e w Y o r k a n d d i s s e m i n a t e a n d p o s t t h a t
i n f o r m a t i o n . I f , in f a c t , a c t u a l p l a n s f o r t h e
c l o s u r e s of s u c h f a c i l i t i e s a r e n o t c u r r e n t l y und e r c o n s i d e r a t i o n , I i n s i s t t h a t you publicly so
state and explain your recent actions."
T h e C S E A l e a d e r told P r e v o s t h i s r u m o r s of
closings w e r e creating a m o n g the employees,
" a n a t m o s p h e r e of f e a r a n d d i s c o n t e n t . "
M r . M c G o w a n a s k e d G o v . C a r e y f o r a n exp l a n a t i o n of t h e j o b a t t r i t i o n " p l a n " l e a k e d to t h e
press last week. He noted that news reports said
c u t s would b e m a d e in t h e O f f i c e s of M e n t a l
H e a l t h a n d M e n t a l R e t a r d a t i o n w h i c h could
v i o l a t e t h e p r o v i s i o n s of t h e M o r g a d o M e m o r a n dum, an a g r e e m e n t between the state and CSEA
p r o v i d i n g f o r p r o t e c t i o n of e m p l o y e e s in M H a n d
MR facilities and establishing m i n i m u m staffing
ratios.
T h e union p r e s i d e n t s a i d h e w a s " a p p a l l e d " t o
read that state Transportation Commissioner
W i l l i a m H e n n e s s e y told t h e m e d i a h e could
" t a k e u p s l a c k " c a u s e d by t h e c u t s in h i s
D e p a r t m e n t by h i r i n g c o n s u l t a n t s .
" I do n o t b e l i e v e t h a t t h e c u r r e n t a t m o s p h e r e
w h i c h is b u i l d i n g in o u r w o r k f o r c e c a n b e allowed t o c o n t i n u e t o f e s t e r in t h e f a c e of w h a t c a n
only b e t e r m e d t h r e a t s , " P r e s i d e n t M c G o w a n
told t h e G o v e r n o r , " a n d I u r g e n t l y r e q u e s t a
m e e t i n g to a d d r e s s t h e p r o b l e m s w h i c h a r e
currently facing us."

The pending grievances seek

against her.
Moxley says the personal safety
condition a r e d e f i c i e n t f o r m a n y
reasons, including inadequate
s t a f f i n g f o r t h e t y p e of c l i e n t a t t h e
facility, inadequate training for the
s t a f f , a n d i m p r o p e r utilization of
m e n t a l h y g i e n e t h e r a p y a i d e s . And,
he added, the f a c t t h e r e a r e a s
m a n y a s 70 g r i e v a n c e s back-logged
i n d i c a t e s a c a l l o u s a t t i t u d e in
general toward workers at the
f a c i l i t y by m a n a g e m e n t .

r e c e n t l y r a t i f i e d by a v o t e of t h e
R o c k l a n d C o u n t y U n i t m e m b e r s h i p of
C S E A L o c a l 844.
Collective Bargaining Specialist
E m a n u e l e Vitale, chief n e g o t i a t o r f o r
the 10-member team, announced the
unit ratification a f t e r m o r e than four
m o n t h s of n e g o t i a t i o n s . T h e p a c t w a s
a p p r o v e d by t h e Rockland C o u n t y ,
L e g i s l a t u r e five dayS later.
A c c o r d i n g t o V i t a l e , t e r m s of t h e
new contract include wage increases
of 7 % e f f e c t i v e J a n u a r y 1, 1980; 7 %
J a n u a r y 1, 1981; a n d 7% J a n u a r y 1,
1981, in a d d i t i o n t o i n c r e m e n t s e a c h
y e a r . An A g e n c y S h o p c l a u s e w i l l
b e c o m e e f f e c t i v e J a n u a r y 1, 1980.
Other negotiated benefits include:

• Labor management committees

benefits occasionally e x c e e d t h e disa b l e d w o r k e r ' s f o r m e r pay. S o c i a l
s e c u r i t y o f f i c i a l s e s t i m a t e t h i s is t r u e in
6 percent of t h e cases.
A n o t h e r p r o v i s i o n o f t h e H o u s e bill
a s s u r e s e q u i v a l e n t b e n e f i t s f o r all d i s a b l e d b e n e f i c i a r i e s , r e g a r d l e s s of t h e i r

worker's average monthly earnings
o v e r a p e r i o d of y e a r s , b u t , in c o m p u t ing t h i s a v e r a g e , c u r r e n t law a l l o w s
d r o p p i n g 5 y e a r s of l o w e s t e a r n i n g s .
The drop-out feature means younger
d i s a b l e d b e n e f i c i a r i e s g e n e r a l l y get
higher benefits than older disabled
beneficiaries because fewer years of
low e a r n i n g s a r e i n c l u d e d in t h e i r b e n e fit c o m p u t a t i o n .
T h e H o u s e bill w o u l d m a k e t h e
n u m b e r of d r o p - o u t y e a r s p r o p o r t i o n a t e to t h e n u m b e r of y e a r s t h e claimant has w o r k e d u n d e r social security.
In a d d i t i o n t o t h e s e t w o f e a t u r e s , t h e
bill i m p r o v e s c e r t a i n b e n e f i t c o n d i t i o n s
in o r d e r t o e n c o u r a g e r e h a b i l i t a t i o n
e f f o r t s by t h o s e s e e k i n g t o g e t b a c k t o
work.
T h e work incentives include:
— e x t e n d i n g t h e c u r r e n t 9 - m o n t h trial
work period and 3 - m o n t h a d j u s t m e n t
period (12 m o n t h s total) to 24 m o n t h s .
B e n e f i t s w o u l d n o t b e paid in t h e s e c ond year, but they would be reinstated
a u t o m a t i c a l l y if t h e d i s a b l e d p e r s o n ' s
a t t e m p t t o w o r k f a i l e d b e c a u s e o f his o r
her impairment.
—allowing a d e d u c t i o n of certain impairment-related work expenses and
a t t e n d a n t c a r e c o s t s in d e t e r m i n i n g
w h e t h e r a p e r s o n is d o i n g s u b s t a n t i a l
gainful work.
— eliminating a s e c o n d 2 4 - m o n t h waiting period for M e d i c a r e c o v e r a g e for a
person who becomes disabled a second
time.

$ 1 7 m i l l i o n in fiscal 1 9 8 0 , $ 3 3 7 m i l l i o n

d e m a n d e d by c o u n t y l e g i s l a t o r s a n d t h e e f f e c t s of
s u c h c u t s on public e m p l o y e e s .
In a j o i n t l e t t e r , W a l t e r D u r k i n , p r e s i d e n t of t h e
C S E A Sullivan C o u n t y L o c a l 853 a n d J a m e s McN u t t , p r e s i d e n t of t h e Sullivan C o u n t y C S E A
D e p u t y S h e r i f f ' s U n i t , e x p r e s s e d t h e i r c o n c e r n s to
the county administrator. The joint letter r e a d s a s
follows:

session clearly illustrated that the proposed

Unfortunately, some legislative proposal a i m e d
at reducing jobs have already caused some
d a m a g e . Proposed layoffs, job eliminations or

"CSEA believes that other strategies can be used
w h i c h will not h a v e a s e v e r e i m p a c t on c o u n t y
e m p l o y e e s . A t t r i t i o n , f o r e x a m p l e , is a l e s s c o s t l y
method than layoffs. This strategy prevents the
e m p l o y e e f r o m l e a v i n g t h e t a x p a y e r rolls to t h e
t a x - f r e e u n e m p l o y m e n t rolls. T h e e l i m i n a t i o n of
only v a c a n t p o s i t i o n s is a l s o l e s s d a m a g i n g .

in p r o p o s e d c o n t r a c t s t u r n i n g o v e r
the city's sewage t r e a t m e n t plant
and parking facilities to private,
outside m a n a g e m e n t .
And w h e n all t h e f a u l t s w e r e out
on t h e t a b l e , t h e c o u n c i l w e n t
ahead and approved the contracts
anyway.
T h e s p e c i a l m e e t i n g of t h e council w a s held s p e c i f i c a l l y to a c t on
the two contracts, Environtech
Corp. for the s e w a g e t r e a t m e n t
plant and the Meyers P a r k i n g

filled all a v a i l a b l e c h a i r s a n d q u i t e
a bit of s t a n d i n g r o o m f o r t h e
meeting that lasted four hours.
Most stayed for the whole meeting.
Why?
F o r m a n y it w a s a m a t t e r of v i t a l
importance — their jobs.
City w o r k e r s r e p r e s e n t e d by
C S E A w a n t e d to l e t t h e c i t y f a t h e r s
know their feelings about the issue
of c o n t r a c t i n g o u t m u n i c i p a l s e r v i c e s to p r i v a t e c o m p a n i e s . S o m e
of t h o s e in a t t e n d a n c e w e r e f r o m
the sewage t r e a t m e n t plant and the
parking facilities that were turned
o v e r t o p r i v a t e b u s i n e s s e s by t h e
council. Others w e r e f r o m a
v a r i e t y of c i t y a g e n c i e s w h o a r e
now w o n d e r i n g h o w s e c u r e t h e i r
c i t y e m p l o y m e n t is.
One m a n , who said he worked for
t h e D e p a r t m e n t of P u b l i c W o r k s ,
said that now t h a t the city has
s t a r t e d on t h i s p a t h , it is n o t o u t of
the
question
that
other
departments, including DPW,
could b e c o n t r a c t e d o u t .
"What about m y pension?" he
a s k e d . " I ' v e g o t s e v e n y e a r s in
w i t h t h e c i t y — w h a t do I do if
someone takes over? Start at the
bottom again?"
T h a t s a m e point w a s r a i s e d by a n
e m p l o y e e of t h e c i t y ' s p a r k i n g
facilities when he asked the council
"What about m e and the others
w h o d o n ' t h a v e 10 y e a r s in w i t h t h e
c i t y ? W h a t h a p p e n s to our
benefits?"
The city a d d r e s s e d the problem
in a l e s s t h a n r e a s s u r i n g m a n n e r by
telling t h e c r o w d t h a t " a l l t h e s e
t h i n g s will h a v e t o b e w o r k e d
out. . . "
More importantly,
several
s p e a k e r s a d d r e s s e d t h e h e a r t of t h e
m a t t e r : c a n p r i v a t e e n t e r p r i s e do a
better job?

sound f i n a n c i a l c o n d i t i o n , a f a c t
that undercut the city's reasoning
in a t t e m p t i n g to c o n t r a c t out city
services.

lawyer and counsel for CSEA,

out, by e x a m p l e , h o w E n v i r o n t e c h
could b e within i t s c o n t r a c t u a l
a g r e e m e n t w i t h t h e c i t y a n d still
fail to m e e t state and federal standards on effluent discharge — with
t h e c i t y liable f o r p e n a l t i e s a n d
f i n e s . H e pointed o u t t h a t a o n e to
t h r e e y e a r i n v e n t o r y of s u p p l i e s a t
t h e s e w a g e p l a n t would b e " h a n d e d
o v e r " to E n v i r o n t e c h
without
c h a r g e a n d w i t h o u t provision f o r
replacement. He cited, among
many other deficiencies, the fact
t h a t t h e c o n t r a c t c o n t a i n e d no
c l a u s e r e f e r r i n g to t h e condition of
plant and equipment to be returned
to t h e c i t y in t h e e v e n t of a c o n t r a c t
c a n c e l l a t i o n , o r a d e c i s i o n not to
renew the contract.

Luposello continued, "They think
t h e y h a v e r e s o l v e d a p r o b l e m , but
in r e a l i t y t h e y ' v e c r e a t e d a lot of
new problems. J u s t wait, they'll
find o u t . "
T h o m a s Mahar, CSEA counsel,
s a i d t h a t while t h e c o n t r a c t s h a v e
b e e n a w a r d e d by t h e council, t h e
b a t t l e is not o v e r .
"This is basically P h a s e 1," he
s a i d . " W e t r i e d t o point o u t to t h e
council a n d t h e p u b l i c t h e d e f i c i e n cies and the p r o b l e m s with this
w h o l e idea of c o n t r a c t i n g o u t . N o w ,

He explained that now that the
c o n t r a c t s have been a w a r d e d , an
improper practice proceeding

angry over the entire situation and

chunky. 54-year-old e m p l o y e e did his

moonlighting a s S a n t a ' s s e c r e t a g e n t ,
c o m p l e t e with b a g of toys.
" I do it b e c a u s e of the k i d s , " explained C a r v e l l i . " S e e i n g the joy on

FISHKILL - Establishment of a
CSEA FAMILY FUND to benefit
the families of three State Transportation Department employees
killed on June 5 when they were
struck by a truck on Interstate 84 at
Newburgh has been announced by
CSEA Region III President James
Lennon, who has also issued an
appeal for all CSEA Locals and
Units statewide to contribute to the
fund.
In commenting on the purpose of
the fund, Mr. Lennon said, "We
want to, reach out and offer some
tangible help to the families of
those men who lost their lives. As
we close out the year, and look
ahead with hope to 1980, we would
like to see every CSEA Local and
Unit in the state contribute to this
worthwhile cause. We are confident
the giant CSEA "family" will
to the poor of his p a r i s h , and he cons i d e r s his role a s Santa Claus a s a
f o r m of d i s c h a r g i n g a r e l i g i o u s
obligation.

who n e e d e d C h r i s t m a s g i f t s .
S a n t a w a s a s s i s t e d by his own
f a m i l y , too. T h e y helped s t o r e a n d
p a c k donations a t t h e i r h o m e . T h e n
C a r v e l l i ' s d a u g h t e r and a f r i e n d ,
a c t i n g a s S a n t a ' s h e l p e r s , would c a r r y
t h e g i f t s to t h e poor. D u r i n g t h e 12
y e a r s , C a r v e l l i e s t i m a t e d he h a s called upon h u n d r e d s of f a m i l i e s , r o u s i n g

In an e f f o r t to cut down on t h e high
n u m b e r of w o r k e r s ' c o m p e n s a t i o n
c l a i m s , the county h a s d i r e c t e d s o m e
200 e m p l o y e e s , who d r i v e t h e i r own or
county c a r s on business, to fill out t h e
detailed q u e s t i o n n a i r e s .
A f t e r being analyzed by t h e c o m p u t e r , the f o r m s will be r e v i e w e d by
Dr. Richard Farrel, a private
physician who is a g r a d u a t e of D u k e
U n i v e r s i t y . He will then call s o m e
e m p l o y e e s in for a consultation.
The employees, meanwhile, a r e
r e f u s i n g to a n s w e r c e r t a i n questions,
a r e a n s w e r i n g s o m e falsely and a r e
withholding their social security
numbers.
CSEA, said C a m p b e l l , is not totally
a d v e r s e to the c o m p u t e r i z e d f o r m s
and plans to suggest the p r o c e s s i n g be
done by a local f i r m with which t h e
e m p l o y e e s will feel m o r e s e c u r e .
Dr. Farrell has admitted that the
s y s t e m is not infallible, but s a y s h e
f e e l s confident with it.

Stressing importance of communications

Stressing the need for open lines of communication between Local leaders throughout the
state and the union's statewide headquarters in
Albany, CSEA President William L. McGowan is continuing his series of fact finding meetings with local
union officials within CSEA's six regional operations.
Within the past few days, McGowan conducted informal meetings with Local presidents and other union
officials in CSEA Regions I, II and IV. Previously he
conducted similar sessions with Local officials in
Regions III and V.
