ALBANY — The first day c a r e c e n t e r p r i m a r i l y for s t a t e
w o r k e r s was dedicated last week in Albany, the result of y e a r s
of negotiating by CSE A with the State. The Plaza Day C a r e
Center was dedicated in the E m p i r e State Plaza, the huge
s t a t e offices complex in downtown Albany.

CSEA P r e s i d e n t William L. McGowan, who p a r t i c i p a t e d
in c e r e m o n i e s m a r k i n g the dedication, said he envisions a
series of s i m i l a r day c a r e c e n t e r s eventually n e a r other l a r g e
s t a t e work locations around the State. The P l a z a Day C a r e
Center is being opened as a pilot p r o j e c t on S e p t e m b e r 5 to service infants, toddlers and pre-school children of s t a t e workers.
It will be run a s a public benefit corporation, and Gov. Carey is
expected to include public employee union r e p r e s e n t a t i v e s as
well as s t a t e m a n a g e m e n t - p e r s o n n e l to the corporation.
Meyer " S a n d y " F r u c h e r , director of the governor's office
of employee relations, who r e p r e s e n t e d Governor Carey at the
dedication, praised CSEA for leading the drive to achieve such
a p r o g r a m through l a b o r - m a n a g e m e n t negotiations.
P r e s i d e n t McGowan said the union has pursued the concept for y e a r s in an e f f o r t to e a s e e m p l o y m e n t p r e s s u r e , especially for single p a r e n t s t a t e w o r k e r families. " T h i s is a
g r e a t concept that should prove to be a g r e a t benefit to
employees. I believe we will see the idea s p r e a d as this pilot
p r o j e c t proves its w o r t h , " McGowan said.

Employee Assistance plan
helps solve problems
ALBANY — An innovative p r o g r a m to help s t a t e
w o r k e r s solve drug, alcohol, m a r r i a g e , or other personal
p r o b l e m s which a f f e c t work p e r f o r m a n c e began last week
in the Division of Substance Abuse Services.
The E m p l o y e e Assistance P r o g r a m — the f i r s t of its
kind in any Albany-area s t a t e agency — w a s designed by the
s t a t e Division of Substance Abuse Services, t h e Division of
Alcoholism and Alcohol Abuse, and the commission on
Alcohol and Substance Abuse P r e v e n t i o n and Education.
The Civil Service E m p l o y e e s Assn. also helped develop the
program.
E m p l o y e e s who a r e troubled with p r o b l e m s will receive
r e f e r r a l to a p p r o p r i a t e s e r v i c e s in the c o m m u n i t y a s the
m a j o r p a r t of the prograrh, which will b e c o m e fully
operational this fall. Designers of the new p r o g r a m feel t h a t
relieving the s t r e s s of personal p r o b l e m s will i m p r o v e
w o r k e r s ' job p e r f o r m a n c e s and i n c r e a s e productivity.
Under the p r o g r a m , employees r e c r u i t e d f r o m the staff
of the agencies will a c t as coordinators and will set aside
t i m e each week for voluntary consultation with w o r k e r s .
The coordinators will interview w o r k e r s , identify and
a s s e s s any p r o b l e m s , and r e f e r the e m p l o y e e s to an
a p p r o p r i a t e service agency, if needed.
Follow-up interviews with w o r k e r s will also be conducted. All information will be kept confidential.
Coordinators will receive specialized training f r o m the
Division of Alcoholism and Alcohol Abuse to l e a r n interviewing and a s s e s s m e n t techniques and to help t h e m identify public and p r i v a t e service agencies in the c o m m u n i t y .

MIDDLETOWN — The Civil Service E m p l o y e e s Assn. has presented its
P r e s i d e n t ' s Award to a staff employee, the president of a CSEA Local, and a
newspaper r e p o r t e r for their roles in discovering and publicizing the dumping
of c h e m i c a l s and c a d a v e r p a r t s on the grounds of the Middletown P s y c h i a t r i c
Center last April.
CSEA P r e s i d e n t William L. McGowan recently presented the P r e s i d e n t ' s
Award to CSEA Field R e p r e s e n t a t i v e Flip Amodia of Region III; Alex Hogg,

for abolishing six staff positions during an i m p a s s e in negotiations over
the abolition of the positions, it was
announced by Unit President Charles
L. Jones.
The union filed the charge with the
State Public E m p l o y m e n t Relations
B o a r d b e c a u s e t h e B o a r d of
Education unilaterally decided to
a b o l i s h t h e positions d u r i n g t h e
pendency of the impasse. This constitutes a unilateral change in t e r m s
and conditions of employment and is
e v i d e n c e of b a d - f a i t h b a r g a i n i n g ,
CSEA charges.
The union asked P E R B to assist the
p a r t i e s in an a t t e m p t to resolve the
impasse. P E R B may assign a
m e d i a t o r or a fact-finder to provide
outside expertise in resolving the
negotiations impasse.
The union said it would prove that
the Board of Education entered into
the negotiations with a pred e t e r m i n e d i n t e n t to abolish t h e
positions and thus evidenced badrfaith
bargaining.
E x p r e s s i n g his disappointment that
the negotiations had reached an impasse, Unit P r e s i d e n t Jones said, " I n
approaching the bargaining table with
a pre-determined intent, the Board of
Education effectively sabotaged the
n e g o t i a t i o n s . " T h e union m a d e
several proposals in an a t t e m p t to
resolve the problem, but the district
negotiating t e a m m a d e virtually no
movement from their original
position of abolition of the positions."

Downstate Medical job phaseout protested
ALBANY — CSEA s t a f f e r s m e t last week with m e m b e r s of the union's
Downstate Medical Center CSEA local, to try to resolve an ongoing problem
of phasing out of certain types of jobs there.
Local P r e s i d e n t Bob Keeler and about 30 other active CSEA m e m b e r s
f r o m D o w n s t a t e m e t in Albany with CSEA E x e c u t i v e Director Joseph
Dolan; Collective Bargaining Specialists P a u l T. Burch and Nels Carlson;
and R e s e a r c h Analyst Timothy Mullens.
" M r . Keeler asked us to m e e t with him and his people concernmg a
situation at Downstate that a p p e a r s to be d i s c r i m i n a t o r y , " said Mullens.
" F o r s e v e r a l months, they have been leaving all vacancies unfilled in the
positions of attendants, nurses' aides, technicians and s o m e others, and
replacing every two of these jobs with one r e g i s t e r e d n u r s e . "
Mullens pointed out that " t h e kinds of jobs that a r e being phased out
at D o w n s t a t e a r e a l m o s t all minority-and women-held jobs. And t h e r e
a p p e a r s also to be a contradiction in policy t o w a r d s these people, because
m a n a g e m e n t often turns t h e m down when they apply for t i m e off to attend
courses or training sessions. So on the one hand t h e y ' r e telling these
employees, ' Y o u ' r e to i m p o r t a n t ; we c a n ' t s p a r e y o u , " and on the other
hand, t h e y ' r e not replacing the ones who leave or r e t i r e . "
The D o w n s t a t e employees also informed CSEA a t the m e e t i n g t h a t the
employees who r e m a i n in the above-mentioned jobs a r e no longer doing
direct p a t i e n t - c a r e work, but a r e being told to do escort- and m e s s e n g e r type duties.
As a result of the meeting, the union is requesting a m e e t i n g with the
central a d m i n i s t r a t i o n of SUNY and m a n a g e m e n t at Downstate, requesting
an investigation demanding a n s w e r s to the employees' complaints. The union is also bringing the situation-to the attention of t h e joint S t a t e / C S E A
Continuity-of-Employment C o m m i t t e e , through Burch, who is the CSEA
staff liaison to that c o m m i t t e e . The union for education and training for the
a f f e c t e d employees, and increased tuition r e i m b u r s e m e n t s to m a k e such
education and training possible. And finally, CSEA is asking t h e s e Downs t a t e e m p l o y e e s to send to the union's R e s e a r c h Dept., 33 Elk St., Albany,
N.Y., 12207, information about their job descriptions and a c t u a l job duties,
now and in the past, so that the union can proceed with a reclassification request f r o m the Dept. of Civil Service.
" W e ' r e going to try to get these employees reclassified to m o r e
a p p r o p r i a t e titles, a t s a l a r i e s that properly r e f l e c t the value of the work
they d o , " Mullens said.
Memorial service is held for Alfred
VALHALLA — A m e m o r i a l service
for Alfred Jaroszewicz, who died
while allegedly p e r f o r m i n g out-oftitle work on J u n e 5, was expected to
have been held this week on the
grounds of the Westchester County
Medical Center here. At press time,
the service was scheduled to be held
J u n e 19.

The a g r e e m e n t , which included an
agency shop clause, also provided for
adoption leave, available to either
sex, and new provisions for m a t e r n i t y
leave. An overall longevity increase
from $700 to $1,000 was established
and upgradings occurred for public
health nurses, registered nurses and
h o m e h e a l t h a i d e s in t h e H e a l t h
Department.

Contracting out charges in Nassau
MINEOLA — Alleged contracting
out by Nassau County has led CSEA
Local 830 to file four I m p r o p e r P r a c tice ( I P ) c h a r g e s with the Public
Employment Relations Board
( P E R B ) , Local P r e s i d e n t Nicholas
Abbatiello has reported.
He said CSEA Regional Attorney
R i c h a r d G a b a filed I P s in J u n e
against the county for contracting out
for security and custodial services at
Nassau County Community College in
Garden City.
Gaba filed I P s in May against the
county for contracting
out
m a i n t e n a n c e s e r v i c e s in Westbury
and security s e r v i c e s in Lawrence.
The I P s a r e based on P E R B ' s April
1978 ruling that the contracting out of
work previously p e r f o r m e d by the
recognized bargaining unit is a subj e c t of m a n d a t o r y negotiations. Such
contracting o u t violates the Taylor
Law.
The Appellate Division of New York
State S u p r e m e Court, in a unanimous
decision in May, upheld the P E R B
ruling. The P E R B and court decisions
w e r e in the Saratoga Springs City
School District case.
Newsday, the m a j o r daily newspaper on Long Island, reported that
Nassau County bases its right to cont r a c t out on the 1977 State Court of
Appeals decision in the Westchester
County case, Abbatiano said.
CSEA Attorney R i c h a r d Burstein,
who r e p r e s e n t e d the union in the
Saratoga Springs case, has said the
Westchester decision does not apply
to N a s s a u and other contracting out
because:
— P r i o r to the s u m m e r of 1977,
P E R B did not have the authority to
require m a n a g e m e n t and unions to
negotiate in good faith. With the
passage of the P E R B P o w e r s Law
t h a t y e a r , P E R B w a s giyen t h e
authority to rule as it did in the
Saratoga Springs case. P E R B ' s ruling
was based on N L R B rulings and U.S.
S u p r e m e Court c a s e law.
— The Westchester c a s e occurred
before the P E R B P o w e r s Law and
was based on a constitutional issue
r a t h e r than the legal reality which
now exists.

R e g a r d i n g out of title work, O'Connor said: " T h i s is a p r a c t i c e that has
to be stopped. The d a n g e r s a r e obvious when unskilled and untrained
men a r e assigned dangerous w o r k . "

$60,000 back pay closer
BROOKLYN Two CSEA
m e m b e r s took a step closer to $60,000
a w a r d s in back pay last month when a
Brooklyn S u p r e m e Court ruled they
had been unfairly t e r m i n a t e d eight
y e a r s ago.
P a m e l a Nicotra and Lillian
Monathsberger w e r e e m p b y e e s of
the Kingsboro P s y c h i a t r i c Center until a y e a r a f t e r the 1972 CSEA strike
there. The two Mental Hygiene
Therapy Aides w e r e penalized for
s t r i k i n g and with a t h i r d CSEA
m e m b e r Yvonne Vaughn, w e r e placed
on a y e a r ' s probation. But they w e r e
never notified they w e r e on probation
and later all t h r e e w e r e fired.
The CSEA litigated the c a s e and the
ruling on May 25, which m a y be the
last step in a long series of CSEA wins
in court, was another victory for the
union.
" I t j u s t shows that the CSEA will
not let the s t a t e get a w a y with an infraction of the rules no m a t t e r how
long it t a k e s , " c o m m e n t e d Sol

Supreme Court Justice Irving
R a d e r , Kings County, a g r e e d with the
CSEA law f i r m of Mailman & F u l l e r ' s
c o n t e n t i o n t h a t Ms. N i c o t r a a n d
Monathsberger were fired during
their probationary period without being charged and given a hearing. H e
ruled that the employee could be fired
without f o r m a l c h a r g e s and a h e a r i n g
only a t the end of the probationary
period.
Moreover, the s t a t e , in an e a r l i e r
litigation last y e a r , w a s unable to
produce probation notices allegedly
sent by certified mail to the t h r e e
women. The Brooklyn S u p r e m e Court
ruled last May that the t h r e e w e r e entitled to the Taylor Law Strike determination hearings which they w e r e
denied in 1972.
Ms. Vaughn last January established
that she was not on strike during the
incident at Kingsboro and w a s reinstated with $50,000 in back pay and int e r e s t . The two other employees failed to establish that they w e r e not on
strike but then pursued the legal
action which resulted in last m o n t h ' s
ruling.
" T h e reason for the firings w a s
given a s unsatisfactory p e r f o r m a n c e .
But, like p e r m a n e n t e m p l o y e e s ,
employees on probation had to be
brought up on charges and given a
hearing. They couldn't just be summ a r i l y f i r e d , " said Ted Ruthizer, an
attorney f r o m Mailman & Fuller. Atty. Ruthizer explained that the Taylor
Law has since läeen amended to allow
such a procedure but it was illegal in
1972.
Mr. Ruthizer said that the two
employees should get about $60,000
each in back pay and he believes they
will receive interest on the money,
" b u t the court order doesn't
specifically spell it o u t . "
The s t a t e has 30 days to file for
appeal of the decision but according
to Mr. Ruthizer, " t h e s e a r e very difficult grounds to launch an appeal
f r o m and we have not received any
word a t this m o m e n t that they will,"
he said.

Union probing air quality
ALBANY - The Air Quality Comm i t t e e of the Capital Region of the
Civil Service E m p l o y e e s Assn. is
seeking input f r o m Locals throughout
the Region about heating and ventilation problems, smoking and
a s b e s t o s contamination and other
conditions which adversely a f f e c t a i r
quality.
The c o m m i t t e e , which has recently
been focusing its attention on the
possibility of asbestos contamination
in s o m e buildings of the E m p i r e S t a t e
P l a z a and the S t a t e Campus, will
s t a r t following up r e p o r t s of this and
other p r o b l e m s in all a r e a s .
A c c o r d i n g to J o h n C o r c o r a n ,
Capital Region field director who is
serving as an advisor to the committee, they have received complaints about a condition of smokefilled, s t a l e air, c r e a t e d when partitions a r e installed to divide work
space. " S o m e buildings w e r e not
m e a n t to be divided into c u b i c l e s , " he
said. " T h e y w e r e designed to have a
continuous a i r flow f r o m one end of
the r o o m to the other f r o m ventilation
points along the walls. Floor to ceiling
partitions i n t e r f e r e with the air flow.
Of course the employees a r e complaining because the a i r can be very
i r r i t a t i n g to b r e a t h e . "
Under its c h a i r m a n . Capital Region
president Joseph M c D e r m o t t , the
c o m m i t t e e has been m e e t i n g with the
S t a t e for the p a s t several m o n t h s on
the a s b e s t o s contamination m a t t e r .
" W e have been insistent that the State
hire an outside consultant to t e s t for
the p r e s e n c e of asbestos, that the
c o m m i t t e e be allowed to approve of
the one who is hired and that we
review t h e results of the t e s t s , " he
said. Currently the c o m m i t t e e is
waiting for the test reports. Mr.
M c D e r m o t t feels that the p r o b l e m s
will be readily c o r r e c t e d because
" t h e S t a t e is concerned about the
matter."
Asbestos contamination, he reports,
m a y not be limited to the State
buildings, but m a y exist in schools
and other public buildings, as well.
" T h e S t a t e p r o b l e m s have s t a r t e d the
ball rolling, said Mr. M c D e r m o t t .
" W e a r e now checking into r e p o r t s of
contamination in other a r e a s . "

Rank-and-file
They came to Albany by the several hundreds over the past
several weeks, culminating in a self-proclaimed "Lobby Day" rally earlier this month. They discussed, they urged, they pleaded and
they pressured their cause with members of the State Legislature.
"They" are the officers and the rank-and-file members of
CSEA Locals from across the state, the "backbone" of the labor
movement that historically has risen up and responded to a call for
action.
As this year's legislative session dragged along, it became apparent that action on many of CSEA's key program bills might be
delayed. As so, starting a few weeks ago, the union issued a call for
unified lobbying by members to put pressure on legislators to consider and act upon union-supported legislation.
Region by region, they came to Albany to lobby with their own
legislators. And, as the session headed for a mid-June recess, the
Lobby Day rally was organized to renew emphasis from the union
membership to the legislators about their concern for the future of
the union bills.
The photos on these pages depict some of the lobby activity of
the hundreds of rank-and-file members who came to Albany earlier
this month to lobby under guidance of CSEA professional lobbyists.
At press time, legislative action on the bills was inconclusive. A
complete status report is shown on page 9 of this issue.

Charge merger would
extend sheriffs term

Attorneys for t h r e e Westchester
County Deputy Sheriffs have told the
State Court of Appeals in Albany that
a m e r g e r of the Sheriff's D e p a r t m e n t
with t h e c o u r t s P a r k w a y P o l i c e
would illegally extend the s h e r i f f ' s
t e r m of office and be inequitable to
the deputy sheriffs.
At p r e s s t i m e , t h e Court of
Appeals issued a ruling that the
planned m e r g e r m a y go into e f f e c t
on July 1 as scheduled.
The a r g u m e n t s before the s t a t e ' s
top court c a m e on an appeal Dy
Westchester County for a decision
e a r l i e r this y e a r by S u p r e m e Court
J u s t i c e George Beisheim J r . that
declared the proposed m e r g e r unconstitutional.
The m e r g e r , approved by the county's voters last November, was
scheduled to go into e f f e c t July 1. It
would involve the 160-member
s h e r i f f ' s d e p a r t m e n t and the 172m e m b e r P a r k w a y P o l i c e . CSEA
r e p r e s e n t s the s h e r i f f ' s deputies.
Attorneys for the t h r e e deputies
who challenged the m e r g e r , T h o m a s
Spasiano, Robert Cantrell and F r a n k
P r e t e , said that the appointment of
the present sheriff, T h o m a s Delaney,
as Public Safety Commissioner in
c h a r g e of the combined force would
be unconstitutional because it would,
in e f f e c t , extend his t e r m .
T h e p r o v i s i o n in t h e m e r g e r
providing for Delaney's appointment
was p a r t of a c o m p r o m i s e between
the sheriff and County E x e c u t i v e
Alfred DelBello to win Delaney's support for the proposal.
The Westchester County Unit of
CSEA is also opposing the county's
appeal. CSEA Attorney J a m e s Rose
pointed out that the a u t o m a t i c appointment of Delaney to the Public
Safety Commissioner post would be
" a de facto election with but one candidate."
He also said that the m e r g e r law
would curtail employee rights in disciplinary proceedings.
F r o m t h e b e g i n n i n g CSEA h a s
s t e a d f a s t l y maintained that its opposition to the m e r g e r was not a blind
opposition to a combined police force,
but an unwillingness to accept what
C a r m i n e DiBattista, the Local's chief
shop s t e w a r d , r e f e r r e d to as a " b a d
law."
This p a s t week R a y O ' C o n n o r ,
president of the Westchester County
unit of CSEA, c o m m e n t i n g on the
Court of Appeals action, said " W e a r e
interested in a t r u e m e r g e r that will
protect the rights of both the w o r k e r s
and the t a x p a y e r s . This law does
neither.

" W e a r e very hopeful that the court
decision will go in our favor. We want
t h e m all to go back and put together a
m e r g e r proposal that is constitutional
and f a i r . "
O ' C o n n o r pointed out t h a t t h e
reason for the m e r g e r plan is " t o save
money."
" T h i s plan is an expensive plan, so
in addition to its other d r a w b a c k s it
will save little if any money. We
h o p e , " he continued, " t h e people will
get a chance to vote on a t r u e m e r g e r
plan that will be good for e v e r y b o d y . "
The county is basing its appeal on
the a r g u m e n t that " h o m e r u l e "
provisions of s t a t e law allow the
county to e f f e c t the m e r g e r now.
County Executive DelBello,
however, has suggested that r a t h e r
than invalidate the m e r g e r , the court
should instead stay its e f f e c t until
J a n . 1, 1980 when Delaney's t e r m a s
sheriff runs out.
The deputies contend that the
m e r g e r law should either be approved
or denied as a whole because it w a s
" a product of e x t r a o r d i n a r y political
a r r a n g e m e n t and c o m p r o m i s e . "
The m u r k y s t a t u s of the m e r g e r
plan has had its e f f e c t on the county's
political p a r t i e s which a r e undecided
on whether or not to designate candidates for sheriff in the upcoming
general election in November.
A decision by the court of appeals is
expected in mid-June.

In a l e t t e r to all CSEA Local
presidents e a r l i e r this month, CSEA
P r e s i d e n t William L. McGowan noted
CSEA had m a d e a c o m m i t m e n t to
help r a i s e funds to support the g a m e s ,
and t h a t a film sale p r o j e c t backed by
CSEA has not resulted in the level of
support envisioned. T h e r e f o r e , he
said, with the g a m e s so close now,
direct contributions f r o m CSEA

ALBANY - The Civil Service
E m p l o y e e s Assn. has recently
settled c o n t r a c t s for two
bargaining units in Columbia
County, both going into e f f e c t
July 1, 1979.
In the City of Hudson both
sides a g r e e d to a two-year cont r a c t giving e m p l o y e e s a 5.9 per
cent s a l a r y i n c r e a s e in the f i r s t
y e a r a n d a 6.9 per cent in the
second y e a r . E m p l o y e e s who
have ten y e a r s of service, or
' m o r e , can now be paid for unused sick leave up to a m a x i m u m
of 60 days p e r y e a r , a t set r a t e s .
In addition a sick leave bank h a s
been established and the n u m b e r
of y e a r s an e m p l o y e e m u s t work
in o r d e r to qualify for vacation
has been reduced.
A t h r e e - y e a r c o n t r a c t with inc r e a s e s of six p e r cent in t h e
first y e a r , and seven p e r c e n t in

ALBANY — The wages of Comprehensive E m p l o y m e n t and Training
Act (CETA) employees, as regulated by the new CETA Law a r e causing
p r o b l e m s for both unions and the local g o v e r n m e n t p r i m e sponsors of the
program.
Common interest in the problem led both union and m a n a g e m e n t
r e p r e s e n t a t i v e s to get together at a CSEA-sponsored meeting in Albany
on J u n e 11.
The problem is that even though a CETA employee can be paid up to
$10,000 a y e a r , the a v e r a g e CETA wage m u s t be that of the a v e r a g e
wages in the a r e a , which usually a r e in the vicinity of $7,200 a y e a r according to a CETA formula.
Adhering to this facet of the CETA Law, which went into e f f e c t April
1, forces the creation of sub-entry-level positions (labor trainee) where
the actual work done by the CETA employee would be identical to the
higher-paid entry-level position (laborer).
Both union and m a n a g e m e n t r e p r e s e n t a t i v e s at the meeting were in
a g r e e m e n t that the use of sub-entry-level positions would c r e a t e secondclass citizens of CETA employees, and would place a stigma on such
w o r k e r s and c r e a t e bad feelings.
CSEA P r e s i d e n t William L. McGowan, who attended the meeting,
said: " Y o u hurt t h e m before they ever s t a r t work. . . I t ' s an awful thing
for the dignity of working people."
The m e e t i n g w a s coordinated by CSEA Collective Bargaining

Local 010 workshop covers many topics
NEW YORK CITY - New York City CSEA Local 010 held its annual workshop and convention with an excellent turnout May 28-30 at
the Concord Hotel, Kiamesha Lake.
The 3-day program, traditionally held during the Memorial Day
period, featured workshop sessions on insurance, health plans,
retirement, employee benefit fund, and political and legislative action,
among other topics.
