and new prescription d r u g insurance to CSEA
m e m b e r s in t h r e e m a j o r s t a t e bargaining units, has moved several steps closer to being
activated with the appointment of a fund
d i r e c t o r , a p p o i n t m e n t a n d e l e c t i o n of
t r u s t e e s , and the receipt of bids f r o m ins u r a n c e c a r r i e r s i n t e r e s t e d in p r o v i d i n g
coverage.

CSEA wins major appeal, test rescheduled

employees, has won a m a j o r appeal
decision f r o m the Civil Service Commission.
Union forces state to halt
disruptive staffing pattern

D u f f y and G r i e v a n c e C h a i r m a n William Chacona have won an a g r e e m e n t f r o m
s t a t e officials preventing the s t a t e f r o m rushing headlong into a disruptive
staffing plan for " d i s c r e t e m e n t a l r e t a r d a t i o n u n i t s " ( D M R U ' s ) at P i l g r i m
and other facilities.
" T h e union's position always w a s that the r e t a r d e d should be served by
those who a r e trained and experienced in c a r i n g for t h e m — the Mental R e t a r dation employees. But the S t a t e ' s plan called for segregation of these patients
into D M R U ' s , and for the P i l g r i m e m p l o y e e s — on 24 hours' notice, and with no
training or p r e p a r a t i o n , and with no r e g a r d for their scheduled shifts or days
off — to go right into the DMRU and s t a r t taking c a r e of these p a t i e n t s , " CSEA
Collective Bargaining Specialist Bob Guild said.
The a g r e e m e n t signed by the s t a t e officials m a k e s s e v e r a l m a j o r consessions to the union! F o r one thing, 80 funded jobs will be m a d e available to
the Office of Mental R e t a r d a t i o n so that r e c r u i t m e n t and training of R e t a r dation employees can begin. This r e c r u i t m e n t and training has a l r e a d y begun,
according to Ms. Duffy.
Secondly, the planned m o v e m e n t of patients a t P i l g r i m into the D M R U
t h e r e w a s postponed f r o m the original d a t e of May 30, and will now begin on
J u n e 6.
Also, the s t a t e a g r e e d t h a t the D M R U s t a f f i n g will be accomplished solely
with volunteers a n d / o r new Mental R e t a r d a t i o n employees.
And p e r h a p s m o s t importantly, the s t a t e has assigned two r e p r e s e n t a t i v e s
— one f r o m the Office of Mental R e t a r d a t i o n and one f r o m the Office of Mental
Health — to go to P i l g r i m and stay t h e r e until the transition to the DMRU is
completed, consulting with CSEA and keeping the union informed e v e r y step of
the way.
Region I P r e s i d e n t Irving F l a u m e n b a u m said: " I ' m glad they c a m e to this
understanding. But it should have been worked out a long t i m e ago. I hope the
d e p a r t m e n t of m e n t a l hygiene learns they m u s t c o m e to CSEA and consult
with us f r o m the beginning. This would have prevented the p r o b l e m s . "
The full Civil Service Commission
heard CSEA's appeal on May 24, and
decided the appeal was valid and that
the e x a m will be reopened to the
lower-paid workers. As a result, the
original J u n e 23 e x a m day will be
rescheduled to a l a t e r date.
CSEA had protested in M a r c h that
the scheduled test for the position of
Computer P r o g r a m m e r
Trainee,
which pays $10,624 a y e a r , had arbitrarily been closed to s t a t e w o r k e r s
in G r a d e s 6 and under. The last t i m e
the e x a m was given, in 1977, 23 of the
Grade-6-and-under employees who
took the e x a m w e r e appointed to the
t r a i n e e jobs, which lead to G r a d e 14
C o m p u t e r P r o g r a m m e r positions in
the s t a t e service.
Civil Service Commission P r e s i d e n t
Victor Bahou had r e j e c t e d CSEA's
protest in M a r c h , saying that only a
few people below g r a d e 6 passed the
1977 test. CSEA then appealed that
d e t e r m i n a t i o n to the full Commission,
and the h e a r i n g w a s held May 24.
A f t e r the union's hour-long appeal,
the c o m m i s s i o n deliberated on the
m a t t e r and m a d e its decision l a t e r in
the day. It i m m e d i a t e l y a f f e c t s about
2,300 workers, according to union est i m a t e s , the n u m b e r of Grade-6-andlower employees who filed for the
e x a m last t i m e . However, t h e r e m a y
be m o r e this y e a r .

I wonder how many of you a r e
a w a r e of the various steps taken by
CSEA to improve and insure union
reaction to m e m b e r problems?
T h e r e a r e at least four levels at
which these problems can occur.
The m o s t common one is at the individual m e m b e r level. Someone is
fired, harassed or abused. That
someone (if they a r e a w a r e of their
rights!) goes to the union rep and
thus the union r e a c t s .
A second level is work location.
A building is unsafe, too hot or too
cold. Complaints a r e registered
and the union (usually by a field
rep) r e a c t s to c o r r e c t the problem.
A third level is the bargaining unit. At this level the union is organized to negotiate, a r b i t r a t e , and adm i n i s t e r contracts. Local and unit
o f f i c e r s have good contact with
regional and central resources for
guidance and assistance.
The last level is one that often is
missed by our m e m b e r s , and is
a l m o s t always missed by other unions. That level is the c a r e e r level.

P r o g r a m and was accepted. I a m now
employed as a p a r t - t i m e s e c r e t a r y t r a i n e e at P i l g r i m Center, still
attending Brentwood High School and
receiving credits along with 35 other
students who a r e also in the P r o g r a m .
May I, on behalf of these high
school students, let the public know
that Mr. Chesson" and Mr. Carlsen,
e a r n e d , and deserve, the love and
thanks of their fellow citizens h e r e on
Long Island for making this P r o g r a m
possible and creating incentive for
t h e s e high school s t u d e n t s to
g r a d u a t e , go on to college or e n t e r the
civil service field as well as the
private business sector — to say
nothing of the cash the student will
now have in his or her pockets.

etc. Another a s p e c t t h a t needs cons i d e r a t i o n is t h e d e p a r t m e n talization of units. Thus e m p l o y e e s
consider problems as centered
about the Social
Services
D e p a r t m e n t , or the Highway
D e p a r t m e n t or the bus d r i v e r s , etc.
T h i s c o m b i n a t i o n of a w i d e
v a r i e t y of c a r e e r s a n d t h e
departmentalization of e m p l o y e e s
c r e a t e s a real identity problem for
any union a t t e m p t i n g to r e p r e s e n t
e a c h of t h e m . Y e t , t h e b a s i c
necessity for UNITY, calls for us
to m e e t this challenge!
O n e m e t h o d s t a r t e d by t h e
County Executive C o m m i t t e e and
myself was to develop a c t i v e comm i t t e e s along these levels. Such
c o m m i t t e e s o f f e r e x p e r t i s e and
d e d i c a t i o n b a s e d on s p e c i f i c
c a r e e r s a n d / o r work situation.

WASHINGTON, D.C. — The million m e m b e i American F e d e r a t i o n of State,
County and Municipal E m p l o y e e s (AFSCME), with 400,000 women m e m b e r s
throughout the nation, has n a m e d E v e Johnson Coordinator of Women's Activities.
Ms. Johnson joins the AFSCME International staff following 4 y e a r s as
education and training coordinator for A F S C M E ' s Council 28, Washington
F e d e r a t i o n of State E m p l o y e e s .
AFSCME m e m b e r s h i p continues to experience increasing growth a m o n g
working women. A recent Labor D e p a r t m e n t study noted that t h r e e out of five
women who joined labor unions between 1956 and 1976 joined AFSCME.

an I m p r o p e r P r a c t i c e c h a r g e has
been filed with the
Public
Employment Relations Board
( P E R B ) against the New York State
D e p a r t m e n t of P a r k s and Recreation.
Nels E. Carlson, CSEA Collective
Bargaining Specialist and representative fof employees in the P a r k s and
Recreation D e p a r t m e n t , indicated
that New York State allegedly
violated Article 14, Section 209-a, subsection (d) of the Public E m p l o y e e s
F a i r E m p l o y m e n t A c t w h e n on
F e b r u a r y 9, 1979, it unilaterally discontinued its p r a c t i c e of providing
state-owned vehicles on a 24-hour
basis to employees assigned such
v e h i c l e s a s a condition of t h e i r
employment.
The I P c h a r g e f u r t h e r contends that
the State of New York, through its
agent. Commissioner Orin L e h m a n ,
unlawfully discontinued providing
state-owned vehicles
without
negotiating such change with the
duly recognized bargaining representative (CSEA).
"CSEA contends that any unilateral
change is a violation," Carlson said.
" W e carefully investigated similar
c h a r g e s and P E R B decisions involving public employees in Onondaga and
C a t t a r a u g u s counties and, based upon
those decisions, have filed an I P
charge on behalf of s t a t e employees
f r o m the P a r k s and Recreation
D e p a r t m e n t who w e r e assigned
v e h i c l e s a s a condition of t h e i r
e m p l o y m e n t . At p r e s e n t , p u b l i c
employees have a difficult t i m e keeping up with today's spiraling costs of
living and r u n a w a y gasoline prices
without the state adding undue
h a r d s h i p by t a k i n g a w a y w o r k
vehicles," Carlson said.
PERB orders pay increases for
Clinton County airport workers
PLATTSBURGH - A f t e r passing a
resolution in J a n u a r y of 1978 to f r e e z e
the wages of county a i r p o r t personnel, the Clinton
County
Legislature has been ordered by a
Public E m p l o y m e n t Relations Board
m e d i a t o r to grant the w o r k e r s the
s a m e increase a w a r d e d to other
county workers in a two y e a r c o n t r a c t
effective J a n u a r y 1, 1978.
A c c o r d i n g to J e a n n e K e l s o ,
president of the Clinton County CSEA
Local, the employees will receive a
lump sum p a y m e n t for $500 which
should have been added on to s a l a r i e s
in J a n u a r y 1978 and a partial p a y m e n t
for $500 which should have been added
on for J a n u a r y 1979, in addition to an
a d j u s t m e n t in s a l a r y schedules to
reflect the increases for the
r e m a i n d e r of the c o n t r a c t period.

Retardation and Developmental
Disabilities, an organization seek9ng

The formation of the coalition, says
chairperson and p a r e n t C. R i c h a r d
J o n e s , is " d u e to a c o m m o n
recognition, by both the relatives of
the mentally retarded
and
developmental disabled and the staff
that is responsible for their c a r e , that
t h e present s e r v i c e s being received
by our handicapped citizens a r e inadequate, h a r m f u l and fail to m e e t
t h e s t a n d a r d s t h a t t h e S t a t e administration has established for these
people.
F r a n k Wilucz, a CSEA representative f r o m the Wilton Developmental
Center says a change is needed in the
Willowbrook Consent D e c r e e , a court
a g r e e m e n t that spells out the required ratio of staff to patients, to
allow for m o r e s t a f f . In addition he is
seeking to obtain c o m m u n i t y services
which have been assigned, but not implemented in the Wilton a r e a . He
blames the c e n t e r ' s p r o b l e m s on the
f a i l u r e of t h e c e n t r a l o f f i c e administration in Albany to properly
plan and i m p l e m e n t p r o g r a m s and a
lack of communications between that
office and the p a r e n t s and staff at the
centers.
R e p r e s e n t a t i v e s for N e w a r k and
Broome County c e n t e r s have also expressed concern over inadequate
staffing and the quality, and in s o m e
cases the lack, of services.
The coalition first m e t in F e b r u a r y
of 1979 to discuss deficiencies that existed at each center and to f o r m u l a t e
its goals. The group hopes to bring
about changes through m e e t i n g s with
the State administration and through
legislation.

all Suffolk County employees, is conducting an extensive r e s e a r c h p r o j e c t
to a s c e r t a i n the educational needs of
the county employees.
A questionnaire will be distributed
s o m e t i m e in J u n e and all employees
a r e urged to complete the questionn a i r e a s carefully and frankly as they
can, and return it to E m p i r e S t a t e

toll collectors, improved uniform and
work clothing allowances, increased

grievance procedure and other cont r a c t clause modifications.
In r e g a r d to l o n g e v i t y , t h e
Authority has agreed to continue the
s y s t e m in e f f e c t March 31, 1977, with
the following modifications:
(A) Once y e a r s of longevity a r e
e a r n e d , t h e y r e m a i n with an
employee during employment with
the Authority. If promoted to a higher
g r a d e , an e m p l o y e e r e c e i v e s a
m i n i m u m of a p e r f o r m a n c e advance
at the new grade level, and any
longevity steps at the new level that
w e r e c a r r i e d at the previous grade. If
an employee has not earned full
longevity steps, the employee still
shall be given credit toward longevity
for every year spent at the job or at
the first longevity step.
(B) If, because of promotions, a
person is not given full opportunity to
receive longevity steps, a f t e r twenty
continuous y e a r s of p e r m a n e n t service with the Authority it will be
a s s u m e d that person has earned the
second longevity step and salary shall
be a d j u s t e d the next April 1.
(C) If a person is appointed to a
position with the Authority other than
by Open Competitive Examination,
t i m e in g r a d e at another Civil Service
position with New York State, its
Agencies and Authorities shall count
t o w a r d s longevity with the Bridge
Authority.

The rush for
action

Political action at home needed
ALBANY — As the current legislative session draws nearer to a summer adjournment, the
Civil Service Employees Assn. has quickened its pace in pushing for action on a number of bills the
giant labor union considers important. Special emphasis has been directed to the permanent
agency shop proposal, although several other bills are also being pushed hard now by CSEA.
On June 5 CSEA had scheduled a major, statewide lobby day which was to feature a big outdoor
rally on the Capitol steps, and lobbying sessions by union members with their individual legislators.
But last week, it was union activists from CSEA's Central Region who were in Albany pushing
for legislative action on the bills the union considers to be of major importance. It was the latest in
a series of regional lobby efforts sponsored by CSEA. The June 5 lobby day and rally will climax the
big push for action before the state legislators call it quits for the summer. On these pages are
photos of the Central Region lobby effort.

m a n d a t o r y agency shop f e e for all public employees in New York S t a t e
would insure that all w o r k e r s who s h a r e the benefits of union r e p r e s e n tation also s h a r e the cost.
" T h e r e is absolutely no sound rationale for e x e m p t i n g non-union
m e m b e r s within a bargaining unit f r o m paying his f a i r s h a r e , " Corbett
said in a s t a t e m e n t .
" T h e public employee unions a r e required to r e p r e s e n t both
m e m b e r s and n o n - m e m b e r s in negotiating c o n t r a c t s and in g r i e v a n c e
proceedings," he said. " T h e n o n - m e m b e r s have a l w a y s enjoyed the inc r e a s e d wages, job protection and fringe benefits negotiated by the
union."
"Since the s e r v i c e s of t h e union and the benefits of this s e r v i c e a r e
shared by all workers, t h e r e is no justification for union m e m b e r s alone
to bear the substantial financial burden of r e p r e s e n t a t i o n , " Corbett
emphasized. "A p e r m a n e n t , m a n d a t o r y agency shop f e e in all public
employee units in the s t a t e will alleviate this inequality."

officials ignore the self-interest involved in local g o v e r n m e n t officials opposing such legislation as
Taylor Law r e f o r m , OSHA and
Agency Shop.

regressive, anti-labor, anti-public
e m p l o y e e , P r o p o s i t i o n 13 sentiment is local g o v e r n m e n t officials. If you don't believe that,

Dental, prescriptions
N e w welfare fund
to operate shortly
ALBANY — In the very near future, a new and comprehensive benefit from
CSEA representation will be available to New York State public employees
when the CSEA E m p l o y e e Benefit Fund goes into e f f e c t providing improved
dental insurance and new prescription drug insurance in the CSEA's Administrative, Institutional and Operational bargaining units.
The Fund, a creation of CSEA's successful negotiations this y e a r with the
G o v e r n o r ' s Office of E m p l o y e e Relations, will for the first t i m e provide direct
benefits to bargaining unit employees f r o m their collective bargaining
representative. It will be a first for s t a t e employees.
CSEA P r e s i d e n t William L. McGowan is C h a i r m a n of the Board of
T r u s t e e s that will monitor and regulate the Benefit Fund. Other T r u s t e e s a r e :
CSEA Statewide S e c r e t a r y I r e n e C a r r , elected S e c r e t a r y of the F u n d ; CSEA
Region 5 P r e s i d e n t J a m e s Moore, elected T r e a s u r e r of the F u n d : and CSEA
M e m b e r s Elaine Mootry and Louis Mannellino, m e m b e r s of the negotiating
t e a m that c r e a t e d the fund for the Administrative, Institutional and
Operational bargaining units.
The P r e s i d e n t of CSEA is an a u t o m a t i c t r u s t e e of the fund under the f u n d ' s
rules, adopted by CSEA's Board of Directors. The president appoints two of the
other four t r u s t e e s , in this c a s e Mr. McGowan appointed Mr. Mannellino and
Ms. Mootry — and the union's Board of D i r e c t o r s elects two t r u s t e e s — in this
c a s e Mr. Moore and Ms. C a r r .
The T r u s t e e s have appointed T h o m a s P . Collins, Comptroller of the union,
a s Director of the Fund. Mr. Collins has resigned his position a t union headq u a r t e r s to devote his energies to the Fund.
F i r s t order of business for the new Director and T r u s t e e s was deciding
what types of benefits will be provided to participating employees by the Fund.
Since the negotiated a g r e e m e n t with the State for the t h r e e bargaining units
t r a n s f e r r e d funds used by the State to provide employee dental insurance for
unit employees to the Fund, the T r u s t e e s decided that continuation and imp r o v e m e n t of Dental I n s u r a n c e w a s a priority benefit. Additionally, the
T r u s t e e s decided to provide the f i r s t Prescription Drug I n s u r a n c e p r o g r a m for
the t h r e e bargaining units.
Details of the F u n d ' s benefits will be released as soon a s the T r u s t e e s
a w a r d c o n t r a c t s for t h e c o v e r a g e to the insurance c a r r i e r s that bid on the
p r o g r a m . Bids w e r e opened on May 22 by P r e s i d e n t McGowan, Director
Collins and CSEA E x e c u t i v e Vice P r e s i d e n t T h o m a s McDonough. The bids
were referred to the Fund's consulting firm for review, and recommendations and will be awarded early in June.
Under the new CSEA-State c o n t r a c t s covering the t h r e e s t a t e bargaining
units, the State will pay $50 p e r q u a r t e r , per employee, to the CSEA Benefit
Fund to provide benefits to bargaining unit employees. T h e r e is no cost to the
employees. The T r u s t e e s of the Fund d e t e r m i n e the types and levels of benefits
to be provided with t h e available resources.
In the future, other CSEA represented bargaining units can buy in on the
F u n d ' s benefits by negotiating with e m p l o y e r s to provide the n e c e s s a r y cost of
participation.
While a Benefit F u n d is new to m o s t CSEA m e m b e r s , s i m i l a r funds have
been serving union m e m b e r s a c r o s s the country for d e c a d e s with g r e a t
success. The T r u s t e e s of the CSEA Benefit Fund a r e convinced t h a t this Fund
will also m e a n a n o t h e r m a j o r i m p r o v e m e n t in the services provided to public
employees in New York by the CSEA.
With the July 1979 implementation date for the Benefit bund rapidly
approaching, work is continuing to finalize a r r a n g e m e n t s for the s t a r t of this
new e r a in CSEA s e r v i c e to public employees. Information about the Fund will
be sent to participating employees in the n e a r future.

CSEA backing immediate
court reclassification plan
ALBANY — CSEA P r e s i d e n t William L. McGowan has directed union
officials to m o v e for the i m m e d i a t e implementation of the long-awaited
reclassification plan in the s t a t e ' s Office of Court Administration and to
use the union's legislative r e s o u r c e s to a s s u r e p r o m p t p a y m e n t of
retroactive s a l a r y i n c r e a s e s to s o m e 10,000 s t a t e court employees.
P r e s i d e n t McGowan issued the directives following the signing of the
classification plan by H e r b e r t E v a n s , Chief Administrative J u d g e of the
Office of Court Administration. I m p l e m e n t a t i o n of the plan m e a n s s a l a r y
i n c r e a s e s for m o s t of the court employees a f f e c t e d by the Unified Court
P r o g r a m adopted by the s t a t e legislature in 1977.
Under the Court R e f o r m P r o g r a m , court employees f o r m e r l y
employed by the counties and cities b e c a m e s t a t e employees when all of
the local c o u r t s w e r e m e r g e d into the s t a t e ' s new Unified Court System.
The classification study w a s begun to d e t e r m i n e w h e r e on the s t a t e ' s
salary schedule t h e s e newly m e r g e d employees should be placed. Due to
the m a j o r c h a n g e s in the court s y s t e m a s the result of the Court R e f o r m
P r o g r a m , all e m p l o y e e s of the Court of Appeals, the Appellate Division,
the Court of Claims, etc., who had been s t a t e employees prior to the
r e f o r m implementation, w e r e also reclassified.
Classification d e t e r m i n e s which s a l a r y g r a d e an employee should be
placed on. In collective bargaining a g r e e m e n t s s a l a r y g r a d e s a r e
negotiated. While CSEA and the Office of Court Administration presently
have a c o n t r a c t providing s a l a r y i n c r e a s e s for these employees r e t r o a c tive to April of 1977, the employees never received the s a l a r y i n c r e a s e s
they deserved because they w e r e not classified on the a p p r o p r i a t e salary
grade. The Court R e f o r m legislation gave the Office of Court Administration exclusive authority for classification of the newly m e r g e d
employees.
With the signing of the classification plan, employees a f f e c t e d by the
Court Reform P r o g r a m will now be assigned to a salary grade and, in addition to receiving salary increases up to their new grades, they will
receive a lump sum payment for the salary increases they have not received
since April of 1977 as a result of the classification delay.
The classification plan provides an appeals m e c h a n i s m if an employee
feels he or she has been improperly classified, but since CSEA has not
had an opportunity to study the full classification program it declined to
c o m m e n t on its reaction to the full package.
"We a r e of course happy that this m e s s has finally been cleared up
and we a r e at long last on our way to getting these people the money they
have been owed for the last two y e a r s , " P r e s i d e n t McGowan said, " b u t
it's absurd that this should have taken so long. The Office of Court Administration has pushed our people beyond the point of reason and t h e r e
a r e a g r e a t deal of hard feelings over these delays. I will m o s t strenuously urge J u d g e E v a n s to expedite the p a y m e n t of s a l a r y i n c r e a s e s and
r e t r o a c t i v e p a y m e n t s a s a g e s t u r e of good will on the p a r t of the s t a t e and
a m e a n s to r e s t o r e employee m o r a l e . "
The union president said he would o f f e r t h e support of the s t a t e ' s
largest public employee union to help the Office of Court Administration
to expedite passage of an appropriation bill in the legislature needed to
fund the r e t r o a c t i v e lump sum p a y m e n t s . The salary i n c r e a s e s a r e expected to be i m p l e m e n t e d in the n e a r future.
Mr. McGowan said union staff m e m b e r s and a t t o r n e y s will e x a m i n e
the classification document during the next several days and undertake
an information c a m p a i g n to advise the union's m e m b e r s h i p of its
reaction to the plan.
CSEA is the s t a t e ' s largest employee union and r e p r e s e n t s approximately 5,500 of the court employees a f f e c t e d by the classification plan.

Stan Jarosz retiring
B U F F A L O — When you mention the n a m e of Stan J a r o s z to his f r i e n d s and
coworkers, a few things always s e e m to pop up in the conversation — his love
for his family, his devotion to public service and his passion for dill pickles —
not necessarily in that order.
Stan is retiring this month a f t e r 43 y e a r s of public service and when his
associates held a luncheon recently at the Statler Hilton Hotel to honor him, it
was no s u r p r i s e to anyone that m o r e than 150 people showed up.
" H e is one of the nicest people I ' v e ever known," said P e t e r Blaabouer,
P r e s i d e n t of Buffalo City CSEA Local 003.1 know that it's an old saying, but it
really fits. He w a s a joy to work with and a p e r f e c t g e n t l e m a n . He a l w a y s went
out of his way to m a k e people feel c o m f o r t a b l e . "
A CSEA m e m b e r since 1966, Stan served a s vice-president of Local 003 for
four y e a r s and a s t r e a s u r e r for the p a s t six y e a r s .
He began his c a r e e r in 1936 as an accountant with the W a t e r Bureau in
N i a g a r a F a l l s and worked actively for m a n y y e a r s with the New York State
Civil Service F o r u m there.
In 1951, Stan was n a m e d Administrator of the Sales Tax Division, a post he
held for fifteen y e a r s , before t r a n s f e r r i n g to the s t a t e D e p a r t m e n t of Taxation
and F i n a n c e in the Buffalo District Office, w h e r e he has worked since then in
the Sales Tax Audit p r o g r a m .
An accident a t birth left Stan blind in one eye, but what s o m e people might
call a handicap has never slowed him down. In addition to his work with the
CSEA, Stan has been actiye in c o m m u n i t y and church a f f a i r s .
M a r r i e d for 39 y e a r s with four children, Stan is anxiously awaiting the
a r r i v a l of his sixth grandchild. He says he plans to " j u s t t a k e it easy for a
w h i l e " now that h e ' s retired, but if you ask his friends, t h e y ' r e not quite sure
t h a t ' s possible.

New York State currently has about
43,000 people working under CETA
auspices, P a u l Burch e s t i m a t e s . They
include s t a t e employees as well a s
e m p l o y e e s of n e a r l y e v e r y local
jurisdiction.
A recent m e m o to the " p r i m e spons o r s " f r o m the. U.S.
Labor
D e p a r t m e n t directed the employers
involved to try to achieve the mandated $7,200 a v e r a g e annual wage for
CETA employees by c r e a t i n g new,
sub-entry-level jobs. The problem the
D e p a r t m e n t directive was trying to
a d d r e s s was that employers w e r e
finding it impossible to reach the
C o n g r e s s i o n a l l y - e s t a b l i s h e d $7,200
a v e r a g e salary for CETA employees,
in a r e a s w h e r e the cost of living —
and consequently, salaries — a r e
relatively high.
The N o r t h e a s t was a particular
problem a r e a , Mr. Burch said. " T h e

employees of $7,200" he noted. " I n
order to hire a CETA employee at a
salary higher than that, the State
would h a v e to e m p l o y a n o t h e r

salary in o r d e r to m e e t the a v e r a g e
annual wage. The f e d e r a l proposal
c r e a t e s a whole new class of subentry level jobs, which a r e in reality
sub-standard jobs, held by a group of
essentially disenfranchised w o r k e r s . "
Mr. Burch, a collective bargaining
specialist, explained that " i t was
never contemplated or intended in
any collective bargaining a g r e e m e n t
that the union r e p r e s e n t any workers
who a r e a t s a l a r i e s below the
minimum that was negotiated.
C r e a t i n g a w h o l e n e w c l a s s of
workers at sub-entry-level jobs will
leave those workers, without
representation."
But m o r e f u n d a m e n t a l he says, is
the fact that the new regulations will
undermine the original purpose of
CETA.
" T h e purpose was to help the disadv a n t a g e d , the elderly, and the
chronically unemployed find dignity
through meaningful jobs. If these
regulations a r e allowed to stand, it
will be like telling these people,
' Y o u ' r e not worthy of standard civil
service jobs, so we have to c r e a t e subs t a n d a r d jobs for you.' That, it s e e m s
to me, is c o n t r a r y to the whole i d e a . "

WHITE PLAINS - With two court
victories in its favor already, the Civil
Service E m p l o y e e s Assn. said it anticipates yet another in the n e a r
f u t u r e to prevent the planned July 1
m e r g e r of the Westchester County
S h e r i f f ' s D e p a r t m e n t with the count y ' s P a r k w a y Police.
According to CSEA Regional Atty.
J a m e s Rose, the County will appeal a
M a y 11 S t a t e S u p r e m e C o u r t ,
Appellate Division ruling in Brooklyn,
by a 3-2 vote, that the planned m e r g e r
is b o t h u n c o n s t i t u t i o n a l a n d a
violdtion of Civil Service Law. The
Appellate Division upheld an e a r l i e r
decision by J u s t i c e George Beisheim
J r . in F e b r u a r y , who decided in f a v o r
of a suit brought by the W e s t c h e s t e r
County Unit of CSEA Local 860.
It is anticipated that the S t a t e Court
of Appeals will be asked to h e a r the
county's appeal prior to July 1.
CSEA filed suit to block the planned
m e r g e r because of union concerns
over the s t a t u s of the deputy s h e r i f f s
in t h e m e r g e d d e p a r t m e n t , t h e i r
f u t u r e promotional opportunities, and
their pension rights.
CSEA r e p r e s e n t s the deputy
sheriffs, a s well a s the lieutenants,
c a p t a i n s and civilian employees of the
P a r k w a y Police.

N e a r l y 18,000 s t a t e e m p l o y e e s w h o a r e m e m b e r s of t h e
Professional, Scientific and Technical bargaining unit a r e insured
through the various CSEA-sponsored M e m b e r s h i p Insurance P r o g r a m s .
Because of the confusion over their r e p r e s e n t a t i o n s t a t u s and the confusion over the P E F - s p o n s o r e d insurance plans, m a n y of these PS&T
e m p l o y e e s have been calling and writing CSEA hoping to continue their
existing coverage. Let m e a t t e m p t to c l a r i f y .
T h r o u g h a r e c e n t c h a n g e in t h e C S E A C o n s t i t u t i o n , a new
c l a s s i f i c a t i o n of CSEA m e m b e r s h i p h a s b e e n e s t a b l i s h e d . This
m e m b e r s h i p , known a s Associate M e m b e r s h i p , allows persons employed
in the Civil Service of the State of New York, who a r e not represented by
CSEA for the purpose of collective bargaining, to continue m e m b e r s h i p in
CSEA. Associate M e m b e r s shall be eligible for participation in the ins u r a n c e p r o g r a m s sponsored by CSEA. However, since CSEA does not
have payroll deduction for these people, Associate M e m b e r s h i p dues and
insurance p r e m i u m s m u s t be paid on a d i r e c t p a y m e n t basis.
The last deduction for CSEA-sponsored M e m b e r s h i p Insurance
P r o g r a m s was taken on May 16, 1979, for the Institutional Payroll and on
May 23, 1979, for the Administrative Payroll. An instructional letter and a
p r e m i u m notice will be received during the week of May 28 by all PS&T
insureds advising t h e m of the eligibility to continue in the insurance plans
and instructing t h e m how to go about m a k i n g p r e m i u m payments. P l e a s e
be a s s u r e d that your insurance c o v e r a g e will continue uninterrupted until
you have had a d e q u a t e t i m e to pay on a direct-mail basis. F u t u r e
p r e m i u m notices will be sent on a q u a r t e r l y basis, c o m m e n c i n g August 1,

retroactively if the appeals court upholds the e a r l i e r ruling.

Sunday in J a n u a r y , in a decision
M a r c h 1 by S u p r e m e Court J u s t i c e
Alexander B e r m a n .
B e r m a n ruled that Nassau County's
14,000 employees a r e entitled to the
holidays under t e r m s of the N a s s a u
CSEA c o n t r a c t .
T h e r u l i n g w a s l i m i t e d to t h e
dispute
N a s s a u c o n t r a c t and does not a f f e c t
e m p l o y e e s of the s t a t e and o t h e r
jurisdictions. The ruling put N a s s a u
a h e a d of m o s t j u r i s d i c t i o n s on
holidays f o r the m o m e n t , with 11 stand a r d s t a t e w i d e holidays plus King
Day and F l a g Day.

School district negotiations continue in summer
Although the traditional school y e a r is winding down in anticipation of s u m m e r vacation, the l a b o r - m a n a g e m e n t scene is still ext r e m e l y active all a c r o s s the s t a t e . The a r t i c l e s on this page illustrate
some of that activity.
And a s CSEA Coordinator of School A f f a i r s Arne Wipfler noted in
her " R e p o r t C a r d " column last week, m o r e than 650 non-city school
districts a c r o s s the s t a t e have voting on proposed school budgets
scheduled in May and J u n e . CSEA r e p r e s e n t s thousands of nonteaching employees in those districts, and will be monitoring the
budget ballotings.
Pupils and m o s t t e a c h e r s m a y be looking forward to a long
s u m m e r vacation, but for m a n y non-teaching employees, their union,
and the district administration, t h e r e is no such thing.
Contract
problems
continue
AMSTERDAM - The Montgomery
County Local of the Civil Service
E m p l o y e e s Assn. and the Capital
Region of the CSEA have undertaken
a m a s s i v e media campaign to m a k e
the public a w a r e of the problems they
a r e having settling a contract for noni n s t r u c t i o n a l e m p l o y e e s of t h e
G r e a t e r A m s t e r d a m School District.
The union will buy radio spots and
place ads in local n e w s p a p e r s to
emphasis that negotiations have
been dragging on for months with no
prospect for an equitable s e t t l e m e n t
in the n e a r f u t u r e . The c a m p a i g n will
point out that t e a c h e r aides have gained a total salary increase of 65 cents
over the past six y e a r s and a r e still
below the federal m i n i m u m w a g e ,
w h i l e school a d m i n i s t r a t o r s h a v e
been a w a r d e d increases which r a n g e
f r o m $5,750 to $6,050 during the s a m e
period, and that a f t e r granting a ten
cents per hour increase to the aides
last year, the administration cut back
their hours so that no salary i n c r e a s e
w a s realized.
CSEA is also requesting that the
school board sit in on negotiations " t o
make sure that the professional
negotiator hired by the school board is
doing what the Board wants. We feel
that t h e r e m a y be a breakdown in
communications and that all p a r t i e s
should be present and know what is
being d i s c u s s e d , " said a CSEA
spokesman.
One a i m of the campaign is to m a k e
the public a w a r e that they, too, a r e
being a f f e c t e d by the delay in settling
t h e c o n t r a c t . H a r m o n Swits, t h e
Collective Bargaining Specialist
handling negotiations for CSEA, said,
"When the Taylor law is used as a
weapon against public employees the
public m u s t be informed of m o r e than
just the controversial issues. They
must realize that prolonged
negotiations a r e having an a d v e r s e
e f f e c t on the whole community, not
j u s t t h e s p e c i a l g r o u p of p u b l i c
employees. In a school district this
situation can have an a d v e r s e e f f e c t
on t h e c h i l d r e n a t t e n d i n g t h e
schools."
CSEA opposes Westchester school layoffs
WHITE PLAINS — CSEA-represented non-teaching employees of the White P l a i n s School District have
promised m o r e public d e m o n s t r a t i o n s to protest the planned t e r m i n a t i o n of 60 or m o r e employees at the end of
this school y e a r due to the closing of t h r e e schools and the consolidation of staff.
A related public hearing on the proposed new budget is coming up e a r l y in J u n e and the union, a f t e r having
analyzed the proposed budget c a r e f u l l y , will have s p e a k e r s on the public hearing schedule.

Charles L. J o n e s has declared impasse in the negotiations between the
union and the district for a new contract.
The i m p a s s e was reached a f t e r two
bargaining sessions, when the administration unilaterally abolished
six positions in the district.
The union also filed I m p r o p e r P r a c tice c h a r g e s against m a n a g e m e n t ,
alleging that the abolition of the
positions constitute a unilateral
change in the t e r m s and conditions of
e m p l o y m e n t for the w o r k e r s a f f e c t e d .
Such a change a m o u n t s to bargaining
in bad faith, since the union and the
d i s t r i c t w e r e in t h e p r o c e s s of
negotiating over the abolitions when
the axe fell.
" B o t h this bargaining in bad faith
and the unilateral change a r e in
violation of the Taylor L a w , " noted
CSEA field r e p r e s e n t a t i v e L a r r y
Scanlon. " H o w can they say they
w e r e negotiating in good faith when
we w e r e right in the middle of talking
about it when they unilaterally decided to abolish the six j o b s ? "
PERB orders representation election
HUDSON — The Public E m p l o y m e n t Relations Board has recently
approved the Civil Service E m p l o y e e s Assn. bid to hold a representation election a m o n g t e a c h e r aides and monitors in the Hudson City
School District. Those employees currently do not have a union.
Ballots w e r e mailed the end of May and will be counted in midJune. A special meeting will be held a f t e r the ballots a r e mailed to discuss the election and a n s w e r any questions.
