the CSEA Expansion Commit-

L A Z A R O N T : T h e c o m m i t t e e is
a Howard committee, formed by
the Board of ESrectors and responsible to the Board. In our
last repcH-t to the Directors, we
completely rejected any affiliation with any subdivision of t h e
APL-CIO. However, we did leave
open the exploration of t h e possibilities of some type of affiliation In which CSEA would be
allowed to have its own charter.
I can't stress strongly enough
t h a t this would be entirely different from the type of affiliation t h a t AFSCME is proposing.
However, the Board rejected this

possibility, and as f a r as the
CSEA Board of Directors is concerned, Uie issue of affiliation is
dead. Period.

though the "field work" part of

Arbitration' Bill

ALBANY—A bill that would provide "last binding arbitration" on contracts between the state and unions representing state workers has been introduced in the Senate.
The measure, S-8200, was referred to the Senate Civil
CSEA president Theodore C. Wensl and Assemblyman Andrew Stein (D-L, Manhattan) face representatives of Syracuse-area news media as they announce plans for heartnir in Syracuse of CSEA/Stein Joint
Committee to Investigate Waste and Inefficiency in Government.

ALBANY—The Civil Service Employees Assn. has
formally called for factfinding in current contract
negotiations between it and the
State for employees in the Institutional Services Unit, ending
what CSEA said was a n unsuccessful effort to mediate the situation.
An impasse was declared in the
contract tallcs for the Institutional Services Unit by CSEA in
late J a n u a r y . The State's top
mediator, Harold Newman, director of conciliation for the Public Employment Relations Board,
entered the dispute in early February. Several sessions arranged
by the mediator were held, but
no progress was reported as a
result of those sessions.

dispelled as "strictly an
unfounded rumor and
completely untrue" a story
that legislation is pending
to reduce from the present
30 days to 10 the maximum number of vacation
days an employee can be
credited with for final
average salary pay purposes upon retirement.
"There is absolutely no
truth to that rumor," a
CSEA spokesman said. "It
is true that the State has
such a proposal on the
bargaining table, along
with several other prop>osals to reduce other
benefits, but all those
items are negotiable and,
plainly stated, we will
never under any circumstances agree to those proposals." The union spokesman said the rumor probably started after Donald

In Use Of Pensions

HEMPSTEAD—Two ranking officers of Long Island Region I, Civil Service Employees Assn., testified before a State
Assembly Task Force here to urge employee participation
in pension management to help return state worker confidence in the state's retirement
system.
Nicholas Abbatiello, Region second vice-president, urged the
creation of a state board with
public employee representation
to oversee retirement investments. I^e also voiced CSEA opposition to a state a t t e m p t to
use pension monies to purchase
moral obligation bonds and other
unsecured loans.
The Assembly Task Force on
the Seciu-ity of Public Pension
Funds heard Mr. Abbatiello, testifying in behalf of Irving Flaumenbaum, president of the Region, declare "the use of pension
money for buying moral obligation bonds of different municipalities does not give the retiree
the constitutional guarantee t h a t
monies from the pension f u n d
will be available when he is
ready to retire."
Mr. Abbatiello also restated a
CSEA position t h a t a board of
trustees should be established for
the management of retirement
funds.
"This board would include public employees who are members
of the retirement system. It is
their money and they should
have some say as to how the
money is used," he said.
J a m e s Corbin, president of the
CSEA Suffolk County chapter,
testified about erosion of confidence in the state pension system
among public employees.
"When I became a public employee, 19 years ago, everyone
was envious of the retirement
plan and the security t h a t civil
service jobs offered, despite the

committee is Assembly Bill 8015,
which would require employees

Joseph G. Metz, executive director of the Permanent Commission on Public Employee Pension and Retirement Systems, appointed by Gtov. Hugh L. Carey,
testified at the hearings t h a t
the pension commission will submit a m a j o r report on pension
benefits to the Gtovernor a n d the
Legislature during the first week
In March. It will recommend a
new uniform public employee
pension plan to cover all employees In all counties, cities,
towns, villages, and school districts in the state.
According to Dr. Metz, the new
retirement plan will "result in
savings to every unit of government In the state." Observers say
t h a t the Metz Report will recommend drastically cutting back
pension benefits for those employees who Joined after 1973.
In earlier hearings In Albany,
CSEA's state programs administrator Bernard J. Ryan appeared to spell out the union's "unalterable opposition" to the indiscriminate investment of pension
funds.
Citing Municipal Assistance
Corp. bonds, Mr. Ryan declared

that cannot reasonably be considered sound Is to deprive employees of the confidence t h a t
they have had in their retirement
plan."

s t a f f , its own lawyers, lobbyists,
clerical, r e s e a r c h a n d public r e lations people, a n d would c o n t i n u e t o elect its o w n officers.
Well, we h a v e all these people
now. So w h a t d o we need to
spend $6.6 million a y e a r f o r ?
F o r t h e privilege of holding
h a n d s with t h e m ?
You know, one t h i n g m a n y of
our m e m b e r s d o n ' t realize is t h a t
CSEA h a s t h e best s t a f f - t o m e m b e r s r a t i o of a n y u n i o n i n
t h e c o u n t r y , bar n o n e . W e h a v e

w h a t e v e r t h e y ' r e going to call it.
We've got to get it c h a n g e d so
t h a t it allows t h e union some
o t h e r recourse w h e n n e g o t i a t i o n s
hit a s n a g t h a n to go begging
a t t h e ckx)r of t h e s a m e political
body t h a t they've been b a r g a i n ing with all along.
How, If A F S C M E were really
i n t e r e s t e d In revising t h e T a y l o r
Law. t h e y ' d say t o us, a l l right,
we'll raise & few million dollars,
a n d you raise a few million, a n d
we'll combine t h e m o n e y to t r y
to get t h e law c h a n g e d t h i s year.
T h a t would m a k e a lot m o r e
sense t h a n t a k i n g $6.6 million
f r o m one u n i o n ' s pocket a n d
p u t t i n g it i n t o the o t h e r u n i o n ' s
pocket for d i s t r i b t u l o n t o t h e i r
Washington fat cats and unions
all over the c o u n t r y t h a t Wave
n o t h i n g in c o m m o n with us h e r e
in New York. AFSCME h a s a s
m u c h a t s t a k e in c h a n g i n g t h e
Taylor Law as we do, b u t t h e i r
a f f i l i a t i o n p l a n is certainly n o t
a sincere a t t e m p t t o deal with it.
LEADER: Wouldn't affiliation
bring CSEA a c e r t a i n a m o u n t
of p e a c e — a n d also a savings
of money—because AFL-CIO
a f f i l i a t e s a r e n o t allowed t o
raid one a n o t h e r ?
LAZARONY: T h a t ' s a n o t h e r
of t h e misleading claims by
AFSCME. You've got t o r e m e m ber several t h i n g s . First, CSEA
h a s been tremendously successf u l in raids. W e ' v e withstood
ch'3'llenges by every k i n d of imion
in a l m o s t every political subdivision you c a n t h i n k of. Over t h e
last f o u r years, oiir u n i o n h a s
s p e n t a b o u t $2.5 million i n f i g h t ing off challenges by outside
unions. And g r a n t e d , t h a t ' s a lot
of money. B u t in t h a t f o u r years,
if we h a d been a f f i l i a t e d w i t h
AFSCME, we would h a v e s p e n t
over $26 million in increased
dues a l o n e — s o we've saved o u r selves $24 million these piast f o u r
years alone, by n o t a f f i l i a t i n g
with AFSCME. A n d t h a t ' s a
very conservative e s t i m a t e .
I n t e r m s of t h e expense Involved, it would be m u c h s m a r t e r
for CSEA t o r e m a i n I n d e p e n d e n t
a n d c o n t i n u e f i g h t i n g off AFSCME raids o n oxu- mrantoershlp
as we h a v e in t h e p a s t , t h a n t o
affiliate with them.
Besddes, t h e A F L - C I O ' s a n t l r a i d i n g rule would not a p p l y t o
t h e T e a m s t e r s , who were i n volved with t h e r e c e n t c h a l l e n g e
by t h e Public Employees F e d e r a tion in t h e Professloival, S c i e n t i fic a n d T e c h n i c a l U n i t of s t a t e
workers, nor would it apply t o
o t h e r i n d e p e n d e n t labor o r g a n i zations. w h i c h f r e q u e n t l y t r y to
nald CSEA c h a p t e r s a n d u n i t s .
A n o t h e r m a j o r exception would
be t h e cases in w h i c h a p a r t i c u lar g r o u p of employees is n o t
r e p r e s e n t e d by lany u n i o n a t all.

the truth.
L E A D E R : Aren't CSEA dues going to go up, sooner or later,
anyway?
LAZARONY: T h e y wlU probably suggest a dues Increase of
one dollar a pay period a t t h e
upcoming convention. Even t h e n ,
our dues would still be less t h a n

Time For Reason
the capricious announcement last month by

Donald Wollett, director of the State Office of Employee
Relations, that the Civil Service Employees Assn. was asking
salary and benefits that would amount to a 35 percent increase, a number of editorials were written chastising the
union.
Besides the fact that Mr, Wollet's statement violated
the traditional "gentlemen's agreement" against unilateral
pronouncements by either side during the course of negotiations, there is a more fundamental defense of the CSEA
demands.
We wonder why editorial writers are not just as indignant
about the state's minus negotiating proposals as they are
about the union's demands.
It must be remembered that employees are still living
with the same salary that went into effect on April 1, 1974.
Now, as everyone knows, inflation and taxes have cut drastically into the purchasing power of that 1974 salary. In
terms of purchasing power, state employees are making less
today than they did two years ago.
Nevertheless, the state is repeating its stance of last
year when it refused to grant even a token cost-of-living
increase. Moreover, the state negotiations are based on finding ways to decrease benefits that the union has won for its
members over a period of many years in place of monetary
raises.
It is, of course, traditional in any negotiations that both
sides start with rather outrageous proposals and then compromise to a position that both sides can live with.
Considering the degree of erosion that undermined the
salaries of state employees, we do not find 35 percent to
be all that outrageous.
Yet, obviously, the union will eventually agree to something less, since it does not want to put the state into a
position where it will lay off workers in order to pay the
increases to the surviving employees.
But, if CSEA is expected to be reasonable, so, too, must
the state be willing to negotiate in good faith.
It is an axiom among teachers that you establish discipline with a new class during the first few weeks of a school
term, and then you can relax control during the rest of the
year since authority has been established.
In a similar manner, the Carey Administration might be
forgiven its tough stand during its first months in office,
but now, after a year of seasoning, it is time for the Governor and his aides to learn that the time has come for

from the AFL-CIO and receive

national group. This does not
seem likely to happen, however,
as the AFL-CIO has a clause in
its constitution t h a t a new u n ion c a n n o t be accepted if there
is a present member union covering the same group of workers.

Employees. AFSCME has been
trylivg to link up with CSEA for
a long time. Several representatives of AFSCME were present
during this meeting.
AFSCME has proposed a twoyear trial "marriage." CSEA

per m o n t h required for AFLCIO national dues.

ALBANY—Following an analysis of a statewide study to formulate a program enabling fire officials to provide improved protection, Secretary of State Mario M. Cuomo Q

The survey was conducted by the Division of Fire Prevention and Control in the r
D e p a r t m e n t of State.
Composite ratings of priorities
proposed by fire and municipal
officials reflected five areas of
concern. Mr. Cuomo listed these
as a p p a r a t u s and equipment;
fire training and education; investigation of fires; planning for
fire protection, and emergency
medical a n d rescue.
Mr. Cuomo said he would recommend dissemination of s t a n d ard specifications for a p p a r a t u s
and equipment. He noted t h a t
the New York State Office for
General Services has s t a n d a r d
specifications, and all municipalities In the stiate are eligible
to purchase under state contracts awarded by OGS. While

Cuomo said.
"While comments regarding
t h e programs at the Fire Academy at Montour Palls were essentially requests for expansion,
our response can only be In

resources
and these we have requested in
our proposed budget for 1976-77.
Meantime, the revision of our
field training courses Is already
under way.
" I also will recommend a massive statewide media campaign
recommending the installation of
early warning detection equipment in private homes a n d residences."
I n the area of fire investigation, Mr. Cuomo said his office
is recommending la^ t h r e e - p h a s e
program to combat t h e increasing Incidence of arson. T h e first
phase would be a broad scope
training program for local fire
and police officials. T h e second
phase would establish several
teams of Investigators w h o would
provide technical expertise to local fire a n d police agencies required to obtain arson convictions. T h e t h i r d phase would u p grade arson evidence analysis
and provide 24-hour evidence
analysis assistance.
Changes in t h e federal program dealing with m a s t e r p l a n ning a r e not yet definitive, Mr.
Cuomo said, but he Indicated his
office h a d -already Initiated a n d
assisted with t h e d r a f t of t h e
State Fire Prevention Code which
it Is expected will be promulgated in May.
"Members of my staff intend
to assume a n active role In providing assistance to local fire
agencies to secure adoption of
t h a t code a t the local level. T h e
H e a l t h D e p a r t m e n t h a s primary
responsibility
for
emergency
medical a n d rescue functions in
the state. However, t h e fire services is deeply involved in this
activity a t t h e local level, but
faces problems with t h e enactm e n t of a new Article 30 of t h e
Public H e a l t h Law. We intend to
assist t h e fire service in their
negotiations to secure reasonable

WHITE PLAINS — A new
public service program containing information helpful
to Westchester area senior
citizens will be broadcast weekends by Radio Stations WFAS
and WWYD.
County Executive Afred B. DeBello stated, "The
program
'Westchester 60 Plus' which bears
the same n a m e as the county's
senior citizen's publication, will
keep seniors informed on such
topics as health, housing, employment and special programs
designed to aid the aging."
The shows will be produced by
the Westchester County Office for
the Aging in cooperation with
Station WFAS.
Broadcasts will be Simday at
9:35 p.m. on WFAS. On FM station WWYD, t h e programs will
take place Saturday a t 7:00 a.m.
Mr. DelBello also announced
t h a t the county is starting a
new service to help senior citizens find affordable good homes
and to aid them to remain in
homes where they have resided
for many years.
