She directed department and agency heads to "take appropriate corrective measures immediately" if they were not in compliance with that interpretation. "No authority exists for the extension of such leave benefits to part-time employees who do not work five days per week," Ms. Poston stated. CSEA. however, does not agree. The action was ordered by chapter president James Corbin immediately after he had been notified by county Labor Relations Dii-ector Joseph H. Pasbach of the county's decision. Mr. Corbin declared: "If the County thinks that it can use our increments as a ploy to weaken our bargaining position. it is wrong. We are entitled to increments, and we will pursue the issue with all the legal remedies at our disposal." Mr. Corbin said that federal rulings and the decisions of state courts have repeatedly upheld the right of employees to the benefits of a contract t h a t expires during the course of negotiations. TUESDAY, JANUARY 14, 1975 ^10 High Expectations civil servants (are) t h e most highly trained and " paid," said CJovernor Carey in his State of t h e State Message last week before members of t h e Legislature in Albany. To which we say, " T h a n k CJoodness." I t certainly seems to us t h a t the most highly trained should be the most highly paid. W h a t ' s more, t h e citizens of New York expect their civil servants to be efficient and dedicated to their jobs—and they will expect to keep receiving the same services t h a t they are accustomed to. New Yorkers take pride in being the best and expecting ,the best—whether it is the latest musical comedy aiming for approval of t h e New York City critics or as the source for national leadership (of which Vice President Rockefeller is but the latest example in a long line of New York State Governors who have gone on to become President or Vice President of the n a t i o n ) . I t should be noted t h a t the Governors, as well as t h e rank-and-file of t h e state's civil servants, receive pay commensurate with the greater duties t h a t are required by and for New Yorkers. A New York Governor's salary is greater t h a n t h e combined salaries of the Governors of Maryland, Kansas, Maine and North Dakota. Not only t h a t , but each member of t h e Legislature receives more t h a n the a n n u a l salary of t h e Governor of Arkansas. Frankly, we admit t h a t it is u n f a i r to make these comparisons, because New York is just not any other state. It is, after all, the Empire State. But then, it is u n f a i r to imply t h a t civil servants here are living in the lap of luxury. A minimum wage of $6,000 is certainly not an extravagance, especially in the big cities. While most civil servants do earn more t h a n this minimum, most of t h e m fall within the salary range t h a t used to be regarded as middle class. Again we remind the public t h a t the high-salaried "jobs" t h a t receive so much notoriety are, for t h e most part, political appointments. Governor Carey himself, we are glad to note, expressed his awareness of this when he said: "I intend to eliminate entirely the plague of no-show commissions and bodies, simply and directly. Unnecessary commissions will be eliminated from the budget. Those t h a t perform a needed function will be maintained, but under new circumstances. Their members will be paid for work actually performed. No longer will anyone receive full-time pay for part-time work." T h e Governor's purpose, though, h a s been served in alerting public employees t h a t negotiations this year are going to be tough. He has, at the same time, indicated his willingness to seek solutions to the problems in concert with the unions. Civil Service Employees Assn. president Theodore C. Wenzl h a s already reacted to the Governor's s t a t e m e n t by saying t h a t he, too, is determined to find other solutions so t h a t employees will get salary hikes to cope with inflation, but without sacrificing other employees to layoffs, A strong s t a t e m e n t by the CSEA president would be anticipated in response to the Governor's Message. Yet, both Carey and Wenzl have been careful to make it known t h a t they are looking for ways to work things out. Civil servants throughout the state must be prepared, nevertheless, to show the Administration t h a t they will be reasonable in their demands, but, t h a t as citizens of t h e state, they have the expectation t h a t certain basic bargaining demands be met. (Continued f r o m P a c e 1) of view, he h a s no doubt s h a d owed the picture somewhat in his State of t h e ©tate Message to permit t h e Legislature to let in some r a y of light. Nevertheless, "austere" is the word for t h e message delivered to the Legislature last week. Clearly t h e tone of the message was shaped by Carey's fiscal a n d economic advisers. Its tone gives voice to t h e same alarm a n d pessimism about t h e economy t h a t h a s been the recurring theme of statements e m a n a t i n g f r o m the W h i t e House and the nation's business, industry and laibor leaders. Sense Of Urgency T h e r e was a n urgent quality about the Governor's address t h a t points up its somber tone. Borrowing a n a p p r o a c h f r o m Winston Churchill, who said t h a t he did not become England's Prime Minister to m a n a g e t h e dismemberment of the British Empire, Governor Carey said: " I did not become Governor of this s t a t e to preside over the d i s m a n tling of Its government or of all the programs to help those In need for which we have s t r u g gled these last 15 years a n d more." He expressed t h e hope t h a t t h e "unquenchable energy a n d fire, the creativity a n d quick Intelligence" of t h e people of New York will overcome t h e adversity of economic conditions. I n terms of the state, the Governor noted t h a t t h e quality a n d c h a r a c t e r of public services here are higher a n d more extensive t h a n those In other states. Consequently, taxes here a r e higher t h a n elsewhere. In view of the s h a r p rise in unemployment a n d the s h a r p decline of business activity, Carey said, "the gove r n m e n t of New York S t a t e Is In need of strong action to avert financial crisis." The grim note sounded by the Governor will obviously have wide-spread Impact upon public employees, both of the state a n d of its local governments. P a r t of t h a t Impact will be t h e f u r t h e r erosion of t h e sense of employmeAt security t h a t has long been one of the primary Incentives for people to enter the publicemployment field. This sense of security was badly damaged In 1972, when a tough-minded Legislature forced t h e Rockefeller Administration to Impose a freeze on state hiring, a n d even to close certain Institutions and to c u r tall some services. There Is a n ominous ring, therefore, to his warning t h a t "wage a n d benefit Increases requested by state employees could add h u n d r e d s of millions" to the budget. DetaiU In Budget T h e Governor delivered his message to a Legislature t h a t was organized with dispatch. Assemblyman Stanley Stelngut achieved his life-long ambition upon his selection as Speaker, and Senator W a r r e n M. Anderson was re-elected as the M a jority Leader of the Senate. I t is clear from comments m a d e by both t h a t they were somewhat surprised by the grim picture painted by the Governor and the broad spectrum of retrenchment he spelled out. Arbitration Proceedings Article 75 of t h e Civil Practice Law a n d Rules controls arbitration proceedings in the State of New York. In a proceeding commenced pursuant to Article 75 to vacate a n arbitration a w a r d made between t h e Board of Education of the Harrison Central School District a n d t h e Harrison Association of Teachers, t h e Westchester County Supreme Court granted the petition to vacate t h e award a n d denied the cross petition of t h e Teachers Associatio i to confirm t h e award. The case was appealed to t h e Appellate Division, Second Department. The Appellate Division reversed and dismissed the petition to vacate t h e award a n d confirmed the award which h a d been rendered by the arbitrator. * * * IN THAT ARBITRATION, t h e a r b i t r a t o r was called upon to decide whether the refusal by t h e Board of Education to reappoint a certain school teacher for t h e 1972-73 school year violated the terms of t h e collective bargaining agreem e n t between t h e Association a n d t h e Board of Education. If t h e arbitrator so found, he was to decide what the remedy should be. The a r b i t r a t o r concluded t h a t t h e complainant's services h a d been improperly t e r m i n a t e d a n d t h a t she should be reappointed and recompensed for lost earnings. • * •> AN ARBITRATION AWARD may be vacated solely upon the grounds set f o r t h in CPLR, Section 7511. The petition In this case asserted t h a t the arbitrator h a d exceeded his power. I t was up to the petitioner, therefore, to demonstrate to t h e court either t h a t the arbitrator dealt with m a t t e r s beyond the scope of w h a t h a d been submitted to him or t h a t he gave a completely irrational construction to t h e provisions of collective bargaining agreement which was involved in t h e dispute. T h e Board of Education also raised the o f t e n discussed point t h a t a Board of Education c a n n o t agree to a term or condition of employment which is explicitly and definitively prohibited by statute, relying for its position on the Town of Huntington case which h a s been previously discussed in this column. The Appellate Division held t h a t Special Term should not have vacated the award. T h e arbitrator merely rendered a decision upon a m a t t e r submitted to him under the collective bargaining agreement. There was nothing irrational about his construction of the agreement. * 4< 4> THE COURT ALSO pointed out t h a t the Board of Education was not prohibited by any explicit or definite statutory provision from bargaining as to notice of termination and tenure. An arbitration award may not be set aside because a n arbitrator allegedly m a d e errors of law or fact in his determination. Board of Education, Central School District, Harrison v. Harrison Association of Teachers, 360 NYS 2d 49. down by the Governor. For ex•ample, his call for a 10 percent reduction from the budget of the previous Administration was In reference to "those activities and programs over which I have control." There are, of course, many areas t h a t are m a n d a t e d by law, a n d which would, for the immediate f u t u r e at least, not be affected. He offered to work with union leaders so t h a t "It may be t h a t we can together find other solutions" to t h e alternatives of dismissals and wage freezes. He also stated t h a t efforts would be made to improve the s t a n d a r d s of care for the m e n tally ill and retarded, and said t h a t his budget "will include a greater increase for the D e p a r t ment of Mental Hygiene t h a n for any other d e p a r t m e n t or agency." Other state responsibilities. such as Agriculture and Markets and Health, were also singled out for special mention. T h e precise details of the Governor's fiscal program wiiU be unveiled P o r t l y when he submits the proposed budget to t h e Legislature. It a p p e a r s unlikely t h a t the budget will be slashed as deeply as the Governor suggested a f t e r the Senate Finance Committee and the Assembly Ways and Means Committee have concluded public hearings on the budget. Clearly the Governor will be engaged In active negotiations with t h e legislative leaders, New York City Mayor Abraham D. Beame a n d the heads of local governments and school boards, and with the leadership of the Civil Service Employees Assn. with regard to civil service e m ployee policies. On J u n e 27 the ballots shall be counted and the results made known to the candidates as soon t h e r e a f t e r as •practicable. SECTION E: MISCELLANEOUS 1. On or before May 1, each Chapter President shall receive a computer printout indicating the names of those persons in his chapter who shall receive official ballots. Simultaneously, the chapter president shall receive a f f i davits for replacement ballots in an a m o u n t equal to a p proximately five (5%) percent of the membership listed on the computer printout. 2. T h e independent election agency shall mail the official ballots on or before May 25. The agency should mail t h e m from the largest postal service facility in the six (6) regions or receive assurance from t h e U.S. Postal Service t h a t upon receipt of the ballots at one facility they will be promptly distributed to each region by the U.S. Postal Service. CSEA Publicity Aid Available For Region Nominating Bodies ALBANY—Regional presidents of the Civil .Service Employees Assn. have been notified of the availability of headquarters assistance in publicizing activities of their nominating committees prior to elections coming up early next summer. In a recent memo, CSEA Executive Director Joseph D. Lochner advised t h a t regions seeking assistance should get in touch with t h e public relations staff at the union's Albany headquarters a n d make known their needs. Information Available "Our CSEA public relations dep a r t m e n t will seek to keep our members advised through the Civil Service Leader, and o t h e r wise, as to the nominating and election procedures, and as to the nominations when made, a n d the various deadlines contained within the procedures," Mr. Lochner said. T h e union official pointed out t h a t a guide to the nominating and election process at the regional level Is contained in the model constitution for regions, and copies may be obtained at regional and CSEA headquarters. Independent Nominations Mr. Lochner noted also t h a t forms will shortly bs available for the filing of Independent nominatloi^ by aspirants to regional offices. These will be sent to regional headquarters where they may be picked up by Interested parties. Under Article II of the model regional constitution, nominating committees a r e to be selected by each of the six regional executive boards by J a n . 1 in the year of the election. Each committee then nominates at least two candidates for each position on the regional slate on or before March 1. Candidates are then notified and will have until March 20 to decline. In the event a c-andidate declines and leaves only one person remaining In a given contest, the committee must then nominate another so as to satisfy the required minimum number of candidates. Monroe Water Authority Scores A 2 0 % Increase Plus Larger Medical Plan ROCHESTER—Wage increases totaling 20 percent over the next two years have been won by the Civil Service Employees Assn. for employees of the Monroe County Water Authority. Only the second contract between t h e CSEA a n d t h e W a t e r Authority, it covers about 150 water distribution and maintenance workers. T h o m a s Pomidoro, CSEA field representative who headed t h e CSEA negotiating team, said t h e settlement was reached a f t e r four and a half m o n t h s of negotiations and the t h r e a t of a strike J a n . 1. Under its terms, an 11 percent pay hike became effective J a n . 1 of this year, another 6 percent Increase will take effect J a n . 1, 1976, and an additional 3 percent hike will be paid Oct. 1, 1976. In the contract's second year, the 75-1 retirement plan will go into effect. Also provided will be two more personal leave days; all riders in the Blue Cross a n d Blue Shield plans; the $2 co-pay prescription drug program; two additional vacation days and triple time for working holidays. Coullier, a past president a n d c h a r t e r member of the Black River Valley chapter (formerly Watertown c h a p t e r ) of t h e Civil Service Elmployees Assn., died last m o n t h a f t e r a n illness of several months. Mr. Coullier was a highway general m a i n t e n a n c e foreman with the J e f f e r s o n Residency of Region 7, D e p a r t m e n t of T r a n s portation, joining the Departm e n t in 1946. Prior to being named a general m a i n t e n a n c e foreman in August 1973, Mr. Coullier worked a s a painter and painter foreman with Regional bridge crews. Elected second vice-president of t h e Watertown c h a p t e r in 1957, Mr. Coullier served as president of the chapter in 1958-59 and was often a delegate to a n nual CSEA statewide meetings. He was born in Malone, N. Y., Feb. 18, 1920, t h e son of P r a n k and Mary A. O'Connor Coullier. He served with t h e U. S. Border Patrol from 1943 to 1946. He was also a founder and member of the Watertown Beagle Club a n d a P o u r t h Degree member of the Bishop Conray Council, K n i g h t s of Columbus. Besides his widow, Mary E., he leaves a son, J a m e s L., also a DOT employee; a daughter, Mrs. J o h n T. (Barbara) Dufresne; three grandchildren; his m o t h e r ; a brother; two sisters, and nieces and nephews. Rotterdam Wins 15% Wage Hike And Dental Plan ROTTERDAM — Members of the Town of Rotterdam unit of the Civil Service Employees Assn. signed a twoyear pact with the town that provides a 15 percent pay increase over the life of the agreement. T h e r e will be a n 8 percent in- crease in 1975, and a 7 percent boost in 1976 with increments to be paid to all eligible. T h e contract contains nine newly negotiated items which improve the working environm e n t of the Rotterdam employees. Nassau Chapter Challenges State's Disciplinary Rules MINEOLA—The Nassau chapter, Civil Service Employees Assn. is pressing a federal court case challenging the Section 75 disciplinary rules of the state Civil Service law on Constitutional grounds. The case could have statewide implications. A favorable decision could force the state legislature to rewrite the law to provide for impartial h e a r ing officers a n d pay for any e m ployees suspended from duty pending a hearing. These issues have long been a source of irritation to public employees. The Nassau chapter h a s gained a ruling in Federal Court In Brooklyn establishing a special three-judge panel to h e a r the case. T h e three-judge panel will be composed of one Federal District Court judge a n d two judges of the Circuit Court, a judicial tribunal ranking directly below the UJS. Supreme Court. The Nassau chapter acted a f t e r a CSEA unit leader h a d allegedly been harassed by his superiors 'and repeatedly given Illegal orders to set him u p for suspension. At latest count, the CSEA leader h a d been suspended three times. All the suspensions are under legal appeal by CSEA. Mr. Young, who is chief negotiator for the town's CSEA unit members and an Alden resident, asked the Public E m ployment Relations Board to assign a mediator for f u t u r e talks. Under the current law, the employer is empowered to appoint a member of m a n a g e m e n t to h e a r and determine m a n a g e m e n t charges •against a n employee. In addition, Mr. Stein said the state law violates the right to due process because the law allows a n employer to suspend an employee without pay before a hearing and without presenting any evidence against the employee. Lochner, executive director of the Civil Service Employees Assn., urged CSEA retirees who are eligible for Medicare benefits, and who may wish to enter a nursing facility, "to seek information from reliable sources on t h e facility, to determine if it participates in the-Medicare plan." He cited the story of a retired with the Buffalo Office of Vocational Rehabilitation for public employee who entered a nursing facility for rehabilitation services following a brief period of hospitalization. T h e facility chosen was n o t approved by t h e federal government f o r Medicare a n d t h e retiree did n o t receive any Medicare benefits. Ms. Gormley is active in t h e National Rehabilitation Assn. of Western New York a n d served a s the secretary of t h e group when it was formed. In conclusion. Dr. Wenzl said "State workers can be sure t h a t CSEA is a strong and militant labor union t h a t will not buckle under threats, implied or real.
