The purpose of this Fund is to make available immediate jfinancial assistance to certain individual CSEA members and possibly other State employees who have suffered financially or otherwise as a result of recent actions on their part in behalf of CSEA. It is expected that moneys in this Fund will become available to other employees who may be similarly affected in the be future. It should clearly understood that this Fund will be used only to assist individual employees, not as a source of additional income to support CSEA as an organization. In this respect, CSEA will continue to meet its overall financial needs througli the established procedures defined in its constitution and by-laws. Custody of the funds and its administration is entrusted to a committeeI wish of your eight statewide elected officers. to emphasize that income to the fund will be derived from voluntary contributions from individual CSEA members as well as nonmembers and various groupings within the CSEA structure such as Conferences, Chapters, and Units, etc. and allied organizations associated witli CSEA activities. Projects CSEA Urges OGS Aides Come First in State Hiring ALBANY —A bill before the State Legislature, which would give carte blanche to the Health and Mental Hygiene Facilities Improvement Corp. to hire outside consultants in place of qualified State employees for design and reconstruction work in the Department of Correctional Services, h a s .come u n d e r s h a r p a t t a c k by t h e 200,000-member Civil Service E m ployees Assn. T h e measure, A-11995-a, h a s a companion bill in the S e n a t e and was submitted to t h e Legislature by the S t a t e a d m i n i s t r a t i o n . As presently written, it would give the q u a s i - S t a t e , non-civil service agency the exclusive riglit to determine w h e t h e r o u t side c o n s u l t a n t s or S t a t e e m ployees would be given t h e job to design new facilities or plan the reconstruction of existing sti'uctures in the D e p a r t m e n t of Correctional Services. T h e bill, before being amended, also p e r m i t t e d the corporation to use its own employees to p e r f o r m the work. CSEA strongly protested the wording of t h e original docum e n t , contending t h a t the agen- cy did not have t h e qualified personnel to do this type of specialized work a n d t h a t S t a t e employees in t h e Office of G e n eral Services should h a v e f i r s t r e f u s a l on a n y job to be u n d e r taken. CSEA brought t h e case to the arbitration stage in behalf of a member of the CSEA Syracuse Division T h r u w a y c h a p t e r who h a d been hired by the T h r u w a y Authority as a trainee with the proniise t h a t he would receive a n i n c r e m e n t a f t e r a h a l f - y e a r of employment. T h e c o n t r a c t h a d been voted earlier by t h e Suffolk County Legislature, which m a d e m i n o r revisions to a salary plan r e c o m m e n d e d by a f a c t - f i n d e r . T h e new graded salary p l a n reduces f r o m eight steps to six t h e p r o gi-ession to bop pay. I t provides i m m e d i a t e pay boosts for all employees a n d a d ditional pay for some on July 1. T h e senior employees at step e i g h t will receive 5 percent i n creases. T h e c o n t r a c t is retroactive to J a n . 1. This is a significant revision in CSEA policy and represents t h e culmination of years of h a r d work by make specific requests for c h a p t e r formations, such requests in a county meet certain membership requirements a n d m a k e specific requests for chapter formations, such request will be considered by t h e charter committee. I have followed (and supported) this constitutional change for several years, both in my chapter and on t h e County Executive Committee. T h e only significant opposition I ever knew of was based on two questions: 1. Can school districts produce the leadership a n d volunteers needed to be effective chapters? 2. Will two chapters per county produce a split In t h e ranks of CSEA? These are crucial questions. Actually, t|ie key to success in school district chapters will be the appearance of dedicated effective leaders, leaders able to develop volunteer help and able to increase membership. With good leadership t h e second question of unity need never be a factor. All of us should, however, u n d e r s t a n d the importance of unity. Unity among state workers, city workers, school a n d county workers is and always will be the cornerstone of our organization. * * * IN THE MEANTIME, t h r e e developments are lending themselves to the establishment of school chapters. First, m a n y counties have already set up school "councils." These councils consist of representatives from each organized school unit; they elect officers and meet to discuss matters of mutual concern. Through these councils Chapters are made aware of problems common to school districts, and t h e solutions can often be undertaken in a multidistrict way. Certainly there is the embryo of leadership in the Council Officers. Concurrent with these councils, the parent organization h a s developed an ad hoc committee covering school districts. Some time ago I wrote t h a t committee functions for political sub-divisions might best go this way—committees made u p of specific groups (social service employees, probation officers, etc.), whose function will be to identify and describe problems and to offer solutions pertinent to t h a t group. I t is the intent of the County Executive Committee to give each of these committees the fullest possible consideration in receiving reports and acting on recommendations. The third event is the developing awareness t h a t school districts should be recognized on a regional basis. Bills have been submitted (A5657 & S5013), in the State Legislature for this very purpose. In terms of negotiations, the regionalization of school districts and formation of a school chapter go h a n d in h a n d . School units have an immediate opportunity to show all of us what they can do. The current Super-Sign-Up Drive offers a real chance to demonstrate the qualities needed for a successful chapter. Their effectiveness in garnering new members could tell us a lot about the future of school district chapters. TUKSDAY, MAY 2, 1972 Pi Ui iTi Clearing The Air E Wish to congratulate the New York Daily News, the Albany Knickerbocker News and several editorial writers throughout the State for outstanding reporting jobs t h a t should do much to dispel the swollen picture of public pensions for the rank-and-file civil servant. W What these stories and editorials have done is to illus t r a t e the gulf between the pension benefits of elected officials and the ordinary public employee. This should do much to help reverse the majority of public opinion which, in recent months, has held t h a t civil servant pensions are a n outrage on the public purse. Few of the State's 150,000 workers, for instance, will draw a pension higher t h a n $4- to $5,000 a year, at best. T h e astronomical pensions—ranging from $10,000 to $20,000 a n d up—are gained by people in office who can vote themselves such benefits. Congressman Ogden Reid, of Westchester County, also added another note to the debate on civil service pensions. He pointed out t h a t for decades, public employees' salaries were rarely on a par with similar pay for similar work In the private sector. Decent pensions, he noted, were Instituted to make up for years of being underpaid. All In all we see a about public realization servant should not be t h e extravagant abuses hopeful trend, one t h a t may bring t h a t tne average, hard-working civil punished in retirement because of of a privileged few. Status Of Correction Officers A recent decision of the Appellate Division of the Supreme Court, Second Department, h a s a f f i r m e d without opinion the holding of t h e Nassau County PERB t h a t correction officers are not entitled to a separate negotiating unit in Nassau County. The petition In t h a t case was filed by the Correction Officers Benevolent Assn. (COBA) which h a d changed its- n a m e from Sheriff's Office Benevolent Assn. (SOBA) after a previous unsuccessful a t t e m p t to obtain a separate negotiating unit. I n substance, the petitioner claimed t h a t the working conditions of the employees in the unit requested are unique a n d similar in m a n y respects to t h e duties imposed upon members of the Nassau County Police Department and t h a t their duties are unrelated to duties performed by other employees of Nassau County except those performed by members of t h e Nassau County Police Department. BY ITS DECISION of Sept. 4, 1968, and related decisions made at or about t h a t time, Nassau PERB established the policy of certifying separate negotiating units for t h e Nassau County Police Department and for Community C o l - • lege personnel, both subject to some qualification and one single over-all unit for the balance of t h e County employees subject to specified exclusions. I n t h e report of the hearing officer of Aug. 7, 1968, it was found t h a t there was a community of interest between t h e employees of t h e Sheriff's Office (SOBA) including those employees in the unit now requested by the successor association of SOBA and the single over-all unit of Nassau County employees. This Included similar hours, working conditions and the use of a county-wide grievance procedure. I t was also reflected In the f a c t t h a t all employees in t h e county-wide unit a r e # covered by a similar h e a l t h plan, retirement plan and n u m ber of personal leave days. I n like manner, questions of salary and retirement benefits m u s t be approved by t h e County Executive and Board of Supervisors. I t was also found on the basis of the entire record of hearing, t h a t CSEA has participated exclusively in a traditional negotiating p a t t e r n with the County of Nassau In the exercise of its right of representation of employees in the presently certified unit. I t was f u r t h e r found t h a t all the incidences of employment relating to salary, fringe benefits and other general conditions of employment are county-wide in appli- # cation a n d t h a t t h e historic p a t t e r n of Informal negotiations seems entirely compatible with t h e joint responsibility of the employees and t h e administrators of the County to effectively perform their respective obligations to serve t h e best interests of t h e people of t h e County of Nassau. This report was confirmed by PERB. The present petition presented nothing new to change t h e policy established by PERB in Its 1968 decisions. Lindsay last week ordered the delay of "pink slips" which were to have been distributed yesterday to 977 City employees. The layoffs would have brought the layoff total to 1,067, t h e figure predicted late in March as necessary because of S t a t e cuts in matching funds to City programs. Pending the outcome of State action on the City's budget crisis, no steps have yet been taken on t h e Mayor's t h r e a t of payless furloughs of City employees, including teachers. Mayor Lindsay, Budget Director David Grossman and other City officials have been in Albany lobbying for $227 million in S t a t e aid to balance the City's $10 billion budget for 1973-1974. With little hope of t h a t m u c h in outright aid, t h e City is said to be negotiating with the S t a t e for the O.K. to finance operating costs from the capital budget and for borrowing power of $400 million. T h e Lindsay administration has also asked the CTity Council to approve increased nuisance taxes to produce anotlier $141 million. "New York City's budget situation remains critical," t h e Mayor said after announcing the postponement of layoffs. "If our city is to avoid additional cutbacks in personnel and services on top of the severe attrition cuts already imposed in the 1971-72 and the 1972-73 budgets, these two legislative bodies must act now." April 1 a union was born in New York State." Thomas McDonough, CSEA first vice-president, told of the birth of CSEA, offering fiery comments on the job action subject when he addressed the more t h a n 200 Conference delegates. "We're going to be stronger in the long run. T h e last few weeks did more for CSEA t h a n anything we've done in the last 20 years," McDonough said in explaining the two-day work stoppage against New York State April 1 and 2. He told the delegates in his after-dinner speech t h a t the State prodded the CSEA into not working "by refusing to bargain in good faith." "The State caused this. The State actually drove us into this job action," he added. T h e words "job action" also prompted some emotional oratory at the afternoon meeting from William McGowan, CSEA fourth vicepresident and Mental Hygiene regional representative. "You can use any d a m n word you like," McGowan said when he was asked what CSEA's official terminology was on the work stoppage. "As f a r as I ' m concerned," he added, "we went out. The State of New York was going to rape us clear and simple and withput any provocation on our part if we didn't stand up.
