A 15 percent, across-the-board pay raise for all State
employees, improvements in the pension benefits of both
State and local government employees and proposals for
vast reorganization of the Civil Service Employees Assn.

Winds Of Change Sweeping CSEA
By 1973, the name will still be the same but the structure of the Civil Service Employees Assn. will undoubtedly undergo some radical reorganization changes by that time.
It's not that there Is revolution in the air but, rather, evolution toward an Employees
Association which will become more and more decentralized.

only be dismayed by actions
throughout the country which

public employee pension improvements, delegates cheered
proposals on such improvements
presented by Ernest K. Wagner,
chairman of the pension committee.
One of the most heavily debated topics at the coi^vention
was the restructuring of the
Employees Association. A. Victor

Service Employees Assn. succeeded in m o d e r a t i n g t h e most
inequitable phases of t h e Rockefeller Administration p r o g r a m .

City revenues saved t h e jobs of
t h o u s a n d s of employees whose
livelihoods a n d careers
were
t h r e a t e n e d by a Lindsay Administration economy axe.
Harsh Discrimination
The Nixon Administration a p proach t o its civil service e m ployees is so palpably discriminatory as to m a k e it Immoral.
Salaries a n d wages of all e m ployees, according to a decree of
t h e Nixon Administration, a r e
frozen for a period of 90 days
ending Nov. 13. However, with
respect to Federal employees, a
six percent wage increase s c h e d uled to take effect on J a n . 1,
1972, h a s been deferred to J u l y
1, 1972. I n addition, t h e Nixon
Administration will reduce F e d eral employment
by 100,000,
hopefully by a t t r i t i o n but by f i r ing if necessary. W h a t is especially unconscionable about deferring for six m o n t h s t h e F e d eral salary increase is t h a t t h e
increase was recommended, a f t e r
exhaustive s t u d y by a special
commission, as a n essential first
step towards bringing public e m ployee salaries to p a r i t y with
salary a n d wage scales prevailing in t h e private sector.

civil servants in the S t a t e havfi
been organized by varying e m ployee organizations, Helsby said
some 6,000 pacts have been
reached under Taylor's provisions, "with only one r e p r e s e n tation strike."

t h e "most appropriate u n i t " for
t h e diversity of public employees occupations.
H e went on to predict t h a t
t h e question of breaking a n i m passe would occupy center stage
i n labor relations in t h e years

be to try to get disputes settled without resort to a strike.
Besides strike action, Helsby
pointed to two
alternatives:
third-party arbitration and Taylor Law procedures. T h e a r b i t r a t i o n process "is n o t looked
on with great favor by either
side" and, in fact, preceded t h e
well-publicized Montreal police
strike since t h e policemen r e jected the terms of the A r b i t r a t or a s u n f a i r .

new provisions s t a t e t h a t the i n c u m b e n t union Is given protection f r o m challenge for only a
single contract, u p to three years.
At t h e end of t h a t period, a r e p resentation challenge m a y be
m a d e a n d a new election held.
T h i s compromise, h e said, takes
into account "both the desire
for stability a n d e n h a n c e d d e m ocracy" f o r t h e employees r e p resented.

employees organizations or to
be represented by them in negotiations.
T h e issue is sure to be litigated,
on a title-by-title basis, suggested Lefkowitz, stressing t h e p r o viso t h a t no employer m a y t a k e
the individual action of exclusion. "Only P E R B or one of the
m i n i - P E R B S may do so, a n d
a f t e r a n unchallenged r e p r e s e n t a t i o n period is over," the
counsel emphasized.
T h e Legislature h a s also altered t h e laws so t h a t elections
c a n n o t be stayed arbitrarily,
to give t h e challenging union
more time to g a m e r votes when
they feel their position is weak.
H e pointed to the ruse of the
T e a m s t e r challenge to CSEA is
Babylon, w h e r e a f t e r forestalling t h e vote several times, the
T e a m s t e r s were b e a t e n anyway.
Section 205 now provides all

Under improper practice p r o cedures formerly, P E R B h a d to

slowed t h i n g s down considerably, o f t e n deliberately.

He stated t h a t usually such
cases would drag on ti'om four
m o n t h s to a year's time, c r e a t ing a "volatile situation." Since
m a n y people depend on the f i n a l
verdict, the law now moves t o ward expediting t h a t decision
more realistically.
Another provision declares t h a t
a h e a r i n g involving a f a c t - f i n d er m u s t be public. Previously,
closed-door h e a r i n g s made it
difficult for a f f e c t e d employees
to learn the real issues a t i m passe.
O n the m a n a g e m e n t c o n f i d e n tial u n i t s t a t u s of employees,
Lefkowitz outlined the sequence
involved. T h e employer r e q u e s t ing persoiis for this designation
m u s t file with P E R B 45 to 75
days a f t e r the fiscal year begins,
or within 30 days a f t e r the u n challenged representation period begins.

HEN President Nixon ordered his National wage and
price freeze order, no one was harder hit than pubhc
employees. Federal workers got an extra hard blow when the
President announced that wage increases due them were to
be delayed for six months, not the three months ordered
for employees in the private sector.
This blatant discrimination against civil servants has
been continued in other areas, as well.
We were happy to observe, in face of this economic war
against public employees, that the New York State Civil
Service Employees Assn.—representing 200,000 State and local government workers—has refused to bend to such highlevel pressure and mapped an all-out drive to obtain a 15
percent pay raise for State workers in forthcoming negotiations and to press for substantial improvements in retirement benefits.
The Employees Association has every right to do battle
for these two goals. The railroads, printing and building
Industries, some sections of the steel industry and a host
of other private employee unions had concluded wage pacts
ranging from 32 to 49 percent prior to the freeze. This Is
really the area the President was setting up for a major
target. He had no call at all to take svich devastating action
against public employees whose wage hikes have been nowhere near those gained in the public sector.
As for pension improvements, a Legislature which voted
Itself such lucrative pensions has no moral right whatsoever to try and stall civil service ambitions for equal
treatment.
The Civil Service Employees Assn. has mapped out justifiable and economically sound goals and we wish them
every success in the coming year.

THE TAYLOR LAW has attempted to provide for stability of employee representation through a procedure of
certification and recognition of employee units and unit
representatives. There are, however, four problems of adjustment of units. The four problems are as follows:
(1) ONE GOVERNMENTAL unit is taken over by another.
(2) A GROUP OF employees without a unit properly
should be included in another existing unit.
(3) A JOB TITLE is abolished after certification.
(4) A NEW JOB title is created after certification,

1. WHEN ONE governmental body takes over the ongoing operations of another governmental body, it has
been held that the employee representatives in the government which remains shall be the surviving organi- i
zation, and the new employees shall be added to such
survivor. In this manner, the accretion doctrine of the
private sector was applied to the public sector. The most
appropriate unit was determined by using the standard
of joint responsibility of the public employer and its employees to serve the public, considering administrative
convenience and minimizing the number of negotiating

THIS DECISION leaves open the problem of unit determination if instead of a merger, governmental operations are spun off to a new governmental entity such as
a special district or public authority, cf. 2 PERB 5007.

2. THE SITUATION where a group of employees who
are not in any unit should be most appropriately in an
existing overall unit, has been considered by State PERB.
The Board has taken the position that the non-unit em
ployees cannot be added to the existing unit because th
would violate the existing representative's right to exclusive and unchallenged recognition.
THUS, THE NON-UNIT employees must wait until
the period of unchallenged representation status expires
and then file a timely petition for certification into this
most appropriate unit before the case can properly be
brought before PERB. Matter of Great Neck Board of

A CONTRARY position was taken by a hearing officer
of Nassau County PERB with regard to part-time facultj^^
in Nassau Community College. His position was that In
balancing the employees' right to representation against
the employee organization's right to unchallenged recognition, that the non-unit employees should immediately
be added to the existing unit.
THE EMPLOYEE organization would be required to )
represent such employees even though it did not desire
to have them in the unit. He pointed out that if the employee representative did not properly represent the employees, then the County, under PERB rules, could petition
for an immediate decertification on the basis of abandon^
ment, and in any case, the issue of representation coultt
be decided at an election held when the existing employee
representative lost its period of unchallenged recognition.
3. MOST RECOGNITION and certifications refer to
employees by civil service titles rather than job descriptions. It is not uncommon during the period of unchallenged recognition that titles are changed. The change
may be either by elimination of the job or the job is placed
under a new and comparable title. There are no reported
decisions in this situation.
IT WOULD APPEAR that since there is no substantlv?
change, and that PERB is not in any way bound by civil
service titles, that a unilateral petition to PERB by either
the employer or the employee organization should be
permitted to amend the certification.
4. DURING THE PERIOD of unchallenged recognition,
new jobs may be created. There are no repwrted decisions
on this subject. Cpunsel for PERB has taken the position
that unilateral changes are not permitted during the
period of unchallenged recognition, 2 PERB 5012. It would
appear that the alternatives are the same as those t h a ^
exist in problem No. 2 already discussed, i.e., immediate
placement in an existing unit or no representation until
unchallenged recognition expires.

Despite a proposed pension study by the State Legislature that may stall retirement improvements, the Civil Service Employees Assn. forged ahead with plans to
bring pensions up to date through a series of 22 proposals adopted (for information purposes only) in full session of representatives to the 61st annual convention of the CSEA.
Ernest K. Wagner, chairman
of the pension committee, presented the committee report to
the delegates assembled in the
Main Ballroom of the WaldorfAstoria Hotel in New York City.
"The committee made every
effort," Wagner explained, "to
find items which would be of
greatest benefit to the majority
of our members. Proposals which
would not be of maximum benefit to the members of the Association were rejected."
He also explained t h a t a commission has been created by the
Governor to study public employee pension a n d retii'ement
systems.
" I t is within the power of
this commission," Wagner pointed out, "to make recommendations to the Governor and
the Legislature concerning pension benefits for public employees. The CSEA pension committee feels t h a t the recommendations of this commission
shall have no effect upon our
collective bargaining right or dem a n d s made through tlaat same
process."

minimum retirement age or
minimum service requii'ements.
R-2—Provide the option, at
time of retirement, for withdrawal of annuity contribution.
R-3—Provide full loan privileges from the annuity saving
reserve.
R-4—Base the pension reserve
which is payable under the death
gamble on the formula for service retirement.
R-5—Provide cost of free retirement credit for all employees who sei-ved in World War
II. the Korean War, the Berlin Crisis and the Viet Nam
Crisis.
R-6—Provide retirement credit
for members of the Retirement
System who have a t least 10
years of niember service with

meetings conducted by Asseanbljman Robert
Wertz throughout the State. (The next meeting
of this Mental Hygiene investigation committee
is slated for Middletown.) I n a motion introduced
from t h e floor by Joan Shaw of Brooklyn State,
the delegates to the Mental Hygiene departmental
meeting voted to seek penalties against CSEA
members who failed to adhere to job action as
agreed to by the Association governing bodies.

UTICA—The CSEA's Oneida County chapter, following
the advice of the Central Region Political Action Task Force,
has made four endorsements in the primary elections this
week, with a promise of more to follow for the general elections on Nov. 2,

special needs of public employees."
The political action committee
has been studying the Issue of
political endorsements since it
was formed, about a month before the deadline set for the
June 16 Statewide strike. The
committee is preparing for next
year's State legislative elections
by compiling voting recoids on
each of the assemblymen and
senators on those issues critical
to public employees. Ratings of
each incumbent legislator will be
available to aid chapters in determining whether or not a
given lawmaker h a s been consistently voting in line wlUi

Statewide Structure
Background
T h e CSEA Is presently divided into w h a t Is k n o w n as six
Conference Areas. I n each area,

Conferences a n d t h e C o u n t y
Workshop e a c h receive $1,500
per year p a i d quarterly by CSEA. E a c h affiliated c h a p t e r Is
assessed c e r t a i n dues and all Income is used f o r administering
Conference a f f a i r s .

Proposal A
(1.) T h e Association shall be
divided into six areas as presently exist, e a c h area to be
known a s Region not a C o n f e r ence.
(2.) E a c h region shall be u n der t h e direction of t h e regional president.
(3.) E a c h region shall have
Its own respective regional o f fice a n d s t a f f as approved by
tiie Board of Directors of the
S t a t e Association.
(4.) T h e staff shall be under
t h e supervision of the regional
office m a n a g e r presently known
as regional field supervisor.
(5.)Each office shall be s t a f f ed with a regional research a n alyst, regional public relations
representative, regional political action a n d legislative analyst
a n d a p p r o p r i a t e clerical s t a f f .
All regional fieldmen a n d assist a n t fieldmen shall work f r o m
a n d report to t h e regional o f fice.
(6.) Legal r e p r e s e n t a t i o n shall
be selected by t h e following p r o cedure:

to be decided, a n d M i d - H u d s o n
Region office, to be decided.
If a Region, due to geographical area, deems i t necessary, it
m a y petition t h e b o a r d of directors f o r approval for a d d i tional satellite offices.
(9.) For proper administration,
communication a n d adherence to
Association policy, each respective regional staff representative
shall be deemed to be p a r t of
the
Association
Headquarters
s t a f f . For example: t h e regional public relations representative
shall be p a r t of t h e public relations u n i t in h e a d q u a r t e r s ,
t h u s being familiar with the general public relations p r o g r a m
a n d reporting of t h e Association.
(10.) T h e elected regional president (elected only by members
within their region) shall be
automatically vice-presidents of
the Association.
(11.) E a c h region shall have
w h a t is to be called a regional
executive board.

Suggestion: T h e r e were over
27 d i f f e r e n t suggestions c o n c e r n lag Board m a k e u p . Some w a n t ed larger, some wanted smaller.
However, the key principle here
is t h a t of complete a n d f a i r
representation regardless of size.
Proposal B
(1.) T h e voting m e m b e r s of
the board of directors shall be
the president, executive vicepresident, secretary a n d treasurer.
(2.) T h e six regional presidents
to be known as vice-presidents.

Committee: At least one m e m ber f r o m each county h a v i n g
a m i n i m u m m e m b e r s h i p of a t
least 250 a n d one additional
m e m b e r for each 10,000 m e m bers. T h e C o u n t y
Executive
Committee shall select f r o m its
membership one director to r e p resent counties not having t h e
m i n i m u m membership.
(5B.) T h e County Executive
Committee shall select f r o m its
membership one director to be
known as the c h a i r m a n of t h e
County Executive Committee.
(6.) T h e S t a t e Executive Committee shall consist of one m e m ber f r o m each S t a t e d e p a r t m e n t
having a m i n i m u m membership
of at least 250 m e m b e r s a n d
one additional d e p a r t m e n t r e p resentative for each 10,000 m e m bers.
(7.) T h e S t a t e Executive Committee shall select f r o m Its m e m bers one director to be known

Statewide Association election:
(1.) All officers are to be elected for a period of two years.
(2.) All Statewide elections

a n o d d - n u m b e r year a n d all o f ficers a n d S t a t e Executive m e m bers be installed prior to J u l y 1
of t h e same odd-number year.

report of Jacobs' committee follows:
" T h e salary program of the
Civil Service Employees Association, Inc. Is one which calls fo»r
a salary level for all State e m ployees which will provide an
average salary at least equivalent to t h e average earnings of
non-State employees within New
York S t a t e a n d result in tive
maintenance of a n adequate
standard of living. I n order to
acoompllsli this, two factors are
hlglaly significant and siiould be
used as gxildelines in determitiIng what our salary demand
should be for State employees
this year. These factors are: (I)

IC—(Deleted) In order to provide a take-home pay increase of at least 5.2 percent, the CSEA should
sponsor legislation or negotiate with the administration to sponsor legislation which would permit
and result in a contractual
agreement wherein the
State would pay the employee's share of
the
FICA payroll tax.
ID—That the CSEA take all

Final Review
The committee reconvened on
Sept. 8 to review its final report
to the delegates and evaluate t h e
effect of
President
Nixon's
Wage-Price Freeze on public
employee salaries generally and
its recommendations in particular.
The committee noted t h a t Its
recommendations are for full
implementation on April 1, 1972.
The contracts between the S t a t e
and CSEA expire on M a r c h 31,
1972. The 13'/2 percent compounded two-year increase, with
a $1,275 across-the-board minimum, provided by those contracts currently in effect, h a s
been fully realized and is u n a f fected by the President's freeze
of wages. T h e committee's proposals are similarly not affected
by the 90-day moratorium on
wage increases, as they would
not be implemented imtil April
1, 1972, a date f a r beyond the
expiration of the 90-day period.
"Dr. Wenzl h a s communicated
with Secretary of t h e Treasury
John B. Connally a n d the Director of the President's Cost-ofLivlng Council, William I. C?reener, to insure adequate consideration of proposals to protect our
membership against t h e continuance of u n j u s t and discriminatory controls over S t a t e employee
salaries, as well as a provision
for exemption for local government employees, against whom
t h e freeze has worked a n u n j u s t
and unfair hardship.
"The committee feels t h a t Its
proposals are therefore fully
consistent with the 90-day order
of the President currently in effect and any fairly and justly
taken f u t u r e action."

C. Wenzl, Statewide president of the Civil Service
Employees Assn., said last
week that Administration representatives have reportedly "misled many CSEA members in
the m a t t e r of the proposed designation of certain State employees as 'management and confidential,' thus removing them
from tlieir present bargaining
units.
Many of our people have been
advised to discontinue membership Immediately, because the
State nas incorrectly told them
that they will soon be ineligible.
Wenzl emphasized the fact

CSEA member to discontinue
membership at this time. This
