J . Allyn Stearns presided. More t h a n 100 delegates were present. Three field representatives, of the Afisociation were there, too: Charles L. Culyer, who spoke; Jack Kurtzman, and Ernest A. Conlon. All three cover both County Division and State Division chapters. John J. Kelly Jr., assistant counsel, and Philip Kerker, public relations director, spoke, too, and President Jesse B. McParland sent a message of welcome, since at the time laryngitis prevented him from speaking. Kelly Gives Le)f>:al Information Mr. Kelly discusses the five-day week, methods of attainment, controverting union recognition, revising work niles and the relation.ship of such rules to other considerations, such as allowances for auto travel. Achievements Noted Mr. Culyer referred to the agenda of the first meeting of county chapters, in October, 1947, over which J. Leslie Winnie, then president of the Chemuiig chapter, presided. The «<igenda consisted of a nine-point program. Mr. Culyer read from the record: 1, .stabilization of salaries; 2, improved working conditions; 3, improvement of the retirement law; 4. operation of a true five-day week; 5, better .salaries and working hours for non-teaching school employees. "Those were the first five objectives," he said. All have been achieved. But it was no accident. Positive energetic efforts by the County Division chapters and officers, and by officers, committees and other representatives of the Association com- blned to produce these notably successful results." He praised the Association's policy of subsidizing, through its membership committee, attractive factual material for membership campaigns by chapters. "The A.ssociatlon is determined to keep up-to-date," he added, "its approach to membership problems." Galpin Talks On Raises F. Henry Galpin, salary research consultant on the Association staff, explained the services rendered by the Association on salary matters, and gave an expert insight into the methods to be pursued to achieve results. The Association furnishes the chapters with a kit on the subject. Including comparative pay statistics of jobs in other counties and in other governmental jurisdictions, as well a.s in private industry. The audience listened with closest attention while Mr. Galpin detailed a tested step-by-step process for obtaining pay increases by negotiation, and recommended t h a t Intensive efforts should be begun by all chapters when the Association year starts. (It started the next day.— Editor.) A .schedule of appearances before Board of Supervisors, Common Council, or other legislative body, was stressed as a vital necessity. Mr. Galpin answered questions for an hour and a half. Resolutions were adopted by the County Division at its September meeting, and forwarded to the Association's resolution committee. All the county resolutions were favorably reported by the committee, and all were adopted at the Association's a n nual meeting, which followed the County Division conference session. Anniversary December 15 The County, Division will be seven years old on December 15, 1953. Its membership increased again this year and, as of September 30 last, was 10,569. ALBANY, Oct. 19 — J. Earl Kelly, director of classification and compensation, State Department of Civil Service, announced the upward reallocation, by three grades, of two titles. Assistant director, antitoxin, serum and vaccine laboratories, was raised from G-37. $8,013 to $9,588 total, to G-40, $8,800 to $10,375, effective September 16, 1953. Chief hydraulic engineer, G-9, J.538 to $10,113, was reallocated to G-42, $10,733 to $12,521, effective October 1, 1953. Two other titles were raised through reclassification. Senior X-Ray Technicians Lose An appeal for a salary increase, made by senior X-ray technicians, was denied by the Division. The employees are now in the G-10 ^rade, at 3,411 to $4,212 total. As guests were Lester Crick of Albany, Deputy Superintendent of Public Works; Warren Welch, per• o n n e l a d m i n i s t r a t o r ; W m . Kelcy of the State Department of Civil Bsrvice, Division of Classification and Compensation, and two of Mr. Kelcy's assistants. The guests a n swered puestions from the floor. The principal problems: Pay Cuts 1. Reclassification of per diem employees to an annual basis has resulted in pay cuts, particularly in District 10, ranging frorn $110 to $700 a year. Those cut $700 or nearly that much resigned. The cuts re.sulted f r o m the higher per diem rates preTailing on Long Island, in private industry. t h a n elsewhere in the State, and, the State had to come somewhere near them, for reasons of competition. So the chapters want a grade differential to be established geographically, to bring the pay of those who stayed, at least up to their previous pay. This would Invoke the Kime principle as the Commission applies to hiring stenographers and typists In New York City at a higher entrance rate t h a n obtains in State employ elsewhere, and is believed to be attainable administratively. Titles include maintenance helper, maintenance man, equipment operator, and tree pruner. Upward reallocation is sought. In Districts 5 and 8 there have been fewer instances of such marked disparity. Correct Evaluation of Work 2. Truck drivers, equipment operators, and light maintenance foremen are all In the same grade, G-5, though the titles represent unequal degrees of responsibility, no higher pay is sought for those performing the more responsible work. Safcffuard on Reclassification 3. A new law is sought, to safeguard per diem employees' pay being cut, on reclassification, in line with the protection afforded to annual employees. Subsistence Pay 4. An increase to $3, from present $3.75, is sought, for daily subsistence. Now any one working on construction tion more t h a n 25 miles from headquarters may choose between $3.20 a day travel expenses. If using his own car, and $3.75 subsistence to live near the construction job. Few choose the $3.75, since it's far from enough to pay expenses, but more would, especially those who have no cars, if the subsistence rates were raised. No travel expense goes with the subsistence rate. Any subsistence selector would either get a lift home or be Impossibly distant from home. Engineers are affected by this situation. Auto Travel Rate 5. An increase in auto travel rate, to 10 cents a mile, from 8, Ls asked. Reclassification Completion 6. Reclassification of titles omitted from this undertaking to date, is a n other request. Some maintenance men have not been reclassified, nor h a v e . ^ r i l l rig operators, but Civil Service Department, pleading a heavy load of tasks, expects total completion by April 1. More Titles 7. Additional titles, to fill the gap existing in all districts, are regarded as imperative, and Mr. Welch volunteered t h a t the Public Works Department will request new ones for next year. Holiday Pay 8. Per diem employees want holiday pay. They get the same vacation and sick leave as annual employees and insist there should be no discrimination as to holidays, either. William A. The County Division held the largest conference in its histci-y. With J, Allyn Stearns presiding, the delegates heard Association functionaries describe various phases of their operations ut the local levels of government. A Memorial Plaque was dedicated In Association headquarters, with Francis A. MacDonald, former chairm a n of the Southern Regional ConXerence, making tiie presentation. J. Raymond McGovern, Compntroller of the State, described the new Social Security program, pointing out its essentially humane features and at the same time recognizing its inadequacies. At a later meeting, a n address was made by Gene Robb, publisher of the Albany "TimesUnion," on the relation of the public employee and the press. Internal Organization The delegates gave renewed consideration to matters of internal organizational operation. Two amendments to the CSEA constitution, which would have enabled the amendment of chapter constitutions by the board of directors, were tabled for the second time. Another tabled section dealth with the problem of voting by proxy. The question of what constitutes a quonim at Association meetings was clarified by vote of the delegates, who set one-third as the figure. This section will be voted upon again at the next Association meeting, and if approved then, will become part of the Association constitution. A section which would have forbidden a candidate from ruruiing for more t h a n one office at the same time was lost. Another amendment, concerning withdrawal of a candidate, was ordered changed, and will be presented again to the delegates. Tliese jobs h a d two special f e a tures that made them d e s i r a b l e security, a n d even m o r e i m p o r t a n t , a pension on r e t i r e m e n t . For these benefits, people o f t e n were willing to forego t h e h i g h e r salaries t h e y could c o m m a n d in p r i v a t e i n d u s t r y . T h e y m i g h t be depriving themselves of luxuries, b u t t h e y could meet t h e i r i m m e d i a t e needs a n d p l a n on a s a f e future. Tliose days are gone. I n literally t h o u s a n d s of cases today, city e m ployees find t h a t c o n t i n u i n g on t h e i r jobs m e a n s depriving t h e m selves a n d t h e i r families of t h e necessities of life. And private i n d u s t r y now h a s pension plans too — m a n y of t h e m better t h a n t h e city's plan. T h e n e w s p a p e r s told recently of a school t e a c h e r in Newark, N. J., who left his job to become a t r u c k driver, because it paid almost twice as m u c h . T h a t situation Is Just as t r u e i n New York City, a n d . as a result, city employees a r e leaving t h e i r jobs in record n u m b e r s . I n a d d i tion, some of those who r e m a i n o n t h e i r city jobs a r e r e s e n t f u l of h i g h e r salaries paid in private i n d u s t r y a n d are so preoccupied w i t h personal f i n a n c i a l problems t h e y c a n n o t give t h e i r best to t h e job. T h i s is a serious problem for city workers a n d for t h e city as a whole. T h e r e is no easy solution. U n d e r o r d i n a r y circumstances, t h e obvious solution would be t o raise t h e salaries of city e m ployees. B u t t h e t r e m e n d o u s rise In t h e cost of living h a s hit t h e city itself, just as it h a s h i t city workers. Until t h e city Is r e h a b i l i t a t e d financially, no responsible official c a n promise i m m e d i a t e salary i n creases down t h e line. T h e r e is one simple step, h o w ever, t h a t c a n be t a k e u almost a t once to increase t h e t a k e - h o m e pay of city employees. To u n d e r s t a n d it, one should know how t h e city's pension plans work. Because it is t h e easiest to explain, let's look at t h e t e a c h e r s ' pension p l a n . T h e t e a c h e r s ' pension law p r o vides a m i n i m u m pension paid f o r by t h e city of 25 per cent of t h e average salary in consecutive five y e a r s before retirement. The t e a c h e r s also m a y purchase, t h r o u g h m o n t h l y payroll d e d u c tions, a n a n n u i t y to equal a n o t h e r 25 per cent of t h e salary. T h i s would be fine u n d e r ordin a r y circumstances. B u t t h e t e a c h e r h a s to m a k e u p for t h e small a m o u n t s paid in t h e early lowsalaried years by p a y i n g r e t r o a c tively when his salary rises. W i t h pay increases in r e c e n t y e a r s a n d with raises d u e to p r o motions, m a n y t e a c h e r s find 20 or 30 percent or even more deducted f r o m t h e i r pay checks as t h e i r .salaries go up. W h a t c a n a n d does h a p p e n u n d e r t h i s system is t h a t a raise o f t e n m e a n s less t a k e - h o m e pay. T h i s should h a v e been b a d e n o u g h . B u t in 1951 t h e law was a m e n d e d to have t h e city pay t e a c h e r s a pension of 1 percent of I Citizens Commlltee t h e average of five years of s e r vice, w h e n a t e a c h e r becomes eligible for r e t i r e m e n t . T h e r e was a gimmick in t h i s law. I t provided t h a t a t e a c h e r could h a v e this larger pen.sion only if h e increased his a n n u i t y p a y m e n t s to t h e s a m e e x t e n t — so t h a t t h e a n n u i t y aLso would be 35 per cent instead of 25 per cent. T h e option was to refu.se to sign u p for t h e plan a n d lose t h e opp o r t u n i t y for a larger city pension. Some t e a c h e r s , who h a d to i n crease their a n n u i t y p a y m e n t s for as m u c h as 20 or 30 years r e t r o actively, f o u n d t h e y could draw n o s a l a r y at all for as m u c h as a year in order to m a k e u p t h e increase. T h i s law was called t h e Clancy Law. T h e r e was anotlier Clancy Law, for city employees who b e long to t h e New York City E m ployees R e t i r e m e n t System, so all were a f f e c t e d in t h e s a m e way. T h e gimmick a n d t h e r e s u l t a n t h a r d ships a r e not limited to t e a c h e r s , b u t apply also to clerks, inspectors, engineers, a u t o - e n g i n e m e n , s t e n o g r a p h e r s a n d laborers. W h a t I propose is t h a t we m u s t discard t h e provisions of t h e two Clancy Laws which require t e a c h ers a n d city employees t o m a t c h t h e city's c o n t r i b u t i o n s to p e n sions. "Tlus will enable every city employee to get t h e full 35 per cent pension a n d decide for h i m self how big a n a n n u i t y h e w a n t s to a d d to t h i s pension. . City employees would be p e r m i t t e d t o reduce t h e i r m o n t h l y contributions t o t h e scale t h e y paid before t h e Clancy Law went i n t o effect. T h i s will have t h e effect of a s u b s t a n t i a l salary nicrease. I t will provide more t a k e - h o m e pay, a n i m p o r t a n t f a c t o r in t i m e of o u t rageous price increases, a n d w i t h out increasing t h e employee's i n come tax. I t will enable city employees t o h a v e t h e necessities of life while a new city a d m i n i s t r a t i o n .seeks a n d finds t h e m e a n s to raise city salaries. Some savings to t h e city would result f r o m t h i s plan. Using t e a c h ers a s a n example again, t h e a v e r age salary of t e a c h e r s a t r e t i r e m e n t is f r o m $6,000 t o $6.B00 a n nually. A larger pension would e n courage earlier r e t i r e m e n t s . Tlie saving is obvious w h e n a $6,000 t e a c h e r is replaced by a y o u n g e r one at $3,600. I n addition, t h e city would save some h u n d r e d s of t h o u s a n d s of dollars in interest t h a t it will not have to pay because a n n u i t y contributions will be smaller. W i t h o u t c o u n t i n g t h e savings, t h i s p l a n would cost t h e city a n e s t i m a t e d $5,000,000 a year f o r t h e teachers, a n d $8,000,000 f o r o t h e r city employees — a small a m o u n t when m e a s u r e d a g a i n s t t h e dividends in improved m o r a l e a n d b e t t e r h u m a n relations, I also propose on J u l y 1, 1954, t h e beginning of t h e first full b u d get year of m y a d m i n i s t r a t i o n , t o install t h e Meyer salary schedule for teachers. At t h a t time it will cost $1,250,000 to do .so. I t s effect will be 'way out of proportion t o t h e total a m o u n t ow money i n volved. F o r example, a t e a c h e r h a v i n g 8 years i n service will be receiving a n increase of $^97 over existing salary schedules. A t e a c h - HALLEY er with 12 years of service will get a n increase of $495. While t h e Meyer schedule does npt a f f e c t t h e initial or final salary of t e a c h e r s , it does a d j u s t t h e a n n u a l i n c r e m e n t s into m e a n i n g f u l schedules t h a t will give a sub.stantial pay increase to most of t h e t e a c h e r s who are not already a t m a x i m u m . TJiese p l a n s a r e only a small p a r t of a wide a n d overall p r o p r a m to improve t h e working c o n ditions a n d morale of all our city employees. An idea of t h e grim need f o r Improvement c a n be gained f r o m t h e f a c t t h a t 40,000 city employees t a k e h o m e leSs t h a n $50 a week a n d 90 per cent t a k e h o m e $80 a week or less. Mo.st of these people h a v e to s u p p o r t families. Small wonder t h e city employee envies t h e t r u c k driver. New York City's employees can a n d m u s t h a v e increased salaries a n d improved working conditions. I h a v e given t h i s problem long a n d serious t h o u g h t a n d have evolved a positive p r o g r a m to which I pledge myself. I n my b u d g e t analysis last spring I showed t h a t by increased efficiency in city d e p a r t m e n t s , w i t h o u t p a y cuts or firings, we could save f r o m 25 to 30 million dollars. T h e s e savings will be usetf to pay s a l a r y increases to city employees. I favor h i g h e r real estate taJ^es u p to t h e full 2V2 p e r c e n t to be voted on in t h i s election. T h i s will bring a n o t h e r 40 or 50 million dollars into The city's t r e a s u r y a n d m a k e it more feasible to pay city employees a living wage. T h e s e are positive steps a n d will be refiected almost Immediately in t h e pay checks of city employees. T h e r e is a t h i r d possibility — a n d t h i s I call "if money." W e m u s t h a v e more s t a t e aid to provide t h e services to which t h e citizens of New Yoi'k City are e n titled a n d I shall fight Governor Dewey a n d his dirty political m a chine until New York City gets a s q u a r e deal f r o m t h e Legislature. Tliis is one b a t t l e I a m longing to get going. S a l a r y increases alone, however, will not enable New York City to compete with private i n d u s t r y for t h e best t a l e n t s t o r u n our governm e n t a n d will n o t m a k e t h e cily worker give his best to t h e job. I have, t h e r e f o r e , decided on a specific p o i n t - b y - p o i n t p r o g r a m t o r e m e d y this situation. Some of t h e points are s e l f - e x p l a n a t o r y , o t h e r s will be d e t a i l e d : • 1. A five-day, f o r t y - h o u r week for all city employees. 2. Equal pay for equal work. T a ' o city employees should not work Bide by side a t d i f f e r i n g m a x i m u m salaries. 3. I m m e d i a t e installation of a c a r e e r - s a l a r y plan. T h i s p l a n h a s been kicked a r o u n d f o r five years without a n y reason. We m u s t h a v e a Classification B o a r d to study j o b duties, set u p job r e q u i r e m e n t s , establish proper salaries a n d a c t whenever necessary to bring wages a n d duties into line. Every e m ployee m u s t have t h e right to b r i n g his case before B o a r d if h e feels his title is out of line with his for the Election of Ilalley—Caimdo—Mellen— duties or h i s salary o u t of line with his title. T h i s would do away with t h e p r e s e n t vicious system whereby i n c r e m e n t s come a t t h e suggestion of T a m m a n y district leaders t h r o u g h t h e Mayor's p a t r o n a g e dispenser. We m i g h t note t h a t Louis Cohen, who filled t h i s dii'ty job for M a y o r O'Dwyer, is a t p r e s e n t associated with t h e c a m p a i g n of R o b e r t W a g ner, as are t h e district leaders who evolved a n d who p e r p e t u a t e t h i s system. 5. A s t r o n g Civil Service C o m tor. Most of t h e r e f o r m s I p r o pose will be ineffective unless we establish a D e p a r t m e n t of P e r s o n nel A d m i n i s t r a t i o n u n d e r a n o n political Civil Service Commission. 6. U n i f o r m lime a n d leave rules. Now each d e p a r t m e n t still h a s its ov/n rules a n d regulations, typical of t h e city's crazy-quilt a p p r o a c h . 7. E l i m i n a t i o n of o u t - o f - t i t l e v/ork. T h i s is a m e t h o d by which t h e city c h e a t s employees, f o r c i n g t h e m to assume responsibilities a n d duties of jobs with h i g h e r titles, but not giving tliem t h e h i g h e r pay. Fire d e p a r t m e n t officers have gone to court to b r e a k this vicious j^^ystem. No court a c tion will be necessary u n d e r my administration. 8. Quicker a c t i o n on r e t i r e m e n t a n d back pay checks. I t now takes a n y w h e r e f r o m six m o n t h s to a year before a retired city employee begins drawing his check/3. I n e f f i ciency is t h e only i t a s o n for t h i s hardship. 9. A Labor R e l a t i o n s Act for city employees. City employees are e n titled to have collective b a r g a i n ing privileges a n d grievance m a chinery to replace t h e p r e s e n t setup, which is based on w h i m , bluster a n d w h o m - y o u - k n o w . T h i s is t h e essence of my p r o g r a m to improve wages a n d working conditions for city employees. Implicit in every point is t h a t city employees m u s t not be at t h e m e i c y of politicians. I m a k e t h e f u r t h e r pledgee t h a t u n d e r m y a d m i n i s t r a t i o n no city employee will be compelled to buy tickets for political h a c k s or t h e i r racketeering f r i e n d s or to d o n a t e to political club j o u r n a l s in order to get a promotion. Political p a r a s i t e s c a n a n d m u s t be prevented f r o m sucking money f r o m decent, honest employees. T h e employees m u s t be secure in t h e knowledgee t h a t merit will be t h e only basis for promotion a n d pay raises, a n d t h a t suggestions for improved efficiency will bring r e w a r d s a n d not t h r e a t s .
