Blank to be the Director of the Division of Insurance Fraud. Blank was named Interim Director following the resignation of Dan Anderson in July, and his official start date as Director is September 3. Blank began his law enforcement career in 1988 with the Royal Palm Beach Police Department in West Palm Beach, Florida. He served as a patrol officer, patrol sergeant, narcotics, person and property crime detective, crime scene tech, internal affairs, PIO and supervised the Criminal Investigations Division. Blank started with DIF in 1996 when he joined the workers compensation squad in Palm Beach County. Since that time, Blank has served in all areas of the Division earning the ranks of Lieutenant, Captain, Bureau Chief of Workers Compensation Fraud and Major of Law Enforcement Operations. Director Blank told the PIP Source “I have seen many changes since joining the Division but one thing has remained constant throughout that time; the dedication and commitment of all our members to safeguard the citizens of this state against all acts of insurance fraud. Criminal trends are always evolving and so must we to remain effective. During the last few years, the Division has made great strides towards this purpose. Effective partnerships have been formed, the number of dedicated prosecutors has significantly increased, technological advances have been made, and the working relationship with the insurance industry as well as regulatory and enforcement agencies has never been better. I look forward to working with all of you as we move forward and confront new challenges.” Before starting a career in law enforcement Blank served his country in the United States Air Force from 1982 through 1986. He received the rank of sergeant and completed his service with an honorable discharge. Blank is well respected by both law enforcement and the insurance industry. August 2013 Page 2 Jacksonville Man Charged in Staged Accident Also Indicted By Feds For Allegedly Supporting Terrorists Acting United States Attorney A. Lee Bentley, III, along with Acting Assistant Attorney General John Carlin, U.S. Department of Justice, National Security Division, and Michelle Klimt, Special Agent in Charge, FBI Jacksonville Division, announced in July the return by a grand jury of an indictment charging Shelton Thomas Bell (19, Jacksonville) with conspiring and attempting to provide material support to terrorists. If convicted, Bell faces a maximum penalty of 15 years in federal prison on each of the two charges. The Division of Insurance Fraud (DIF) arrested Bell on unrelated charges in January of this year where he was charged with participating in a staged accident that occurred in June 2012. The indictment alleges that between May 2012 and September 2012, Bell and others engaged in physical, firearms, and other training in preparation for armed conflict in the Middle East, which Bell described as "the actions of jihad." Bell allegedly solicited other individuals, including juveniles, to travel overseas with him in furtherance of this conspiracy. Bell made video and audio recordings intended to be distributed to others once he arrived in the Middle East, for the purpose of soliciting and recruiting others there to participate in violent jihad. In September 2012, Bell and a juvenile traveled to Amman, Jordan and made contact with an individual who could facilitate their travel to Yemen to participate in violent jihad. Bell is currently detained in the Duval County Jail on unrelated charges. This comes on the heels of guilty pleas by four other defendants in June. Clinic owners Luis Ivan Hernandez, 40, and Maria Testa Baceiro, a/k/a “Maria Testa,” 29, both of Miami, along with massage therapists Olinda Rodriguez, 39, of West Palm Beach, and Iris Roca, 41, of Davie, each pled guilty to one count of conspiracy to commit mail fraud. Those defendants include Helenne Vazquez, 30; Maykel Marquez, 32; Yenisleydi Ramos, 26; Noelia Marichal, 52; Nelson Felix Martinez Torres, 47; Yanet Hernandez Marichal a/k/a Yanet Hernandez, 26; Wilfredo Sauceda, 33; Alien Moya, 29, all of West Palm Beach; Oscar Montiel Martinez, 34, of Lake Worth; and Juan Francisco Avon, 61, and Yeisy Chouza, 31, both of Miami. Defendant Chouza is scheduled to be sentenced on September 30, 2013, at 9:00 a.m. before U.S. District Judge Kenneth A. Marra in West Palm Beach. Defendants Moya, Sauceda, Montiel Martinez, Martinez Torres, and Hernandez Marichal are scheduled to be sentenced on October 21, 2013, before Judge Marra. Defendants Ramos, Marichal, Vazquez, Marquez, and Avon are scheduled to be sentenced on October 28, 2013, before Judge Marra. To date, 92 defendants have been charged for their participation in this automobile insurance fraud scheme. Of those 92 defendants, 56 have been charged federally by the U.S. Attorney’s Office, resulting in court-ordered restitution of more than $5 million to the defrauded insurance companies, while 36 defendants are being prosecuted by the Palm Beach County State Attorney’s Office. The PIP Source Page 3 Division of Insurance Fraud Names New PIP Lieutenants in Orlando The Division of Insurance Fraud (DIF) has named Laquanda Green and John Savino to be the new lieutenants taking charge of the PIP squads in the Orlando office. Green and Savino both started with DIF in 2008, and both have been involved in numerous high profile investigations including staged accident rings and straw ownership of clinics. Lt. Green was previously assigned to the Health Care Fraud Task Force with the Metropolitan Bureau of Investigations (MBI) while Lt. Savino was previously assigned to the Federal Health Care Task Force for the Middle District of Florida. Lt. Green began her career in law enforcement in 1997 with Orange County Corrections and later as a Deputy working in patrol with the Orange County Sheriff’s Office in Orlando. She then worked for the Department of Motor Carrier Compliance as a compliance review officer, commercial motor vehicle homicide investigator and an officer on radiological nuclear team and the hazardous materials team. Lt. Savino began his law enforcement career in 1982 with the New York City Police Department. He served as a patrol officer, narcotics investigator and was promoted to Detective in 1989. John spent eighteen years investigating reports of sexual assaults and child abuse while assigned to the Manhattan Special Victims Squad, and was promoted to the prestigious rank of 1st Grade Detective. During his time with the Special Victims Squad, he investigated thousands of reports of rape and sexual assaults. He was tasked with rewriting the policy used by NYPD when investigating sexual assaults and co-authored two text books detailing the best investigative techniques for rape investigations and other serious crimes. In September of 2001, after the World Trade Center Tragedy, Savino along with an elite group of Detectives were assigned to the New York City Morgue for several months and tasked with attempting to identify the victims of the World Trade Center Disaster. We congratulate Lts. Green and Savino and wish them much success in their new roles. Chiropractor Stephen Lovell Sentenced to 5 Years in Federal Prison Chiropractor Stephen Lovell, 55, was sentenced to five years in federal prison following his conviction in February. United States District Judge John E. Steele sentenced Lovell for conspiracy to commit health care fraud. As part of his sentence, the court also entered a money judgment in the amount of $1.695 million, the proceeds of the offense. A jury found Lovell guilty on February 28, 2013, following a two-week trial. According to testimony presented at the trial, Xtreme Care Rehabilitation Center (Xtreme Care) was operating in Cape Coral, Florida as an unlicensed health care clinic since 2009. The State of Florida licensing requirements were circumvented by the conspirators as a result of the purported exclusive ownership of these clinics by licensed health care practitioners, including chiropractor Lovell. As a result of the purported ownership of the clinics by a licensed health care practitioner, these clinics avoided greater regulatory scrutiny. In actuality, other conspirators including Francisco Huici Fernandez and Ernesto Diaz were the true owners of the clinics. In furtherance of the health care fraud, the conspirators caused individuals to be recruited to be involved in staged accidents and received injuries. These individuals would then go to Xtreme Care in exchange for payment. Xtreme Care then billed insurance companies by submitting false claims for treatments of these patients, which was either never provided or was not medically necessary. Upon payment by the insurance company, the proceeds of the fraudulent activity were then transferred to corporations created by the conspirators to launder the proceeds of the criminal activity. Fernandez and Diaz previously pleaded guilty for their roles in the case. Fernandez was sentenced to five years and ten months while Diaz was sentenced to eight years. This case was investigated by the Cape Coral Police Department, the Internal Revenue Service Criminal Investigation, the United States Secret Service, Hialeah Police Department, City of Miami Police, the Division of Insurance Fraud, along with the assistance of the National Insurance Crime Bureau and the Federal Reserve Board - Office of the Inspector General, and was prosecuted by Assistant United States Attorney Jesus M. August 2013 Page 4 PIP FRAUD – In The News Division of Insurance Fraud Arrests Orlando Clinic Owner For Third Time The Division of Insurance Fraud (DIF) arrested Dayleann Marie Vallejo-Ruiz, 28, a licensed massage therapist and owner of Injury Rehabilitation Center in Orlando, for the third time in July. In this case, Vallejo-Ruiz was charged with insurance fraud, grand theft, organized scheme to defraud for billing Allstate nearly $17,000 for services not rendered. Vallejo-Ruiz was arrested in June for a similar scheme at her clinic, after an arrest in May for a scheme involving another Orlando clinic, Colonial Rehabilitation. State Farm Sues 1-800-ASK-GARY Alleging a "massive fraud scheme" of kickbacks and patient brokering, insurance giant State Farm has filed a federal lawsuit against chiropractor Gary Kompothecras, his clinics and the 1-800-Ask-Gary doctor-lawyer referral service. State Farm reportedly has paid more than $19 million in no-fault medical claims since 2005 to the Physicians Group accident clinics Kompothecras founded. State Farm asserts that a "substantial portion" of the charges were unlawful because they were rooted in a patient referral system that violates Florida laws, including the Patient Brokering Act, the Anti-Kickback Statute and the Patient Self-Referral Act. Kompothecras’ attorney Greg Zitani in Sarasota emailed a statement from the defendants explaining that all of the companies named in the lawsuit comply with Florida law and the suit contained "blatent lies" about the referral service. "Also all of the attorneys who are part of the Ask Gary network are not advised or required to refer any of their clients to the Physicians Group or any medical providers," the statement reads. Appellate Ruling Threatens Hillsborough Ordinance Targeting PIP Fraud An appellate court has effectively ended Hillsborough County's attempt to regulate clinics that law enforcement officials say enabled a proliferation of staged auto accidents. The Second District Court of Appeal has upheld without comment a temporary injunction against county enforcement of the ordinance after a lower court ruled in part that regulation of clinics is the state's responsibility. Hillsborough County Commissioner Kevin Beckner, working with the Hillsborough County Sheriff's Office, pushed the local law. Enforcement of the ordinance has been on hold since the lower court ruling late last year. The nearly 30 clinics that challenged the law said it was overly broad and impinged on the regulatory responsibilities of the state. They said it had an arbitrary and subjective process for people challenging the denial of a license, subjected them to unlawful searches from a broad array of law enforcement and included other requirements that made it all but impossible for otherwise legal clinics to operate. "None of my clients are in favor of fraud," said Luke Lirot, an attorney for the clinics who challenged the ordinance. "They certainly wish that people involved in this line of work would refrain from any conduct of that nature. Palm Beach Woman Arrested in Staged Accident Faika Khader knew she'd be involved in a car crash days before it happened. She filed a claim with Farmers Insurance and began receiving treatment for her injuries at Apex Chiropractic & Rehab Center in West Palm Beach. About a month later, Khader admitted to Farmers that she had staged the accident. Khader explained it like this: She told someone she needed money for school and got a phone call days later from a "business man." She met up with him in July at a Delray Beach gas station and he gave her $900 cash to buy an insurance policy. She repeated the story to a Division of Insurance Fraud (DIF) detective, with a few differences: She said she met a stranger at a gas station who told her she could earn $2,000 by crashing her car. He said she could follow up with a chiropractor for financial assistance. Khader also said the other two passengers in her car during the crash were both strangers. Khader, 31, of Boynton Beach, was arrested by DIF and booked into the Palm Beach County Jail. Rumao committed acts of Insurance Fraud resulting from knowingly participating in an intentional staged motor vehicle crash on July 12, 2009 for the purpose of claiming personal injury protection (PIP) benefits. After the crash, Rumao allegedly treated at a chiropractic clinic for several months. The insurance company was billed for more than $54,000 for this staged accident.
