Hernandez, who operated Magic Hands Medical Services, was previously arrested in May 2013 and November 2013 for organizing three staged accidents. She was most recently charged with organizing another staged accident in September 2011, which resulted in more than $62,000 in fraudulent claims. Beginning in May 2013, the Division of Insurance Fraud (DIF) arrested 20 subjects as part of Operation No-Med Services. Those originally charged included a medical doctor, two clinic owners, five additional medical licensees, six staged accident organizers and six other subjects as part of an investigation involving four accident clinics in Miami-Dade County. With the cooperation of several subjects charged in the case, DIF identified the owners of three of the clinics involved. Investigation revealed that Ricardo Jimenez, 49, was the true owner of Magic Hands Medical Services and was a partner with Delvis Gonzalez, 31, in New Life Rehab Services. Jimenez was also the owner of record for Clarke Medical Services. All three clinics have since closed. The Miami-Dade State Attorney’s office issued warrants against Jimenez and Gonzalez, charging them with various counts of organized scheme to defraud, operating an unlicensed clinic, insurance fraud and grand theft. The charges included $309,247 in clinic billings for four staged accidents that occurred between August 2011 and September 2012. Gonzalez was arrested in February by Cape Coral Police; Jimenez remains a fugitive. “I am proud of our investigators for their commitment to keeping fraudsters off the streets and out of the pockets of hard-working Floridians,” said CFO Atwater. “Every act of fraud drives up the cost of insurance and we refuse to allow those selfish acts to continue.” DIF is actively seeking Ricardo Jimenez. Anyone who may have information on the whereabouts of Jimenez can call 800-378-0445 and may be eligible for a reward under the DFS Anti-Fraud Reward Program. Citizens who provide tips can remain anonymous. Jimenez was featured as the Most Wanted Criminal in February 2014’s issue of the PIP Source. Hugo Goldstraj, 67, the medical doctor who was arrested in May 2013 in conjuction with this case, pled guilty last month and agreed to surrender his medical license to the Florida Department of Health. This case is part of a continuing crackdown by CFO Atwater’s Division of Insurance Fraud and the National Insurance Crime Bureau (NICB) in the fight against auto insurance fraud in Florida. The insurance companies defrauded in these claims include Allstate, Geico, Imperial Fire & Casualty, Kingsway Amigo, State Farm and United Auto. June 2014 Page 2 PIP FRAUD – In The News Six Arrested in Tallahassee Towing Company Fraud Case Chief Financial Officer Jeff Atwater announced that six employees of a Tallahassee towing company have been arrested for filing fraudulent insurance claims. The Department of Financial Services’ Division of Insurance Fraud and the Leon County Sheriff’s Office, in a joint investigation, discovered that Auto Doctor Towing Company employees filed fraudulent claims to eight different insurance companies. “I am proud of our investigators and the Leon County Sheriff’s Office for working together to shut down this illegal operation that’s responsible for defrauding insurance companies and consumers out of thousands of dollars,” said CFO Atwater. “Insurance fraud not only hurts businesses, it takes money from all Floridians through higher insurance costs.” The investigation revealed that the company’s manager, Anthony Ragsdale, established a scheme to enrich himself by double charging for his company’s services. Despite already being covered by AAA, Ragsdale’s customers were instructed to bill AAA and their automobile insurance company for towing and mileage charges. As a result of this deceptive practice, the towing company was paid twice for their services. Florida CFO Jeff Atwater is Keynote Speaker for 44th Annual LAAIA Convention Florida's Chief Financial Officer Jeff Atwater was invited to serve as the keynote speaker for the 44th Latin American Association of Insurance Agencies (LAAIA) Annual Convention during the associations luncheon on Friday, August 1st. LAAIA is a strong advocate for strengthening legislation to fight insurance fraud. Their convention runs July 30 - August 2. The insurance trade fair is the largest of its kind in South Florida, with over 100 exhibitors. There are 16 professional development courses and 36 CE credits available at the event. NICB Releases Updated Staged Accident Videos In cooperation with the Los Angeles Police Department (LAPD), the National Insurance Crime Bureau (NICB) has produced new high definition videos showing some of the most common methods of staging motor vehicle accidents to defraud insurance companies. “Staged or deliberately caused accidents continue to be a problem across the country,” said Joe Wehrle, NICB president and CEO. “We appreciate the opportunity to work with the LAPD to make the public aware of these schemes and to let them know what to look for.” Included in the videos are accidents scenarios known as curb drive down, four vehicles fraud, swoop and squat and left lane fraud. WFTS ABC Action News Coverage in Tampa Bay - Staged Accidents Staged car accidents are an easy way for criminals to cash in without you even knowing you’re a victim. WFTS ABC Action News recently aired a story on staged accidents in the Hillsborough County area. Coalition Against Insurance Fraud Releases New Public Service Videos The Coalition Against Insurance Fraud conservatively estimates that insurance fraud steals $80 billion a year. The PIP Source PIP FRAUD SPOTLIGHT ON – Page 3 PIP Victories As we conclude our fourth year of publication, we would like to spotlight some of the successes of the fight against PIP fraud. Personal Injury Protection (PIP) fraud remains a problem in South Florida. However, PIP fraud increased dramatically in 2009-10, spreading throughout the state and continued to rise through the 2011-12 fiscal year. The Division of Insurance Fraud (DIF) responded by creating dedicated PIP squads in Miami, Broward, Palm Beach, Orlando, Tampa, Jacksonville and dedicated detectives in Ft Myers. As a result, there have been more than 1850 PIPrelated arrests statewide since CFO Jeff Atwater was elected. Arrest Types Published In The PIP Source Since July 2010 DIF made over 1,000 arrests for staged accidents, including nearly 300 staged accident organizers and recruiters. DIF arrested more than 80 clinic owners, 15 doctors and 35 chiropractors. DIF arrested nearly 200 clinic employees, half of which held a license issued by the Department of Health. DIF made 130 arrests related to what is called jump-ins, persons who were not actually involved in the accident, but later claimed to be and filed false claims. DIF arrested nearly 100 patients for their involvement in fraudulent claims, not related to staged accidents. DIF made 55 arrests in solicitation / patient brokering cases. DIF made more than 175 arrests involving fake insurance cards. PIP Fraud May Be On The Decline Since the 2012 HB119 legislation became effective in 2013, Florida has seen a decrease in PIP Fraud. The projected numbers show a potential 16% decrease in 2013-14 from 2011-12, the highest year for PIP fraud referrals. The new legislation, passed on the heels of the hard work of DIF and other agencies, has had an impact on reducing PIP fraud in Florida. This success is reflected in some of the following case highlights: The federal / state coordinated effort known as Operation Sledgehammer in Palm Beach County resulted in more than 100 arrests in a massive scheme involving staged accidents and PIP clinics associated with fraudulent billing in excess of $18 million. This unprecedented investigation by a task force comprised of the Division of Insurance Fraud, the Federal Bureau of Investigation, the Internal Revenue Service, the United States Attorney’s Office and the Palm Beach County State Attorney’s Office was the most successful and impactful case of its kind. Look for a more detailed review of this case in a future issue of the PIP Source. Another successful operation by the Jacksonville DIF office involved several staged accident rings, which resulted in more than 100 arrests since 2012. One of the participants arrested was also indicted by the federal government for providing material support to terrorists. Another important case involved the theft of a corporation identity in Miami. DIF arrested a man who hijacked the Florida corporate identity of a diagnostic center that had closed in 2009 and used it to fraudulently bill for more than $726,000 worth of diagnostic tests in 2011 that were never performed. DIF also obtained an arrest warrant on a second individual in a related scheme that resulted in nearly $900,000 in fraudulent billings by another corporation. The diagnostic center had closed in 2010 but the subject took over the corporation in 2011 and billed for services that never occurred. In Orlando, a major case involved the theft of patient information data from a hospital. DIF arrested and convicted three subjects who illegally stole the sensitive information from more than 12,000 patients, that was used in a scheme to solicit patients to go to several clinics in Orlando. In Tampa, DIF arrested three high profile clinic owners in separate cases, charging each with structuring (money laundering) involving a total of more than $1.5 million in clinic proceeds. Several other owners involved in the scheme remain at large. The Tampa area PIP problem, which exploded several years back, has declined dramatically. PIP Fraud Spotlight continues on page 4 June 2014 PIP FRAUD SPOTLIGHT ON – Page 4 PIP Victories A major focus of enforcement remains targeting unlicensed clinics. DIF has arrested several clinic owners who operated unlicensed clinics, often using a DOH licensee as a straw owner. These clinics have filed millions of dollars in illegal billings while avoiding AHCA licensing requirements and oversight. One related case involved a man who was a fugitive from justice following a Medicaid fraud conviction, who opened and operated an unlicensed PIP clinic under a false identity. One of the most important and impactful successes have been the arrests of fraud committing chiropractors statewide. DIF has arrested 35 chiropractors statewide since 2010, the significance of which is that many of these chiropractors are infamous in their long-time involvement in PIP fraud. Many of them were involved in dozens of different fraudulent clinics over the last 10-20 years, and their removal from the system has had a dramatic effect on PIP fraud. Many of these chiropractors were also involved as straw owners of clinics, concealing the true control of the clinic by criminals. The largest group was taken down in Operation Sledgehammer, which included chiropractors Jennifer Adams, Aaron Freedlander, Hal Kreitman, Kenneth Karow, Lawrence Schechtman and Hermann Diehl, who held a total combined experience of more than 110 years in Florida. Another joint investigation with federal agencies brought down the long-time duo of Stephen Lovell and William Hall, who were licensed in Florida for a combined 47 years. The impact of the takedown of these chiropractors, who were involved in massive fraud over a long period of time, and who now are forever out of the business, cannot be underestimated. Other Initiatives in the Fight Against PIP Fraud The Division of Insurance Fraud (DIF) and other entities (Florida Automobile Joint Underwriting Association (FAJUA) and the Florida Carpenters Union) provide financing for dedicated prosecutors throughout the state to handle insurance fraud cases. Most of them are focused on the prosecution of PIP fraud. Currently, there are 19 dedicated prosecutor positions in the state; in Miami-Dade, Broward, Palm Beach, Orange, Hillsborough, and Duval counties. The close working relationship between DIF and other state agencies such as the Department of Health (DOH) and the Agency for Health Care Administration (AHCA) results in a significant impact on PIP fraud. The dedicated prosecutors work hand in hand with the agencies in the relinquishment or revocation of the licenses that these fraudsters have used to operate their schemes. Most licensees arrested by DIF surrender their licenses when the cases are prosecuted. DIF works closely with the National Insurance Crime Bureau (NICB), and participates in their South Florida and Central Florida Major Medical Fraud Task Forces. This working relationship is important to the success of fighting PIP fraud, as it joins law enforcement and the insurance companies SIU members in an important information exchange. In 2012, DIF partnered with the Florida Highway Patrol (FHP) to create a webpage to educate the public about staged crashes. Most Floridians are aware of the damage that storms can inflict and have taken steps to minimize a storm's physical impact. But financial preparedness is an often overlooked part of hurricane season preparation that can make recovering from a storm more manageable for you and your family. Insurance companies don't issue coverage when a hurricane lurks close to land, so do not wait until the last minute to insure your home. Make sure your policy covers the value of your home, as well as its contents, and that your policy number is easily accessible after a storm. And be sure that important financial information is stored in a safe and accessible place. Other financial tips to make your storm recovery more manageable include having cash on hand in case ATMs are out of service, having and using a credit card and keeping your receipts to document repair transactions. In anticipation of a storm, you should also make sure your bill payments are current to avoid potential late fees. Following a storm, be aware of the potential for scams that attempt to take advantage of storm victims. When hiring a contractor or working with a public adjuster, make sure that he or she is appropriately licensed. It is also important to research contractors to ensure they carry adequate insurance coverage and keep logs of all telephone conversations and copies of all documents signed. A little research and preparation can go a long way to protect you and your family from the many costly hardships that can come with a storm.
