Annual W. Edward Sell ‘45 Legal Lecture
The seminar will focus on the disagreement among historians, politicians
and jurists regarding the meaning of the Second Amendment: “A well
regulated militia, being necessary to the security of the free state, the
right of the people to keep and bear arms, shall not be infringed.” The
panelists will discuss gun rights, gun violence and gun restrictions at the
state as well as federal level, as well as the ambiguity of the language
of the Amendment and how the right to bear arms has been construed in
the recent cases such as District of Columbia v. Heller 2008 and
McDonald v. Chicago 2010. The politics of gun control and the power
of groups such as the NRA, the Brady Campaign, and the Bloomberg
Advocacy Group will also be discussed. Questions to be considered
include: (1) What was the original meaning of the Amendment at the
time it was ratified? (2) Does the Amendment protect a personal right to
gun ownership or only a collective right to participate in the militia? (3)
What type of weapons does an individual have a right to own? Can the
“in common use standard” be adequately defined? (4) Is gun violence a
product of inadequate gun control? (5) What can be done to keep guns
from violent individuals? and (6) Why is the U.S. alone among
democratic states with such limited restriction on gun ownership and high
levels of gun violence? Panelists confirmed to date: Mike Lucas, Esq.

Following the lecture, the W. Edward Sell in Law Award will be presented
to Bob Shust, Esq., ’59, retired partner with Tener, Van Kirk et al, and
W&J Trustee Emeritus.
